I found the information through OC Court Records (Orange County Clerk) and Sparky. Dale Jr. is Dale Wayne (W.) Smith and his birth date is 06/28/71. And he's listed in OC's court records 10 times for various offenses, including battery. As a comparison, I'm listed in my county's court records only being called to and reporting to jury duty.

This "Father/Son" family thing is really setting off my "Hinky Meter"....

This case so reminds me of a case here in North Florida/South Georgia where a young mother named Sunday Blomberg was killed by her Mother-In-Law, MIL's husband and his friend. All because they wanted custody of her young daughter. Sunday was leaving their home and moving back to Tallahassee with her family.

FWIW, a poster here posted this weekend that one of the wives family posted on facebook that they had always been suspicious of that death. Evidently they didn't post a name so we don't know which wife. Probably the head injury one though. Heh, sometimes posts on FB turn out to be true.

It was a comment on NG;s site about Shannon, and how they had questions about her death. I think it was her mom.

Wow, that's really sad. In FL, he cannot just throw her out if she has established residency (DL w/ that address & mail rec'd). He would actually have to go through the court to evict her legally even if a person is not on deed or lease. Those poor babies. I wonder if the family has initiated any type of custody or guardianship yet. I fear for the kids. JMO.

I have heard nothing about that from her friend. I know WESH news at first was saying that all 3 kids were being taken care of by Dale. Then the family made it sound like her oldest boy (not Dale's child) was staying with Michelle's family. As far as has been reported locally, the twins and Dale Jr are staying at Dale Sr's where the raid occurred. Seems weird I know. Sure hope if the situation is as volatile as it appears to be that they can get the twins out of that house on Rose Blvd.

IIRC, Sparky stated threads ago that the 11 year old was with his father. In one of the videos at the command center, the media block out the face of a boy, of which, may have been the 11 year old.

BBM. Sure, but you generally have to really irritate military authorities for them to go that far. I know this sounds terrible, but simple drug possession and simple battery are not going to get the military in enough of a twist to courts-martial you over it - unless it's an extreme case or the person has a pattern of behavior that finally causes the CO to really put the smack-down on them.

In a simple drug possession (not drug dealing; that's different) or a simple battery case, the CO will offer the servicemember an "Article 15", which is a non-judicial punishment. You do not go to court; you agree to let the CO punish you. The CO has a range of options to choose from depending on his/her rank and the servicemembers rank. The CO cannot give you a Bad Conduct or Dishonorable Discharge. He/she can demote you, fine you, restrict you to base, etc. Little stuff.

If the servicemember refuses to accept an Article 15, the CO can ask for a courts-martial and you then go to an actual trial. The trial is conducted by a military judge and he/she can send you to jail, give you a bad conduct or dishonorable discharge, demote you, fine you, etc. The military does have the death penalty, but I don't think they've actually killed anyone in decades.

DS may not have done anything particularly terrible; he may have simply refused an Article 15 and took his chances at courts-martial. Some people do. Even over minor stuff. Then they wind up having the proverbial book thrown at them. But the military doesn't generally jump right to courts-martial unless you did something pretty bad or have a pattern of doing stuff moderately bad and just won't quit it.

So if the media information is correct and he had a "string of court martials", then he likely did some time in prison prior to his dishonourable discharge. I guess he was a repeat offender and had a pattern of behaviour that made them crack down on him.

I don't know if we can say that Dale Jr is staying with his father as it doesn't appear that either he or the twins were there during the raid, or at least it hasn't been reported in the media. But I do get a creepy Josh/Steven Powell vibe from the whole situation. I believe that there is a daughter living there with her children and obviously Dale Jr has lived there in the past, probably prior to buying the condo in 2008 and he's 40 years old. That people finder link I posted earlier has Shannon Collins-Smith listed as Dale Sr's daughter. Not sure where these sites get their info, census perhaps, but why would she be listed as his daughter if she has never lived there? Or did she live there during her marriage to Dale Jr? Since Dale Sr has the roofing business, perhaps he is a little controlling over his family because he has money? Does Dale Jr work for the business? He appears to be the only son.

BBM. Yes, that's my general feel of the situation. He seems like a volatile, hot-headed, impulsive person in general if everything Michelle said at the PC is accurate. I imagine the USMC finally just got sick of it.

At times, some men won't let go either and want the last word, or "one" up on what may have happened to them.

ETA: I see on their Facebook that no one has worked and the children have to eat. Still confused because Dec. 10th is far away!

I did read the chat the night this info was chatted about, however, there was no way to rely on anything being factual. Looking more for an MSN article indicating this information so it's "sealed" in concrete.

Sadly, some TV news stations (HLN) may end up repeating what we still have no clue if accurate or not.

I am trying to make sure I am only putting out information that has a possible link to truth. Yes, I understand how these things get blown up. The last thing this family needs is the circus to come to town.
I will be real careful on what I post, promise.

It was a man that was found and he has been identified.

But the area is actually not as far as what you googled- it is actually much closer then 17 miles away.
