I'm going to try to follow, but as others have posted, this case is soul wrenching. Cherish should never have been in the position to be with this man, period. He needs to rot.

I did go back to revisit the earlier threads. I have to admit, I did not follow this case closely, I don't know why. But, one thing I came across was the missing stroller. I thought you might know. Did they ever recover the missing stroller that belonged to Rayne -- that she had put into the perp's van when he drove them over to Walmart from Dollar General?

Apparently, she left the stroller in his van while they shopped in Walmart, and didn't take it inside the store with her. When he took off from Walmart with Charity, that stroller was still in his van.

I've never served on a jury, but I once participated in a mock trial proceeding and was on that mock jury. The process was so exhaustive. It wasn't even a "faux" murder trial. I think it was a theft. But trying to convince my fellow jurors to see it it my way -- after the literal checklist of what had to be answered in the affirmative for a guilty finding -- was like pulling teeth.

At one point, I just wanted to scream: "FGS! This isn't even a real trial!" I wanted to go home. It was an entire Saturday consumed with this mock trial.

That is why I was concerned that the kidnapping charge in Charity's case might be a problem. I don't think so now, after reassurance from those who have responded.

He should plead guilty and stop this madness.

As someone else explained, kidnapping does not have to be a forceable taking. It is confining someone after they want to leave. I could go on a date willingly, but if he brings me to his house and won't let me leave and holds me when I want to go, it's kidnapping.

He took her away from a premises and withheld her from her guardian. That's kidnapping.

I can still see her hesitating leaving that store. It breaks my heart knowing what was to come. Monster. True monster.

Yes, it was (is) trespassing, IMO. I don't know the Florida statutes about kidnapping, but in NC, kidnapping is often a charge against those who hold people at gunpoint during a robbery -- they hold them against their will, and that is a kidnapping charge in NC jurisprudence.

Jarreau said his relationship with Cherish’s mother was brief but complicated. It began in 2003, when he said the two met while Perrywinkle was working at a strip club in Jacksonville.

“I was in the Navy and was recently divorced. I would go there a couple of nights a week and drink and that’s how we met. It was basically a one-night deal. It was 2 a.m., we took off, and ended up together,” he said.

Jarreau said Perrywinkle informed him that she was expecting, but when Jarreau requested a paternity test, necessary to add Cherish to his military benefits plan, he said Perrywinkle refused.

Great work, Jax. Thank you. I watched the video in the story you posted, and the father said that he spoke to Cherish every day, and that when he didn't hear from her on the day she was taken, he knew something was wrong.

Among other things, one of the 3 reporters (Paige Kelton) talked about the perceived arrogance of DS, and, if he were to take the stand, that would not play well with the jury. I (IMO) don't think he will be taking the stand, but they seemed to think it was a possibility.

One thing I have noticed, that man does not make eye contact with any camera. His gaze is averted -- downward, usually. In the courtroom proceedings with jury selection, he held that head high -- like he was in charge and very confident.

He maintains his innocence, but when LE pointed out to him that they have surveillance video showing him leaving Walmart with Cherish and walking toward his van, he did admit that she was in his van at that point, but that later she jumped out at a red light. This is to separate himself from implication in her rape and murder -- I guess he's thinking the only thing they can pin on him would be kidnapping (if that, he thinks). [IMO]


Do they have solar powered Sparkies in Florida? It is the Sunshine State.

New Documents Give Insight Into Cherish Perrywinkle's Deah [sic]

O.K. Let's ignore the typo in the headline, and the fact that this is an article from Dec. 2013, but it is news to me. Very interesting article that gives some bizarre information of which I was not aware.

1. When he left the Walmart parking lot in the white van (which was his mother's according to the article), presumably with Cherish, he drove past a family who told police that Smith yelled out to them: "We're going to get cheeseburgers, follow us."
2. The roommate who turned him in, who ws living in DS's mother's house, was the one who helped DS take the seats out of the van. He was also a former jailhouse cellblock neighbor of DS.
3. After spending a month in jail, DS told his mother he couldn't go to prison for fear of being raped and murdered. But, apparently, he didn't mind being in prison if he was on death row because, as he told his mother, it would be "simple, happy and peaceful."
4. He said he didn't want to waste money on getting a lawyer because they were going to kill him anyway.

I don't know whether to rely on this information or not. What with the typo in the headline, and a couple of other unintelligible sentences, let's just say it is not very well written and may also be inaccurate.
