Wednesday, August 29th:
*Pretrial Hearing (@ 9am ET) - FL - Savannah Page Gold (21) (Aug. 2, 2017) - Lee Rodarte, Jr. (28) arrested (8/6/17) & indicted (8/25/17) with 2nd degree murder with weapon & tampering with evidence; confessed, but plead not guilty.
Bond was at $500K, but on 1/31/18 ordered to be held with no bond. Remains in Duval County jail without bond. 10/30/17 waived right to speedy trial. Final pretrial hearing 10/23, jury selection 10/29/18 have been struck. New trial date for October, no date set.
7/3/18 Update: Defense files Motion for Continuance, granted. Strike dates 10/23 & 10/29. Moved to October, with no set date. Next pretrial hearing 8/29/18.

New trial date set for man accused of killing Bonefish Grill co-worker

The medical examiner could not determine Gold's exact cause of death but called it a violent homicide. The autopsy report said Gold had second-degree and third-degree burns over 75 percent of her body.

The new trial is set for Feb. 25.

Rodarte has another pretrial hearing Sept. 27.

Question. I used to be able to open up the documents that are at the Duvall County coresite. Now when I try to open them I get an error message. If somebody has the time can they go in and click on it and see if it opens for them and it's just me, or if the site no longer opens them once i am in Rodarte case file. Thanks! They're the green little icons on the right hand side.

ETA... It works on my computer. The things have significance that are in these documents are that they are still searching for AB, ( during his interview, Rodarte gave his address as the same address as AB). They tried to serve him again on 7th of August, but found out that they were kicked out as renters after the incident. The defense has asked as of the 16th of August for the State to give a better address as they cannot locate him apparently.

The other document of Interest was they wanted to dispose her mother again on August 30th, so I guess that's already happened.

My IOS on my phone updated, and my phone will no longer open the documents for some reason. I'll just know that now, and if I need to look at them I'll look at them on the computer. I tried downloading some PDF readers from Google Play, but that's not seeming to work. Oh well. No problem.

I just now posted this in another case, and I thought to post it here. I don't remember any cases in Florida where jury submitted questions.

"The states that expressly encourage judges to allow jurors to question witnesses are Arizona, Arkansas, Florida, Indiana, Iowa, Kentucky, Nevada and North Carolina. Out of these jurisdictions, Arizona, Florida, and Kentucky require that judges allow jurors to question...

ETA- this states Florida has jury questions allowed. I don't remember that at all in Florida cases I have followed. I very much remember it from Jodi Arias case. I wonder why I don't remember that Florida allow such. Getting old I guess."

It usually takes 3 to 6 days for the actual document with identifying information to be released. Since it is a holiday, it may come up on later. Right now the site only has the title of the document. Without the attachment.

Re deposition requests, It may be a redo of two who didn't show up earlier, as I will be surprised the defense is doing subpoenas for somebody new. We have seen the defense do multiple requests on the same folks previously, and I assumed it was because there was conflict and it did not happen.

If they are deposing somebody new, that would be very interesting.

And something to follow up on.

1) One of the subpoenas for deposition is for Peter Gillespie,
in care of the medical examiner office in Jacksonville Florida. I don't recall that one before. They are supposed to be to be deposed on October 23rd at 2 p.m.

I was thinking he was looking for the address as he did before for the old roommate. But all of these are for the medical examiner's office on Jefferson Street. But apparently he is trying to locate a witness Robert Krammer with the medical examiner's office?

When I read that her hyoid was broken in autopsy, I questioned why the medical examiner did not say her cause of death was from strangulation. To me I think it's very obvious. It was strangulation that was her cause of death. I don't think the prosecution is going to say that she was burned when alive. But perhaps the defense is wanting those lung histology to make sure there is no smoke inhalation or anyting? Why would they want it?

Based on the above, I am thinking the defense is trying to verify what the prosecution witnesses are going to say. Are they going to say it was due to asphyxiation or something else. Why else would they ask for lung sections?

Attached is a previous defense request which leads me to this question of what they are trying to set up as his defense or poking holes in the prosecution.

Same old, same old, defense says how can you prosecute him for the killing if the prosecution doesn't know how she died.

Another Casey Anthony case in Florida perhaps where the defense tells the jury that the prosecution does not know the specific cause of death and the time of death, date of death, place of death that they can't prosecute.
Pffft.

Below is the screenshot for the defense is asking the prosecution for a written statement for the particulars for the

1)place,
2) date,
3) time of death.

ETA.. as he only has a public defender, and not a high-profile criminal lawyer, I don't think they're going with the story of they had mad passionate sex in the parking lot, ( and that is the reason why the car was shaking and the door was opening and closing) and then they left and then something else happened. That is only with trials I have followed that have high-profile attorneys that would put out such a ridiculous alternative to the truth.

But I have always wondered why the defense asked the prosecution for the photographs from red light cameras.

Activity since the last pre-trial hearing in December include

The state's attorney has filed a second supplemental discovery (attached below) which includes

1) a new address for AB, Lee Rodarte's roommate at the time of the murder. ( the defense said previously they could not locate him)


2) a new FDLE report from November 7th by Ms S Warf ( it appears that she is a forensic serology touch DNA expert)

3) contact information for R Kammer in the ME's office.

As a result, there was a notice of future defense deposition for Ms Warf, and the deposition is scheduled for January 29th. ( she's a subject matter expert on touch DNA, and testified at the Michael Dunn trial)

I have a feeling the trial may be delayed again because I have not seen a notice of subpoena for a deposition of AB, who was his roommate at the time of the murder and would be key at trial moo.

Waiting for the next status hearing on January 15th to see if we're on schedule for end of February for the trial to start.
