CA appeal has been filed. Supposedly it is 91 pages long but as far as I can tell, it is not available publicly yet.

Jeff Burlew of the Tallahassee Democrat has a nice summary of the appeal which includes problems with the venue (Tallahassee), evidence problems, and jury behavior:

 
Given the overwhelming evidence against CA presented at his trial, it seems mostly academic if he is allowed to appeal. Another trial would surely result in another guilty verdict, he must know that? I suppose in his situation any hope is worth chasing.

During a periodontic assessment, individual teeth are designated a prognosis, and "Hopeless" is one such prognosis.

4/29/25. Order Denying [without prejudice] Defendant's unopposed motion for authorization to retain digital forensic & electronic evidence expert by Judge Stephen Everett. [see post #90, page 5, thread #26 for more info]. Next motions hearing regarding continuing trial on 4/30/25.
4/30/25 Update: During a motion hearing Wednesday afternoon, the judge set a new deadline of May 16 for motions to be filed that relate to the existing charges. The defense requested to delay the trial because of new information and not enough time to review the 100,000 emails and new call recordings. A decision will come at a later date on whether to continue the trial that’s scheduled for June. Next case management hearing on 5/16/25 @ 9am.
4/30/25 Docket update: Case comments from Court event Motion to Continue. Court reservs ruling/Court will address any discovery deadline with ruling on Motion to Continue. Deadline to file motions will be 5/16/25. Hearing set for 5/16/25 to be cancelled & reset at later date. Scope of sealing. Court is going to unseal the documents as relates to Motion to Compel only. Order filed in open Court.
5/1/25 Update: On Thursday, Leon Circuit Judge Stephen Everett granted a defense motion to continue the murder trial. His decision came a day after an explosive hearing on Wednesday in which news surfaced that the State Attorney’s Office conducted a more recent criminal investigation into unknown allegations involving Adelson. Those allegations prompted a judge to sign off on wiretaps that included communications between Adelson & her lawyers. Josh Zelman, who is representing Adelson along with Jackie Fulford, told Judge Everett during the hearing that the allegations proved false. However, Assistant State Attorney Sarah Kathryn Dugan said prosecutors intend to use one or two conversations from the wiretaps. Judge Everett did not set a new trial date in his order. He said it would be the last continuance granted absent “good cause” presented.
5/2/25 Update: In other developments, the 1st District Court of Appeal ruled against the defense in its attempt to boot Judge Everett off the case. The defense last month filed motions in state court to disqualify Everett, which he denied. Last week, the defense appealed that decision to the 1st DCA. The appellate court on April 28 ruled against a motion to determine confidentiality, calling it “overly broad.” The court allowed the defense to file an amended motion, which it did on April 30. Judge Everett, meanwhile, signed an order during Wednesday's hearing to unseal documents & recordings from the wiretap for the limited purpose of the state providing those items to the defense through discovery. The records will remain sealed for all other purposes, Everett wrote.

We are getting into the realms of ineffective assistance of counsel. Is CA's lawyer really telling him how dire his situation is? Or giving him hope? I firmly believe Rashbaum led CA to believe he had a chance of being found not guilty. Basd on the fact he persuaded CA to dump $1 million on a jury specialist. Noone does that when their case is a dogs breakfast.

If CA gets a new trial I fully expect him to cooperate. He could negotiate a 20 year sentence a la LR. He's already done 3 years, 17 to go. He could get out in his mid 60s and live for another 30 years. Would you really roll the dice and risk dying in prison?
 
Jury selection in her first-degree murder trial will begin Tuesday, Aug. 19, with testimony beginning on or before Monday, Aug. 25.

Last week, Everett granted a defense motion to push the trial back from early June — in part because of a secretive state investigation that involved an informant, wiretaps, Adelson and her lawyers, Jackie Fulford and Josh Zelman. It’s unclear exactly what that investigation entailed because court filings about it remain under seal.

Assistant State Attorney Sarah Kathryn Dugan said during a hearing April 30 that the probe sprang from a “lead” the state got last fall. She said that information led to new evidence in the form of about 30 intercepted phone calls, one or two of which the state plans to use at trial.
 
TALLAHASSEE, Fla. (Court TV) — Some explosive new details were revealed when filings were made public following a brief hearing where Donna Adelson appeared in court to ask a judge to allow her team to redepose some witnesses.

In the defense motion to take the depositions, which was redacted and unsealed following the hearing, Donna’s attorneys revealed that prosecutors disclosed “new” discovery on April 7, 2025. This discovery included previously undisclosed investigative work and wiretaps of conversations between a jailhouse informant and Donna’s husband, Harvey Adelson.

But Donna’s attorneys say that affidavits presented to the judge lied about the content of conversations between Donna and her husband and allege that among the false allegations were accusations “the Defendant and her spouse were engaged in conversations by use of the undersigned’s cell phone/watch to plan harm to Robert Adelson, Katherine Magbanua, and the mother of (a) jailhouse snitch.”

Donna’s attorneys want to know how the accusations could impact Robert’s potential testimony against his mother. They also want to depose Sgt. Chris Corbitt, who testified in Magbanua and Charlie’s trials about the wiretaps and phone records, about the timeline of the investigation.

Judge Everett agreed that if the defense has new questions not previously asked or new information, the witnesses can be deposed on that; otherwise, he will take the issue under consideration.

Hi- Maybe you know the answer to this Q.
I was revisiting once again WA’s Isom. Interview and she mentions that her last text with DM wasn’t a good one (I forget the exact words).
Did she ever actually communicate with him that day? Didn’t she text her about 9:15 about meeting with her to discuss the boys school, and then she didn’t contact him till 11:45? What text about the boys and swimming would she be talking about?
 
Luis “King Tato” Rivera is to be released from Federal Prison soon
  • Time flies. Upon completion of 10 years federal imprisonment due to his RICO conviction in 2015, King Tato will be release from Bureau of Prison on 06/30/2025
  • He will be transferred to the custody of the Florida Department of Correction to complete the 7 years reminder of his concurrent 17 years state imprisonment due to his plea bargain in the Dan Markel murder case in 2015
  • This is a bad news for King Tato as his request to stay in federal prison due to fear of Latin King retribution for “rats” (plea bargain) has been denied
  • This is a good news for the Leon County State Attorney’s office as access to King Tato in support of efforts to prosecute the Dan Markel murderers will be easier
