“I would fire him within two seconds,” Trump said.

but CNN also reports
'More than a half-dozen people who are close to the special counsel’s office or other top Justice Department officials previously told CNN they believe Smith doesn’t want to close up shop before being ordered to do so or pushed out by Trump.'

Special counsel prosecutors will shut down their criminal cases against Donald Trump before he takes office, according to two people with direct knowledge of the matter, after his stunning victory against Kamala Harris meant they would not proceed to trial.

The move reflects the reality that the cases will not be completed before inauguration day. Once Trump returns to the White House, the special counsel’s office would be prohibited from pursuing further criminal actions under justice department policy.

"Two years ago, the FBI raided Donald Trump's home to retrieve government records he had refused to return, including hundreds containing classified information. The indictment that followed alleged the former President had left classified information laying around next to a toilet and stacked on a ballroom stage.

Now Trump is poised to be briefed once again on the country’s secrets to prepare him to take the reins of government on Jan. 20. “They’re not going to restrict it,” says a Republican involved in the transition.

Members of an incoming President’s staff typically must go through vetting to get the security clearance needed to see classified information. Judge dismisses special counsel's election case against Trump​

A federal judge has dismissed a major case against Donald Trump that alleged he illegally sought to overturn the 2020 election.

Jack Smith, the special prosecutor who brought the criminal case against Trump, had asked to have the charges dropped, citing a Justice Department policy that bans the prosecution of a sitting president.

Judge Tanya Chutkan dismissed the case "without prejudice", meaning the charges could be refiled after Trump finishes his second term.

Smith has also asked to have his case charging Trump with improperly storing classified documents dismissed. Trump had pleaded not guilty in both cases.

“It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President,” Smith wrote in a filing in the election case.

“This outcome is not based on the merits or strength of the case against the defendant,” Smith added in the six-page filing.

As much as Jack Smith fought to convict President Trump, the case was simply a sham. He should be glad that President Trump will move on and not invest time or money to continue. JMO

Jack fails, again, after a long history of failed attempts. He tried to prosecute VA Governor, Supreme Court overturned due to his jury instruction. Also Congressman Edwards, again a fail.
Hope the governments seen the last of him, wasting millions in tax dollars.

Mr Smith's stint began with the closure of some long-running investigations into members of Congress without charges, but he pressed ahead with other efforts.

Under his tenure, prosecutors brought a public corruption case against former Virginia Governor Bob McDonnell, a Republican, in a case unanimously overturned by the US Supreme Court in 2016.

The unit also prosecuted former Democratic vice-presidential nominee John Edwards, but a jury acquitted Mr Edwards on one count and was deadlocked on others, and he was never tried again.

The cases against Trump should have gone to a jury-- they would have decided the outcome. Instead, since Trump was elected president, there was no way these cases could go forward. Mr. Trump has avoided accountability his entire life by using our messed up courts -he uses the get of jail free card every time. One thing he is good at is manipulating the court system.

I'm hoping to at least see Jack Smith's report. But, he doesn't have a lot of time to get it finished and released.
