AT’s legal team asks for reference to “federal agents” be prohibited in the event certain individuals (federal agents) are called as witnesses at the trial, since jurors may then readily ascertain that AT had pending federal charges at the time he was taken into custody. Instead, the team asks they simply be called “law enforcement officers”.

11/12/21: Notice of arrest or pending prosecution of a State witness. (Now-former deputy Kevin Encarnacion was arrested Tuesday (11/16/21) morning & charged with accessory after the fact & official misconduct, both third-degree felonies. Encarnacion was helping his cousin Enrique Davis run from deputies. He said Encarnacion’s cousin was involved in a domestic violence incident in early October. Investigators said Davis left the scene & Encarnacion gave him information to help him evade arrest). Case management conference hearing on 11/17/21.
11/17/21 Update: Hearing was held. Next status hearing on 12/20/21 & trial has now been rescheduled to begin on 1/24/22. 11/18/21: Notice of provision of supplemental witness list filed by State. 11/29/21: Memo of Law in opposition to Defendant's Motion to Suppress. State argues that Todt voluntarily, knowingly & intelligently waived his Miranda rights prior to the 2nd & 3rd interviews; even if Todt was un the influence of Benadryl, his Miranda waiver was still valid; and Todt's suicidal ideation did not cause his waiver to become involuntary.

1/7/2022 STATES MOTION TO CONTINUE

The most relevant portion of the State’s motion is quoted below.
1. The defendant was indicted on four counts of First Degree Murder and one count of Cruelty to an Animal on February 25, 2020.

2. The Office of the Public Defender was assigned to the case at initial appearances on January 16, 2020. Mr. PS was assigned as lead counsel in the defendant's case. Mr. RW and Ms. EC were also co-counsel assigned to the case.

3. Ms. EC resigned from the Public Defender's Office. Around October of 2021, Ms. AS came onto the case as co-counsel.

4. Mr. PS drafted the Motions, Memorandums, and conducted the arguments on behalf of the Defendant throughout the pre-trial proceedings. Mr. PS conducted most of the discovery depositions in this case, although Mr. RW was present for many of the depositions as well. There are pending Defense Motions before the Court that are scheduled to be heard on January 21, 2022 that were drafted by Mr. PS.

5. Mr. PS passed away in December of 2021.

6. The State had a conversation with Ms. AS regarding the status of the case on January 6, 2022. Ms. AS advised that she believed that she would become lead counsel in the case. Ms. AS advised that the defense would be requesting that the case be reset to March 2022 for trial to allow the defense sufficient time to prepare.

7. This case has several hours of body worn camera footage, several gigabits of digital discovery, hundreds of pages of discovery, and numerous depositions that have been previously conducted.

8. Jury selection is scheduled to begin on January 24, 2022.

9. Based upon Ms. AS’s representations, the voluminous discovery, and the seriousness
of the charges a continuance is necessary to protect the integrity of the prosecution in this matter. The State does not believe that two weeks is sufficient to adequately prepare given the volume of discovery.

10. The non-moving party was contacted for their position on this motion. Defense advised that they have spoken with the defendant and do not have an objection to a continuance until March 1.

Wow, I've never followed a case where an attorney passed away in the midst of things. Condolences to his family but hopefully this won't derail justice.

So if I understand this correctly, due to the death of the defense's lead counsel, everything is getting bumped to March? We are just waiting for the website to be updated with new dates? Thanks to all who are keepingup with this case. This family should not be forgotten.

I believe we will probably learn about it at the next hearing on 1/12/22.
