Doesn’t look like anyone from her local family is there — more specifically, her mother JS is absent! Interesting. OMO.
Nope, but I'm not shocked. This memorial bench was made possible by Jenny, her team, and contributions from the community and people from all over the country/world. The only time I've seen any family participate was when Maddie's dad and step-mother came to look at all of the love-locks, flowers, gifts that were left where she was found.
We won't see Jen Soto in public until the trial(s), probably.
IMO.

I was watching Vinnie Politan Investigates tonight and they showed the last interview with SS before he asked for a lawyer. The detective said something like, "you gave them permission to search your phone" and SS agrees.

IANAL but my opinion is there is plenty of evidence that SS willingly gave LE permission to search his phone.
I agree, he gave them permission
This is what Im trying to understand, his defence is saying he permitted them to search his "maps" not his " phone"
.
but it sounds like even though they got a search warrant the defence is saying if they checked the maps and didnt find anything that would help locate Maddi, they had no reason to search any further. ( no exigent circumstances) so anything they found after that becomes " fruit of the poisonous tree"
I think it has to do with consent and that it can be limited. The requirement for consent is that it has to be knowing, intelligent and voluntary, and SS is saying his consent was limited.
instead, they could have seized the phone until they got a search warrant.
Its also a big deal b/c if convicted, the conviction can become an aggravating factor in the murder trial and going for the death penalty
Did they have probable cause to seize the phone until they got a warrant? Would his admission that he did a factory reset be probable cause?
Maybe someone with a law background can clarify?

My question: How do you unring a bell? how can they supress 1500 photos of Maddi and pretend they don't exist?

His permission to look at his phone was knowing, and voluntary. I think we can agree that the intelligent part is where the problem come in. He thought he was and his factory reset was protecting him from discovery. He was not as intelligent as he thought and that is why he is where he is.

I don't think legally he gets a bye for being not quite the criminal mastermind he thought himself. JMO
I think the judge will rule against this bid to get the phone evidence tossed.

I couldn't agree more. You explained it perfectly.

BBM: Exactly, there is no way ignoring that the photos exist is going to work, period.

I for one would be very concerned if the SA charges were dropped. He is obviously guilty of the crime with no doubt. There is evidence that he disposed of the body. Where is the evidence that it was he who killed her? Don't get me wrong, I think he did kill her but I'm thinking about a jury here. There was another person in the house at the time. Some juror could have a reasonable doubt.
Yes @lonetraveler ….

IANAL…. but if possible maybe all the more reason to charge her too, try them both with their own juries and then see if the truth comes known? Again…. IANAL… and makes me wonder if some or all of that evidence is suppressed. And maybe also more reason to find what became of the other supposed hard drive, tower, or what was in the storage locker? And IIRC SS father had some information on that?

If SS wasn’t that adept at ‘wiping’ or cleaning his phone with a reset….. did he have help with other material? MOO

They wont drop the charges, and if they suppress the icloud evidence it will be tougher but apparently, it's not the only evidence.
They will have to find a Jury from Mars, for him to get away with this.
I think his lawyrers are just doing everything possible for him. Someone has to do it, everyone is entitled to a defence.

The mother needs to be charged too. That poor girl never had a chance for a normal life. Kids are supposed to go to school, watch TV, read books, not deal with rape and abuse on a daily basis from the Mother's boyfriend.

I agree, trouble is what do you charge her with? The police say they have no evidence that suggests she was involved, and even for heglect, you have to prove she was aware and was negligent anyway. Jenn says she had no clue,
I guess her " biggest fear" about ending up in a woody allan situation was just a normal thing, She had no reason to fear that, b/c she had no clue doesnt everyone fear their boyfrineds might sleep with their children?? thats normal right?
or the pregnancy tests under her bathroom sink must have been for her, just in case she thought she was knocked up even with her non sexual relationship,
What about the app that tracked Maddis' cycles so they could be prepared for supplies, That app, must have been real useful as her bathroom had a jumbo family supersize box of feminine hygiene supplies on the shelf

Given that she had no clue about any of the SA stuff until she was told by the police, it wasn't unusual at all for her first reaction to be to call Stephens dad immediately, and tell him to lawyer up for SS, that he needs a lawyer ,like yesterday.

She was awfully defensive of Stephan, hugging and consoling him in the beginning. almost appeasing him with the back rubbing and the hugs, when it was her daughter that was missing, not his.
Or how about that the reason she wrote 'I saw maddi get dressed ". was because the police officer told her to write what she "saw" so she just started her sentience with "I saw" ( she wasnt thinking she said ) so when she corrected SS statement about what clothing maddi was wearing. That was to make it look like she did see her, she only clarified when that statement got her a lot of attention for lying. She was trying to slip that through, and you ask yourself why? is she protecting Stephan or herself.
At least Jenn and stephan have one thing in common, neither one of them are the criminal mastermind they probably think , instead they are. more like dumb and dumber.

Poor, innocent Madeline is dead because of both of their actions and inactions. What happened in that household was far, far beyond normal. I don't care how much JS wants to pretend she was oblivious, it just isn't possible.

MOO

I know, there is so much that looks like she knew about all of it, but I guess they have to prove it.
The fact that she is so protective of him stands out the most to me.

Selfish as she is, MOO, her first thought had to be on herself and her missing/murdered daughter. BUT no, SS was the object of her caring for. Doesn't make sense, if she isn't involved. IMO

I cant imagine being protective of someone who I found out was S.A.ing my daughter. There would be no wishful thinking that they had the wrong guy.
I can not fathom that wanting a man around would overshadow what he did, thats why I think there has to be more to it. IMO
I wonder if we will ever know for sure if she had any role.

So many co-conspirators, on WS, seem to defend their partner to the end. Even some that end up going to prison. I don't understand it. Some sort of delusional interdependence personality disorder?! Like, they have no understanding of "right and wrong". They just ignore what they don't want to acknowledge. Stepford wife syndrome on steroids!

What if her involvement was simply that she provoked a fight that escalated and got out of control? What time did he do the factory reset? and what time did Icloud reload all the data, I know he said in the. morning, but didnt forensics show differently?

I don't know. I just don't think that she didn't know her daughter was being groomed and raped by her BF.

Oh I agree. That phone call that rattled stephan the saturday before, him showing up just as Maddi arrived home alone after her party.Does that have anything to do with what happened? something happened that night that escalated things. I am not feeling the " afraid she would tell" theory.

Yeah, I hear you. I'm just not NOT feeling the "afraid she would tell" story. Something rattled him, like big time, and then she was dead. :(

I totally agree.

Just my opinion, but I think like most child predators, he thought if Maddie ever told, he could create plausible deniability by claiming she was lying or deluded or otherwise untrustworthy.

So it had to be something he believed existed that could not be denied with mere words.
