@Niner, second update today, and there may be others as the hearing started 8 minutes ago m o o. The STATE has put in a demand for speedy trial. That's different than most cases! It's usually the defense. I guess they are fed up.

Hugs and positive thoughts for her family, especially her mother. May she be well enough when this trial happens so that she can see justice for her daughter.

hmmm.... looks like there WAS a hearing on 8/8, Thursday per this article.

Autopsy findings examined in death of Bonefish Grill worker

JACKSONVILLE, Fla. - The man charged with murder in the 2017 killing of his on-again, off-again girlfriend was in court Thursday, where the medical examiner who completed the autopsy described his findings.
[.....]
odarte claimed Gold was slapping him and grabbing his neck, when he grabbed her neck "in an effort to break her grip." Rodarte described hearing and feeling a pop in Gold's neck.

On Thursday, the state and the defense focused on the pop, and on an injury Dr. Peter Gillespie found to cartilage in Gold's neck. Gillespie told the court the injury was serious but not life-threatening and could indicate strangulation.

The doctor told the state that a pop would not cause instant death, and that Gold's spinal cord was not severed.
[.....]
Thursday's hearing was continued to next week when more witnesses are expected to be called.

And next week would be 8/14.

Yes, it was continued.

See jpeg below also.

43 page depo is going to be available soon

ETA #2, I'm going to go through my notes and see who did a deposition on October 23rd. If I can update this post within the time to edit of 60 minutes I'll do it. My guess is the medical examiner who was on the stand today, and who said during testimony according to the news reports that it was his opinion, but he did not have evidence.

1) One of the subpoenas for deposition is for Peter Gillespie,
in care of the medical examiner office in Jacksonville Florida. I don't recall that one before. They are supposed to be to be deposed on October 23rd at 2 p.m.

2) this subpoena for deposition is still unavailable on the website

3) this is for notice of taking a deposition for Peter Gillespie at the office of the medical examiner in Jacksonville Florida 2 p.m. for 60 Minutes on October 23rd

4) defendant is attempting locate Robert Karamer C/o MEO 2100 Jefferson Street Jacksonville Florida 32206

I was thinking he was looking for the address as he did before for the old roommate. But all of these are for the medical examiner's office on Jefferson Street. But apparently he is trying to locate a witness Robert Krammer with the medical examiner's office?

I'll have to look back and who RK is, as I don't recall him. Niner do you recall who RK is with the medical examiner's office?

Bump. It was the medical examiner office that was on the stand today that was deposed from previous post here on October 23rd. PG.

ETA the document that is going to be released in probably two days is going to be 43 pages long. I have never figured out how to upload a PDF. I can only do screenshots. Perhaps somebody else in the next couple of days that knows how to do this core website can capture a PDF and upload all 43 Pages for us all?

Upthread, I had noted that the state actually did what I have only seen done by the defense...... asking for a speedy trial.

They have (prosecution) invoked Marsy's law, which is a new law? in the State of Florida. As of January 2019.

They have invoked it because her mother has cancer. I'm speechless.

I have been saying in many posts that I hope her mother sees Justice, and I am shocked and in awe, in a positive way, that the state has done such to request a speedy trial.

The name of the new law was not mentioned in the paperwork here, but it WAS mentioned in court this week as basis for speedytrial by prosecution,( and no I do not have a link ).

You can Google the new law, there may be many other cases in the State of Florida and other states that perhaps we should spread the word here at websleuths. @SeesSeas

it pushes the defense to quit @(,!svgt messing around and forces the trial to go forward.

Attached are screenshots of the state submission for such.

Marsy's Law - Wikipedia

What Does Marsy's Law, Amendment 6 Mean For Florida?

@SeesSeas

I have tried and tried to do a copy paste of the bottom of the first page and the top of the second page to put within the post, versus being a JPEG. Does somebody else know how to do that as I would like to share it but I don't know how to other than a jpeg. Thank you in advance.

Prayers going up that this b*st*rd is not preventing her mother from seeing Justice for her daughter being murdered, in addition to her being a witness for the prosecution and having been disposed by the defense.

ETA Note that a calendar call is required under the law, so @Niner, that may be why things appear to be changing and now the jury selection and the trial is now labeled as a calendar call and it never was before.

You need to go to adobe.com - and download the Adobe Reader. I just did that for my laptop, as when I got it fixed my pdf thing disappeared - and that worked going to Adobe site & downloading it.

Also - from the screen shot you have in post #527 - it looks like Aug. 14th hearing has been cancelled (line 235)? But the next line (#237) says something different?? Confused??

And I too - have never seen the State ask for a speedy trial! That's a first for me too.

Yes - that line confused me too! But after the 8/22 date it does FPT (Final Pretrial Hearing) and after 8/26 JS (Jury Selection). Which is it??!! LOL!

okay - just checked the court site:

Date Time Type Location Courtroom Cancelled
8/12/2019 9:00 AM PRETRIAL 3rd Floor 305 Yes
8/14/2019 9:00 AM HEARING ON MOTION 3rd Floor 305

So actually the next hearing - as it looks to me - is 8/22 as Calendar Call..... that means the trial has been cancelled for 8/26. ??

23 page deposition is now available (Gillespie depo).

Nothing in the medical examiner's deposition was outstanding to me.

He did speak that the body was wrapped in plastic then a blanket (Ed: can we assume we'll get testimony to say that it was his blanket?) and partially duct-taped.

He also spoke of the reason that the ethanol was there (.137) was due to decomposition/bacteria in his opinion, and also mentioned that they could not obtain blood so that the samples were from chest fluid. And why some of the tests could not be done was due to decomposition by-products.

He also stated that he rarely gives the opinion of COD as homicidal violence. He's only done that a few times in all the 17 years he has practiced.

I figured out how to upload PDF niner :D

DEFENDANT'S MOTION TO DENY AND/OR STRIKE THE STATE'S DEMAND FOR SPEEDY TRIAL

( it is a four-page document which will take probably take 2-3 days to be uploaded to the site.)

No word yet on the stand the ground hearing decision which began last week and is continued to 14th?. Attached are court notes from last Thursday ( concerning the medical examiner and the stand-your-ground defense, and the red light camera person that they have an objection to.)

It looks like the defense grounds for striking the prosecution's request for a speedy trial is due to the fact they say that the requirements to push a speedy trial are that the defense would have had to have asked for 3 continuances which were objected to by the state.

The defense at this time is saying that they have only asked for one continuance that was objected to by the state, therefore the state has no grounds to ask for a speedy trial.

It also appears the defense wants to point out that they got this right before they went to court the other day.

Thank you for ALL your updates dixiegirl!!

Well, that was a short one. It was judged that the prosecution is not barred from moving forward with the speedy trial. See above.

Attaching other orders today also. I haven't seen in the court website the result of the stand-your-ground defense today. Perhaps it is not up there yet?

ETA, Venuti is new PD, and Mizrahi is ASA? Moo.

ETA #2 I still have not seen the notification that the roommate has been deposed by the defense, nor the triangle girlfriend. Perhaps they did not want to do such until right before trial because they know that it will be public knowledge IN FLORIDA, and become immediately available with a Freedom of Information Act what is in a deposition when it is done?.

Still wondering if they are pushing for a deal as they have not, the defense, has not MOO interviewed and deposed the two most important people in the case perhaps TWO WEEKS prior to trial. M o o.

One moved out of state according to court I did a screenshot above, and the other lives in a gated community and The subpoena was not issued as I did a screenshot above. Neither I have seen have been deposed.

Moo. (Hey Lee, perhaps I can share Christopher Watts phone number with you to talk to him about NK)

There is a new 72 page document (attached PDF below) and 125 page document. I could only upload the 72 page and perhaps somebody that has Adobe Acrobat can split up the 125 page doc because it is too large for me to attach here. I have comments also on the 125 page., but I'll wait until somebody is able to post it before I make a comment and attach to such. 16-2017-CF-007212 is the "case sequence " to input at the above link in case you would like to help upload that. TIA

This document is the testimony of the lead detective from last week.

It's got a very good time line of what happened towards the very end of the investigation prior and just after the arrest. Some things of note.

I could not figure out who SE was, the person that the defense has just identified in the last 2 weeks. That person is mentioned on page 23, along with his father, and that law enforcement met with them early on at his house. (See post # 517 of event from 2015 as to the connection with Savannah).

Timeline of Saturday, August 5th.

10 am Before they arrested him, they did warrants for a search of his car, and to do a track and trace on his phone.

2 pm They met with a judge about 2 in the afternoon, and then they went to his employment at

4:20 in the afternoon to arrest him for his outstanding charges ( at this time, not the murder charge)

When they came out of the business, CS was sitting on a bench outside with another officer. They also took CS ( triangle girlfriend went voluntarily) about the same time, she was working that day also. Unknown if that was a strategy by LE to have Lee to walk by her with her speaking to an officer on the bench, or if he even knew that she was taken in about the same time. Of note, when one of the officers was talking to her outside of the establishment, she said she was Lee's girlfriend, yet in the 125 page document, when Lee was interviewed on Thursday night, he said that CS was not his girlfriend.

They interviewed CS first at 5 pm.

At 5:25 pm they began covert surveillance of Lee's house.

At 6:45 pm they got a search warrant for his house.

At 7:15 they began the interview of Lee. ( he came into the interrogation room at 5:28, but they made him wait :D until 7:15 to begin the interview according to the timestamp on the video below)

At 8:45 p.m. they executed a search warrant of his home. There were quite a few people in his home at the time, they were asked to leave by the police, The Only Name I recognize is the roommate.

At 8:50 p.m. law enforcement took CS back to her place of employment.

At 9:30 p.m., steps to begin recovery efforts started, and at

10:41 Lee was handcuffed and arrested for murder (see video with timestamp)

10:50, the dive team arrived, and at

11:30 p.m. they found the body 10 feet from the embankment in 3 foot deep water wrapped in a blue blanket and taped up.

11:40 pm exigent phone data for Lee's phone

Notification to family was made almost immediately afterwards, final ID would come later through the medical examiner.

MG, a neighbor to where he lived at the time, had a video that she deleted. I don't know the significance of that yet. It's not mentioned, but she has been deposed by the defense also as she is a "level A" witness. I don't know offhand where her house is in relation to his, and I'm not sure that I'm allowed to put it up once I look at that tomorrow. Ring doorbell footage that she had reviewed? Surveillance that she had reviewed? Personal video of the fire he did? I don't know if we would see if there was a subpoena for a surveillance company that it may be in the cloud to retrieve? I would think if it was on her phone and she had taken a video, they will be able to retrieve that from her phone? Guess we will have to wait until trial.

Items of evidentiary value mentioned for this case include a gas can, a shovel, red Playmate cooler, bleach, dirty gloves, bundle of plastic, clothing, two cans of dirt, black shoe on Club duclay Drive, black sock from the trunk of the Chevy, swab of sand from drivers kick plate, leadership paperwork with from the back seat and a hair from the back seat.
