Because he got to relive it? And get out of jail for a few days?

That has to be the reason he didn't just go ahead and plead guilty. Enjoyed the celebrity of it all, and probably just as surprised as we were that it all ended so fast.

I Agee with others. He as enjoyed this trial, why else wouldn't he have pleaded guilty. He has done nothing to defend himself. IMO

That must be the reason for such gloom. He was hoping for a 4-day trial, and only got a half day today, and maybe a half day tomorrow. I think he was exspecting things to be longer, and more drawn out, but that DNA along with the videos just killed him.

There is no way, in my mind, that they won't find him guilty.

And, from what I've read, that's what sociopaths/psychopaths do for thrills. They like the attention -- good, bad or indifferent.

It was shocking to hear that those comments he made (jail tapes) were 2 years after he was jailed. Certainly speaks to killer having a very vivid memory of this crime. IMO.

I don't know anything about how the appeals process works, but I do know that they have several opportunities to appeal. Do you think he will appeal?

IANAL, but I believe the first appeal will be automatic.

Anyone know for sure?

ETA: First will be automatic IF he's sentenced to death which I am assuming will happen.

The primary distinction is that capital cases are automatically appealed directly to the FloridaSupreme Court.

Sooo many heroes in this case. I'm sure they don't see it that way. They couldn't save poor little Cherish but they allowed for a quick arrest and much evidence preserved. No further victims. For that I am thankful.

I don't know why but I think the jury will hang on punishment...it has to be unanimous for the death penalty.

Explicit details of Cherish Perrywinkle's rape, murder bring jury to tears

"JACKSONVILLE, Fla. - The jury deciding the fate of the man prosecutors say took the life of 8-year-old Cherish Perrywinkle in June 2013 heard the final testimony Tuesday in the case against Donald Smith, who is charged with kidnapping, sexual battery and first-degree murder in Cherish's death.

That testimony included graphic details from Medical Examiner Valerie Rao, who described Cherish's brutal rape and tortured final moments of life.

Rao walked the jury through the autopsy photos she took as she worked to determine how Cherish spent the last hours of her young life and how she was killed. Her determination was that the little girl had endured severe sexual trauma to her body before being strangled.

Rao said Cherish fought back.

The testimony brought some of the jurors to tears.

After about 45 minutes of trying to clinically describe the torture and murder, Rao appeared to be emotionally drained as she requested a short break....

The attorneys will make their closing arguments Wednesday before the case goes to the jury."

They may hang on DP. If they follow the Law and leave out their beliefs they should be able to reach a DP verdict. Nothing redeeming about this guy. Closing should bring it all home. Not sure what the Defense can say other than to pound it into the Jurors how "they" will be "killing" this man. IMO

The same with his manner when speaking to the judge today.

He can be polite and display superficial charm when it serves him like other infamous sociopaths/psychopaths
