In the photo taken before she was so savagely beaten, Josie resembles my stepdaughter. I pray to the Creator for a full recovery for this beautiful young woman. No young person should have to endure what she has at the hands of a another.

she moved her left side - arm, leg and hand! Her eyes are open just a slit. Dr.s are weaning her off the "coma" drugs. While doing the segment - they just got word she moved her RIGHT hand - which is significant because its the left side of her brain they are worried about and that controls the right side of her body - so movement of her right hand is REALLY REALLY good news!

Deerfield school beating suspects due in court Tuesday

FORT LAUDERDALE - The Deerfield Beach High School student accused of trying to kill teenager Josie Lou Ratley over an insensitive text message is due to appear in juvenile court Tuesday morning.

Wayne Treacy, 15, and a 13-year-old female friend accused of acting as his accomplice will be in front of Broward Circuit Judge Elijah Williams as he considers a defense argument to stop lawyers and investigators from publicly discussing the case.

Williams issued a temporary gag order late last month.

Treacy is facing a first-degree attempted murder charge in the March 17 assault. His friend is accused of identifying Ratley, 15, while knowing that Treacy intended to harm her.

Josie Lou Ratley's immediate medical expenses are covered by Medicaid, her family's lawyer said Monday, but the out-of-pocket cost of her long-term recovery remains in question.

The family of the beaten teen has seen an outpouring of community support after last month's brutal attack at Deerfield Beach Middle School, with local restaurants and leaders putting together drives for the Josie Lou Ratley Fund. At least four events are scheduled just in April, three within the next seven days.

The private trust was set up shortly after the attack to cover Ratley's long-term care, said Rick Freedman, the family's lawyer.

"When we set up the account, we didn't know what the extent of the tragedy was going to be," he said. "She may need speech therapy. She may need occupational therapy. We don't know what she will need until she wakes up and talks, hopefully. And she walks, hopefully."

Ratley, 15, continued to show signs of improvement on Easter Sunday, moving slightly in bed. Her mother, Hilda Gotay Ratley, was able to put the girl's hair in pigtails, working around the stitches from surgeries, her lawyer said.

My heart just breaks for Josie's mom. I can't imagine her feelings of helplessness and sheer terror with her daughter being so severely injured. I hope Josie will continue to improve and they will be able to put this awful event behind them.

I am so happy to read the news that Josie is moving, and her Mama put her hair in pigtails for Easter. Prayer works miracles!

Williams said his client was tearful at a court hearing Tuesday morning. Courtroom deputies stood in front of the 15-year-old suspect for much of the hearing, largely blocking him from the view of the public.

"He is, for lack of a better word, a mess," said Williams. He said Treacy wishes for Ratley's recovery and often asks how she's doing.~ end

Gag order withdrawn!

snip~Outside the courtroom, the attorney said Treacy did not remember everything about the beating of Ratley. While he did not say Treacy "blacked out" during the incident, he also did not dispute that characterization.

Investigators believe Treacy was angered by text messages he received from Ratley's phone that allegedly mocked the suicide of Treacy's older brother. Another girl, 13, is accused of helping Treacy find Ratley at a school bus stop.

Treacy's new lawyer also withdrew a motion asking for a gag order in the case. ~ end

"Mom is definitely feeling better, she's very upbeat," he said.

Freedman said that although Treacy is beginning to show signs of remorse, the Ratley family is still quite upset.

"They're still very angry, their child is sitting in a hospital bed in a coma for the last 20 days," Freedman said.~ end

Does he really care how she is doing, or does he not wanted to be charged with murder?

Hi Elle - Thanks so much for the updates. This act was so premeditated that I just don't think the boy is really concerned for her. I believe his remorse is centered on himself and what he can do to mitigate the trouble he is in. JMO and maybe I'm wrong. His lawyer is obviously going to indicate lots of remorse, whether there is any or not. Undoubtedly, he has also advised his client that his remorse and concern would help him in court.

ITA, Belinda. His actions and expressions before and after he nearly beat her to death tell us a lot more about his true feelings and character than any PR being fed us by his damage control-motivated defense attorney.

Just my opinion, but he had plenty of time to reconsider what he was about to do when he went home to get his steel toed boots and bicycled his way over to Josie's school. If the attorney wants to try and insinuate an act of rage or temporary insanity or whatever he might have going on...I don't think that makes much sense. How long did it take him to bicycle over there?

I will have to go back and read where I heard all that about the steel toed boots, seems I read somewhere that he actually carried them to the school and put them on after he got there, but I have to go check that out.

Well he should be concerned about her condition. If she were to die (thankfully it looks like it will not happen, but it looked like touch and go for while) his charges likely would have been upgraded to murder.

all he cares about is he got caught, and his life hangs in the balance with hers. and this 'blackout' stuff didnt work for jack ruby or sirhan sirhan either.

Just reported on local 11 o'clock news - JOSIE IS OFF THE VENTILATOR!!! She is breathing on her own. Her mother and attorney will be having a press conference tomorrow morning at 8:45 - station said they will be streaming live at www.justnews.com
(I think that's what they said - its channel 10 WPLG Miami station).

Thank you Lord for Josie's improvement. Please help her to continue to improve until she is fully recovered. Our prayers have been heard. Josie - we are all pulling for you!
