Yep, sounds like the teenagers are real believable. They did leave, The shooter left also. If his leaving inplies guilt so does theirs!

After his Nov. 24 arrest, Dunn’s first attorney stated he fired when he saw a shotgun in their SUV, and they threw it away after they drove off. The Davis family attorney, John Phillips, confirmed they did leave.
“What would you do if someone was shooting 10 rounds at you?” Phillips said.
Dunn’s family has now hired Strolla, who said he talked with Gate employees who told him the SUV came back after driving away. As to whether there was a shotgun, police said they found no evidence and Strolla said he won’t know until his investigation is done.

You're back!

I'm curious what your thoughts are on the the change to first-degree charges?

What would even be the point of attempting to get out of the car to attack Dunn if they had a shotgun handy?

I haven't seen this reported anywhere, but I think he never left the car.

I find it curious they haven't released the 911 calls, yet.

This. 911 calls are usually the first things to be released. However, I don't know if the media is even trying to get the 911 calls. This case is not as big as another case because the shooter was arrested immediately. It didn't take a National outcry for the shooter to be arrested. Get what I am saying? Maybe the 911 calls are available, but no public records request has been made?

Jet magazine features Jordan Davis on cover for first issue of new year.

ETA: hm, let me try this link:

http://newsone.com/2119109/melissa-harris-perry-jordan-davis/

Okay, second link takes you directly to story, while first link takes you to home page with story in top news scroll thingy.

and ETA again, sorry, the video on that link says it shows Melissa Harris Perry discussing the Jet cover, but it seems the video is actually about the fiscal cliff. Story text is still there and contains pertinent information, anyway, though. :)

More than 50 law enforcement personnel will also be called to talk about what they saw at the crime scene that night.
...The paperwork also lists what Davis had on him the night he died: A wristwatch. A cell phone. $1.25.

New evidence released in death of Marietta teen shot over loud music
According to the caller, the SUV circled the parking lot of an adjoining shopping center before returning to the gas station where the shots were fired.

“They didn’t even pull into a parking space,” Phillips said. “And we’re talking 60 to 90 seconds. There was no chance for anything to be hidden or purged.”

But Strolla, noting there were about a dozen large trash receptacles in the vicinity of the shooting, said he believes Davis’ friends were gone for much longer than that.

New evidence released in death of Marietta teen shot over loud music

It seems that only one 911 caller helps the defendant's case. However, his sister describes it a little differently.

Sorry about the delay, but here's an article from April about the case:

[D]etectives...informed him he was being charged with murder.
"That sucks," Dunn said before the Jacksonville officers left the Brevard Sheriff’s Office interview room, which is when he slumped over, put his hands over his face and wiped an eye.

Dunn’s trial date was set Tuesday for the week of Sept. 23, though that schedule may prove to be too ambitious.

According to the Duval County Clerk of Court webpage, the recusal order for Judge Mallory Cooper was entered Monday.

Cooper is the second judge to step aside from the high profile case.

According to Jackelyn Barnard, the public information officer for the State Attorney's Office, no one in the State Attorney's Office asked Cooper to recuse herself.

The site also shows that Judge Russell Healey has been reassigned to take over the case.

Judge Suzanne Bass removed herself on May 23 after Michael Dunn's lawyers raised doubts of a fair trial when she denied Dunn's plea to be declared indigent and be eligible for taxpayer funds for his defense.

As Michael Dunn, 45, prepares to face first-degree murder charges in September for the November 23, 2012 slaying of 17-year-old Jordan Davis, in an exclusive interview with Jet Magazine the teen’s parents, Ron Davis and Lucia McBath, share the difficulties in keeping their son’s story alive and how they’ve bonded with Trayvon Martin‘s parents, Sybrina Fulton and Tracy Martin.

Davis was gunned down by Dunn at a gas station in Jacksonville, Fla. Dunn claims that he felt threatened by the teen — who was sitting inside of an SUV with friends — and loud music coming from the vehicle, so he shot inside of it eight or nine times before driving away leaving Davis to die in a friend’s arms.

None of the teens had weapons.

Is the call where the caller says it looks like they were stashing something? Because he's since said that he didn't see them stash anything and that it didn't even really look like that and he didn't know why he said it. They were probably just checking on their friend.

Does anyone know if the other teens will be testifying in this trial?

I would assume so. They'll probably be the best witness' for the prosecution. Then we'll find out what really happened. JMO

When you are involved in an incident involing discharging your weapon during a confrontation you are obligated by law to report. Mr. Dunn did not, he fled the scene. Instead, he returned to his hotel. He still did not report the incident. When he woke the next morning, he saw on the news that Jordan had been hit and killed. He still did not report, he fled city, fled the county and drove 160 miles home. Upon arriving he STILL did not report. He was tracked to his home by law enforcement.

All of the above, to any reasonable person, constitutes flight. To argue otherwise is ridiculous IMO. All over the web, there are persons of a particular mindset trolling comment sections of news articles and discussion forums pronouncing that Mr. Dunn had evey intention of reporting this incident and his involvement therein. He intended to turn himself in to his LEO neighbor. He was in the process of getting legal counsel.

All I can say to that is Mr. Dunn apparently is very decisive and quick to act in some of the actions he took (telling the teens to turn the music down, perceiving a shotgun and threat to his life, firing 8 to 9 rounds into a vehicle at a gas station/convenience store with bystanders present) and extemely slow to act on his "intentions" to do the right things afterwards.

I only know the law here in Arizona.
If you discharge a firearm within incorporated areas/city limits, you are REQUIRED by LAW to call LE BEFORE the weapon is discharged, or immediately AFTERWARD. If not, it's called "Unlawful discharge of a weapon". In unincorporated areas/the county, shooting is unlawful within 1/4 mile of a structure/residence by both LE, and Game and Fish UNLESS you are putting down an animal or dispatching predators.
Both areas require that you call LE immediately if you discharge a weapon that causes destruction of property, bodily harm/death.
I'd like to know if where Mr. Dunn discharged his weapon was in "city limits" and what the law is pertaining to discharging a firearm in said area.
Maybe this has been addressed already, just catching up...
"Castle Laws" are one thing, but SYG looks like it's being used by a bunch of Yosemite Sam wannabes. JMO and definitely my experience with some of the yahoos who move to this state and go all "gun happy".

As I understand it, SYG can be used anywhere at anytime you feel threatened. The fact that the police haven't released him on bond doesn't look good for his SYG defense. JMO

I wonder: Why do I always hear about people in small towns who don't lock their doors--yet have enough guns under their pillow to equip a small army? I always hear about how ~safe~ it is where they live but also about how they have 574773744 guns to protect themselves. It is so odd.

:goodpost:

:floorlaugh:
I LOVE that post!!!!

"Firearms create a more "polite" society".
That's the way I was raised here in Arizona. Phoenix has it's "issues", along with Tucson (metropolises with a lot of non-Arizonans), but for the most part, it's ~safe~. I'm originally from Scottsdale but moved to the boonies 24 years ago.
Some people see a firearm and think "Fear" (my son's GF recently from San Diego has this mindset), some people see a firearm and think "safety" (that's where I am), and others see a firearm and go all macho stupid (like people who move here from highly prohibitive gun law states).
Seriously, my BF has a sidearm for every day of the week and holidays.
In the "country" you use different firearms for different reason. So, it's easy to have several, and then some you acquire from friends or relatives that pass. Some are sentimental, I have a Jennings #48 .380 auto that was used by a dear friend when he was in the OSS, a "boot gun" Davis Derringer DM .22 cal .22 mag that he carried, a 12 gauge shot gun he thought I "needed", and a Llama Comanche .357 mag that he gave me just cause it had too much recoil for him in his old age. I carry a S & W .357 mag every time I leave my property, just habit, like taking your cell phone. (which I refuse to get!)
Everyone's idea of firearms are usually based on the "culture" they are raised in. That could run the gamut of one of "fear and trauma" to "safety and security". I look at my fire arms as "tools" to get things done, whether to put down an animal in terminal pain or trauma, dispatch a varmint, getting a steer or pig ready for the freezer, hunting, or just blow off some steam at a non-breathing target.
It's all in the eyes of the beholder. JMO.
