Trapped in the trunk of her car, Jasmine Samuel drew her last breaths while on the phone with a 911 dispatcher after being abducted by an ex-boyfriend.

"He said he is going to kill me," Samuel said minutes into the call — just before the sound of eight gunshots sounded...

The warrant affidavit for David Payne, the suspect in Samuel's kidnapping and killing, became public Monday. The affidavit paints a more detailed picture of what transpired between Samuel's initial call about 12:33 a.m. until she was found dead about 2 a.m.

He rarely said hello to Montina and wouldn't make eye contact with her, she said. A burly man at 5 feet, 11 inches, David had a reputation, Montina said, of dating younger women and sometimes being violent. He spent five years in prison for kidnapping a woman in 1992, Orange County court records show.

Montina feared the worst. Her sister, Jasmine's mother, was shot in the head when she was 19, killed by her ex-boyfriend...

The Orlando man accused of killing his ex-girlfriend, who called 911 from inside the trunk of her car, will not face capital punishment, according to state attorney’s office records.

Orange-Osceola County State Attorney Aramis Ayala filed a notice of intention on March 16 not to seek the death penalty.

Ayala announced last week that she would not be pursuing capital punishment for any cases while she is in office.
