Okay. IMO she should have been stopped from testifying the second she said she had been in cases "against" WA's atty. Not only an odd choice of words, but it also sounded antagonistic. Wouldn't one simply say representing different clients? LindaB: super atty, teacher, tons of continuing ed... of couse, I'm going to ask, How much is DA's defense team paying you to provide your opinion?

Has MarDes's(atty) plane landed yet??

My opinion only- Donna is directing this show. She wants to surprise the prosecution side with unknowns as to who will be presenting ( new person not previously put on defendants list of witnesses), what they will be presenting, nor how long they will be presenting the defense case. The paralegal is there to stroke Donna's shoulder and her ego so that she is not pestering her lawyers while working within these limitations set up so that Donna can CONTROL the situation. However this has resulted in significant chaos. This ensues that Georgia and her team will need to react rather be prepared. As others are saying this approach and these witnesses do not seem to me to be helping her case.
Donna is certainly a control freak. She wanted to control and micromanage her children's lives, even when they were adults, and so it's not surprising she's bringing that need to control into the courtroom. Every trial lawyer has encountered the type of client who wants to run the whole show and tell the lawyer what to say and what to do.

Georgia's cross of Linda Bailey was stellar. Bailey resisted agreeing with obviously true statements. That can't help her credibility. If this testimony was intended to show that the litigation was over and done with, leaving no reason for anyone to kill Dan, it completely failed.

Is this is the stupidest defense ever?

This stuff about Dan being the aggressor may one day be a useful defense in Wendi's trial. But I don't see what the relevance is for Donna. We've all seen the texts. She was very angry at Dan and was desperate for Wendi to return to Miami.

In the end, the prosecutors could simply ask the witness one question: "So the divorce was done and signed off on. The only way the children would ever move to South Florida is if Dan Markel was no longer alive. Correct?"
If I heard correctly, the witness said something to the effect that Wendi could still have reopened the issue of relocation with Dan later on. But that was lost in the endless testimony about minutiae of that divorce and others, and the prosecutor made short work of the witness on cross-examination, IMHO.

Donna's defense seems to be that DanM was a very bad man, and Aldenson's had a reason to do what they did. Character assassination, imo.

Even in death, Donna wants her revenge. Will never admit it was she, that was the family annihilator. With Wendi's input of course. IMO

So DA's defense is - DM was a bad man who deserved to be killed? A highly respected and respectable law professor whose only "crime" was wanting to co-parent his children?

Sure Donna, that will impress the jury. By trying to blame the victim for his own demise, she is highlighting her hatred of DM. She is only strengthening the prosecution's case by making it look more likely, not less, that she orchestrated his murder.

Not sure what is worse; the extortion defense or this. The extortion defense was laughable, but this defense is downright pathetic. It makes me wonder why the prosecution didn't go after this family sooner. Will this be the last trial? I wonder🤔

They are doing double talk. The divorce wasn’t contentious at all but Jibbers was frivolous and tried to make things difficult for WA. He was dramatic and over zealous with the filings. That doesn’t sound like everything was great. Which one was it?

DA is pushing her pathetic sad face as much as she can without the judge reprimanding her. She is so calculated.

DA and her attys are RIDICULOUS. Cannot believe they asked Judge for more time to talk to DA to see if she is going to testify!

ETA: JUST MAKE UP YOUR MIND DONNA.

Judge gives 5 minutes additional. Tik tok Donna

Judge is over this defense team…..they keep saying they need more time to talk to Donna about testifying. He even said we broke way early for you yesterday to do so. He has now given them a five minute deadline…….

Bet Donna won’t make the decision!

this whole debacle reminds me of all the times i begged my lecturers for an extension on my assignment because I wouldn't be able to complete it on time (usually for reasons that were mostly my fault).

I never got my extension, neither should DA!

JMO

As if it were not obvious before now, DA thinks she is the most extra special defendant to EVER go to trial and therefore she must be granted all these extra special privileges prior to testifying.

When there is no defense, there is no defense.

OK, I cant say enough GREAT things about the prosecution. Georgia is a hero. Smart, on target and unflappable. The whole prosecution is great. Sarah and Georgia make a dynamite team. IMO

Wendi and Donna's lawyers, ugh.

Don’t disagree at all @nodamselindistress …… and for comparative purposes only, there is that other FL defendant, the now convicted Sarah Boone. Perhaps some similarities in the clients?

Now back to the DA trial. MOO

What happened to that five minute deadline on testifying?

Don’t think this witness has helped at all.

  • #618
The defense knows that they can tell the judge anything and then later claim that Donna changed her mind. The more they irritate the judge the better their chances for a mistrial or appeal issue.

DA has her hair 'done up' today.... i think she WANTS to testify and they are trying their best to talk her out of it. JMO They are waiting to see what they can stretch out today.... She thinks she can win the case on her own.... they know she'll get up there and blow it. Again, JMHO.
