The Richardson hearing on the discovery issues is scheduled for tomorrow at 9am, so they must be planning to go into opening statements as soon as that finishes. Looking forward to it!
Thanks, that is what I thought but questioned myself when I saw on CTV that opening statements begin at 9am.

Owens is waffling on a date for which they received records. Judge is determining whether it was a willful act of withholding discovery.

This is going to be rocky. Owens to the judge: I didn't know you were going to ask that.

Judge finds the disclosure was inadvertant, finds a degree of violation, but a limited harm to the State. Will not prevent the Defense from entering the exhibits.

81 pages of medical records reduced to a subset. Some adjustments, resolved.

State is concerned about the content of the Defense's opening. Asks judge to rule against the Defense using exhibits that have not been admitted in their opening.

Back to Owens, "Sarah's going to testify to..." He believes the judge will allow the BSS so he feels....

He's as bad as SB, rules don't apply.

What is the 'inadvertent disclosure'? Limited harm to the state? Still means some harm to the state.

I have said this recently but Owens is playing dirty tricks IMO and this seems unethical and unlawful tho IANAL. Why is he prepared to put his name and reputation on the line for this case?

He's at the end of his career surely, does he want to ruin an entire life's work with one reputation destroying case?

OMG Judge is looking at a Defense opening exhibits about reasonable doubt. It's not the State's instruction!

Did Owens go to REAL law school? What is he trying to pull here?

Wants portions of jury instructions, arguments of law.

This is painful.

Turning over discovery so late, potentially days after they could have.

Judge is being exceedingly careful, patient, generous.

IMO Owens does not deserve it.

State is solid. Asking judge to rule against exhibits. Prior acts might not even be allowed at trial, inappropriate to reference them in opening statements.

Owens is trying to skirt the overt act. My client believes... she'll testify....

Waiting for the judge to say THAT'S NOT HOW THIS WORKS.

Owens then says they are going to play the suitcase video during their opening.

Judge rules that no exhibits can be used in opening that haven't been entered into evidence. Hard no to the Defense's strategy.

Jury coming in.

Ugh, Prosecutor is off microphone for his opening statement.

We will show that JT is dead because of this defendant's judgment.

References the 911 call... he's dead.... i don't know what happened... we were playing hide-n-seek, I fell asleep.

(I don't know what the microphone set up is but this is awful, in and out.)
