Just saw this case on ID- googled and found out about the trial delay due to allegations that prosecution did not provide the defense with evidence they had . What a shame.

A status hearing is now scheduled for Dec. 22, at which time a new trial date will likely be set.

As Suskauer warned prosecutors in an Oct. 21 hearing, further delays won't be tolerated.

"When this case is set for trial the next time, I can't have this continued again," he said.

Scott said the state is not solely responsible for the trial delays, claiming that defense attorneys didn’t begin conducting discovery depositions until 631 days after the indictment was filed. He also noted that the court didn’t conduct a murder trial for nearly 18 months because of the COVID-19 pandemic.

Scott’s response to the defense motion also refuted the defense’s claim that the “clown sighting file” was found at the state attorney’s office. Rather, Scott said, the file was discovered by McCann at the Palm Beach County Sheriff’s Office.

“The court expects the state to continuously seek out the material requested by defendant and to comply with its continuing duty to disclose evidence, which includes evidence held by other state agents,” Suskauer wrote.

Court eyes Killer Clown trial in May​


Attorneys involved in the trial of the woman accused of dressing up as a clown, and killing the wife of the man she'd later marry, are eying a possible trial date in May.

Sheila Keen Warren is accused of killing Marlene Warren in 1990. The case went cold for 27 years until the Palm Beach County Sheriff's Office used new DNA evidence to make the arrest.

Keen Warren was set to go to trial in October, but the judge delayed the start after new evidence came to light.

Jury selection for 'killer clown trial' expected to start in May​


Keen-Warren wasn’t present in court, but attorneys talked with the judge about starting the jury selection process and trying the case sometime in mid-May.

"Attorneys for the accused Florida 'Killer Clown' have claimed another inmate bragged about carrying out the 1990 murder - and now want the details revealed at her trial.

Sheila Keen-Warren is accused of fatally shooting Marlene Warren in Wellington, Florida, in 1990 while wearing a clown costume - before she went on to marry Marlene's widower Michael Warren in 2002.

But her attorneys say Edward Bahr boasted to his cellmate in solitary confinement years ago that he was hired by Michael to carry out the murder because Marlene was getting a divorce and taking over his car dealership, according court filings."

Killer Clown suspect Sheila Keen-Warren's attorneys just argued the case should be dismissed because state delayed indicting her for 27 years and she lost valuable witnesses, etc that could have helped her defense. Judge skeptical

WEST PALM BEACH — With Wellington's most anticipated murder trial drawing near, attorneys for the accused killer are casting doubt over prosecutors’ key evidence.

Two months remain before Sheila Keen-Warren, accused of dressing as a clown and killing Marlene Warren on her Wellington doorstep in 1990, is set to face jurors. Assistant State Attorney Reid Scott said Keen-Warren arrived at Warren's Wellington Aero Club home with balloons, flowers and a gun in her hand and shot Warren point-blank in the head.

Keen-Warren married Warren's widower, changed her name and moved to Virginia in the years following the murder. The case had grown cold by the time lead detective Paige McCann of the Palm Beach County Sheriff's Office took over in 2013 and discovered a 6- to 8-inch fiber among the crime-scene evidence that prosecutors say linked Keen-Warren to the murder of her lover's wife.

The murder of Marlene Warren, in May 1990, shocked the community of Wellington and remained unsolved for nearly 30 years.

Then, in 2017, detectives arrested a woman named Sheila Keen (Warren). Sheila is charged with first-degree murder with a firearm. She's accused of dressing up in a clown outfit, bringing flowers, balloons, and a gun to the victim's house, then killing her in cold blood.

Prosecutors say DNA links her to the crime, and the motive could be the oldest one in the book.

Sheila was Marlene Warren's husband's mistress.

Judge Scott Suskauer wants both sides to submit orders on whether the fiber should be allowed in a trial next month. He has already denied several other motions from the defense trying to get evidence thrown out.
