Lets talk about the family's attorney who claims that MD waited four seconds before shooting. This is simply not true.
In this video it is clear that the assault occurs at 1:42 (MD still on feet, hasn't hit pavement).
At 1:43 MD is on the pavement sitting up, this is when the clock starts ticking on his decision making process.
At 1:44 MD's right hand is clearly reaching for the gun...
and at 1:45 is in the firing position.
There is no delay here and his actions were as swift as can be expected under the circumstances.
Now replay the video and focus on MMs movements. The assault occurs at 1:42 (MD still on feet, hasn't hit pavement). At 1:43 MM takes a step forward, then another. At 1:44 he pulls up at his waistband of his pants. and it isn't until MD reaches for his gun does he begin to retreat. This clearly shows that after the assault MM continued to advance on MD and he was justified in feeling threatened.
One last thing to point out, at 1:35 MM exits the store. At 1:38 the wive spots him coming and begins to exit the car. By 1:41 She is fully out of the car and MD has is facing her. He does not react to MMs approach and was obviously blindsided by the assault. He also may not have even know of the existence of MM.
IMO when MD sat up on the pavement after beam pummelled by MM, his reaction was justified. This was likely the first he saw of MM and he had no way of knowing his relationship to the people in the car. MM violently assaulted him, then advanced on him. Case closed.
