I don't know why but I think the jury will hang on punishment...it has to be unanimous for the death penalty.

It is Florida........just sayin......:scared:

( I do plan on a snowbirdship.......someday)

There were 2 trials that stuck with me due to their brutality and depraved killers. Christianson/Newsom and Pettit family (sp?) Now I have 3.

Wanted to stop by and show my support for Cherish. I also was wondering what the defense was trying to get across when they questioned Dr. Rao about how long to blackout vs die. Did the MMA reference mean anything? I didn’t understand where he was going with that.

Editing to add - Thank you for honoring Cherish with such a respectful thread.

<snip> Ron Rhatigan was about 8 when Smith, then about 13, lived two lots away in San Jose Forest...Smith periodically bullied him for little or no reason, mimicking professional wrestling moves that hurt.

“He picked on little kids and beat my 🤬🤬🤬 a couple of times,” said Rhatigan, 51, who now lives in Oregon.

Though Smith developed a reputation as a troublemaker, Rhatigan said Smith switched on the charm when necessary.

“He was all smiles in front of the parents,” Rhatigan said.

<snip> Freeman said Smith was a favorite among a group of younger men he’d let sit on his bunk and view smuggled, pornographic adult magazines. Nicknamed by inmates as Weezy for his age, Smith had access to such items he’d get from other inmates in exchange for commissary goods paid for by his mother, Freeman said.

When Smith wasn’t providing others with material enticements for attention, Smith talked a good game by convincing inmates he was someone to be reckoned with.

“He’s the type of person who can get inside your head and manipulate you,” said Freeman, 25, who was doing time for credit card fraud. “He was a smooth talker and he was a fast talker.”

My take away from the testimony was that Cherish did not suffer as long as State/ME implied. That she likely passed out prior.

That she did NOT suffer long during the asphyxiation.

Didn’t even think about that. Thank you.

But do we know what she endured BEFORE the asphyxiation? I pray that it occurred before the other acts!:tantrum::tantrum::tantrum:
Even though he deserves the death penalty, won't he be somewhat protected on death row? I prefer that he be around other inmates <modsnip>

I understood it to be because Dr. Rao said Cherish most likely died after 3 to 5 minutes of strangulation.......now we all know it is not an exact science.........seconds, minutes.....
The MMA he brought up ( I'm guessing).....was a " pass-out" maneuver that takes 3 minutes ( ish )....
Bottom line Cherish died within 3 to 5 minutes after loss of blood flow....hence the hemorrhage to the eyes etc.

I want him segregated from others. Above link from epiphany speaks to my personal reasons why. He will manipulate and thrive on exerting power over others. Much more access to contraband. No others to brag and share his disgusting acts with who are like him. I want him alone and isolated. If he gets the DP I hope it happens before he dies himself.

That must be the reason for such gloom. He was hoping for a 4-day trial, and only got a half day today, and maybe a half day tomorrow. I think he was exspecting things to be longer, and more drawn out, but that DNA along with the videos just killed him.

BBM: I certainly hope so.

Yes, me too. I'll never, ever forget the Christianson/Newsom trial. I still have nightmares.

I'm very surprised the defense rested so quickly. I couldn't ever guess at what he could possibly use as a defense, but to see the defense call nobody caught me off guard. It makes me wonder whether he would have just pled guilty if this weren't a death penalty case. Given the evidence I've heard, however, the State Atttorney's office certainly wouldn't have accepted anything but a full guilty plea with full time. This man needs to never walk outside in the sunshine ever, ever again. Given his priors, he is well beyond rehabilitation and has continued to escalate his evil violence and manipulation with every new offense. Monstrous.

This article delves into DS's life history. Excellent and the most comprehensive I've seen yet. Thanks, epiphany.

Dr. Rao made it sound like it needed to be 3-5 minutes of constant pressure. So if after a minute he let up...and then started again...and then let up....etc. etc....the whole ordeal could have been much longer. It's sick. :(

State tells judge "this is a natural human reaction for anyone to have" Judge: "I’ll deny motion for mistrial" @FCN2go #DonaldSmith
I missed the ME's testimony. Is there a link handy so I can replay?

IMO the reason for the photo op. He thrives on attention and control. He could care less what we think. We are simply "objects" to him. He only seeks out people he can manipulate and/or fulfill his deviant needs. His control is limited. Now. And forever thank god.

Thanks to all fellow posters too. It's almost over. Being together here made it a bit easier to tolerate this horror :loveyou:
