I IMO find it absolutely insane the complete dismissal and lack of care for human life. There was absolutely, 100% no reason someone should have died during this argument. It really puts in perspective why people need to remind others that certain kind of people's lives matter, because nowhere else does this complete disregard for a person's life can be found. People search hell and high water for sorority girls but would fight and fight to justify another person's deservingness to die.

would you feel the same if DD had landed on his head and died?

But he didn't and if he had MM would have been charged.

He could have been killed in that attack so it was imperative that D stop the attack before MM killed him. Luckily for D, he was armed.

You're right. It's disturbing. The need to be right and the right to kill another human being matters more than a man's life. It will never make sense to me. Where is their humanity?

I don't believe that for one minute.

Fights break out in parking lots every day (and in eyebrow salons apparently) and people survive them. Pretending he could have been killed is a handy excuse to take another man's life.

Nobody has the right to brutally attack another man like MM did to D. D's life matters because he was MM's victim. He was lucky to have survived. Do you know what's disturbing? The idea that MM had the RIGHT to attack that man without warning and without cause. That's disturbing.

People die in attacks every day. D was lucky to survive and D's life matters and therefore he has the right to defend his life. Which he did.

He thought his family was being threatened by an armed man. Why does he not have the right to protect his family? If he wanted to 'brutally' attack D, he would not shoved him but hit him with a closed fist.

You are not allowed to file a civil suit against someone who used self defense in Florida. It's the law there. So, no suing of D. They will probably sue the store
Can you cite that? I read through their tort laws today and it seemed to me you could file it so I’m curious what I missed. TIA!
ETA: I see an article was posted about this, will check it out.

There were no threats, the woman's police report states that. You can't attack someone unless there is a clear and present threat. The woman
said that there were no threats.
The woman wasn’t shot, the man was. It’s not whether she perceived threats, it’s whether he did.

The law was changed in 2017 so you can sue but if the civil judge throws it out or you lose the case, the defendant gets all his expenses paid by the party suing.
Well, not actually changed but the FL Supreme Ct ruled the law as written required a civil judge to make a determination.

How could he "perceive a threat" when he never spoke to D? The video shows no violence or aggression from D, so there is no justification for the attack.

I saw aggression as did other posters here, you and some other posters did not. The law does not require the parties to speak to one another.

Dozens of people have been shot because they had their hand at their waistband and the other person feared they were going to pull out a gun. The is no reason that MM did not also fear that.

Excellent analysis. You have an uncanny ability to catch others in their untruths

BBM. I read through all of the attorney's fees tort laws just now, and I do not see this anywhere. (Statutes & Constitution :View Statutes : Online Sunshine) I'm really interested in this because it is so counterintuitive to civil injury law (which is what I practice). Do you have the cite to the statute or case law?

Agreed completely, and those people often win at trial or are never charged.

How is it an untruth to say M could have perceived a threat? How can anyone claim to be able to prove he didn't?
