If you "haul your 🤬🤬🤬 up" you have to put your hands upon the ground to get up and therefore you have no way to defend yourself from another attack. You would allow yourself to be beaten?
A shove isn't an indication that a beating is soon to follow. IMO

The Sheriff referred to the *conversation* as a disturbance. A witness reported it to the store clerk. The Sheriff said that the 4 second pause between when the gun was brandished and fired gave him pause. He also said the law is too subjective and makes his office liable.
It's NOT 4 seconds "between when the gun was brandished and fired" - your words.
It's 4 seconds "between the time that Drejka goes to the ground, and the time he shoots" - per sheriff.

Ok so that’s the video. So if you count it, between the time that Drejka goes to the ground, and the time he shoots, it’s a count of 4 seconds. It’s a count of 4, no more than 5. It’s a very short amount of time. And what he claims—and you can tell—it’s a violent push to the ground. This isn’t just a shove. He slammed him to the ground.

By the way, if you park in a handicapped space illegally, sooner or later someone will tell you what you're doing. You don't get any more inconsiderate than to illegally park in a handicapped space. By the way, it is quite legal for someone to tell you that. It falls under the Freedom of Speech, and it is not an excuse for someone to beat you over. If MM had acted in a reasonable civilized manner, things would be very different.
It seems I have read this very same thing in this very thread.
Now let's switch this around to say that if MD had been civil or alerted the proper authorities vs confrontation things would be very different. See how that works?
Two sides to every story. IMO

why the shove/slam, and not a punch?

Yet there is not any further movement by MM.During all of it he is a few feet away. Thank you for clarifying the Sheriff's comment.

Stand your ground should only be used when you are originally minding your own business while carrying a gun in public. Jmo

You shouldn't be able to initiate and carry on a ongoing argument while knowing you will simply shoot if shoved. Jmo

It should be used in cases like this, but guess what.

Alabama woman jailed after fatally shooting estranged husband despite her claims of self-defense, history of domestic abuse
The 38-year-old mother told police her estranged husband charged at her “in an aggressive manner” before she fired her small-caliber handgun. According to court documents, Dixon in 2016 successfully obtained a protection from abuse order against her husband, which also granted her temporary custody of their two young children.
...
The state of Alabama also has a “stand your ground law” that allows residents to use deadly force if they have justifiable reason to fear for their lives. That includes when another person is “using or about to use unlawful deadly physical force” as well as when an aggressor is committing “assault in the first or second degree.”

Despite of all of this, Dixon is facing domestic violence murder charges for the death of her estranged husband and is being held at the Dallas County Jail on $100,000 bail.

Now lets switch this around to D had the right to speak to that woman, and MM DIDN'T HAVE THE RIGHT TO ATTACK HIM.

Pity it didn't happen in a more civilized state like Florida. Some states just seem to want the innocent victims to meekly submit to a beating. She should NEVER have been arrested. First abused by her estranged husband and then by the state. That is outrageous.

Show us on the video where D and MM spoke-was it the second between exiting the store and attacking the older man?

I beg to differ. MM had every right to shove MD away from his family.
Very sad that you feel as though he didn't have the same right for protections as MD. IMO
<modsnipped> TIA

I agree and most would agree that it should require more than a shove to take the life of another person.IMO

You can't count his trying to sit up, and regain his balance. Two maybe 3 seconds to pull out the gun, unclick the safety, and shoot. Not bad timing for someone rattled by a surprise attack.

The whole thing revolves around MM attacking that man. You don't have the right to attack another person. That is the "real crux of the matter". That is why this is self defense.
