Jury selection in Luis Toledo murder trial could be completed Tuesday

"ST. AUGUSTINE -- Defense attorney Michael Nielsen has been here before: the Deltona mass murder case 11 years ago was moved to St. Augustine because of publicity in Volusia County.

Nielsen, along with defense attorneys Jeff Deen and Michael Nappi, are back in St. Augustine at the Richard O. Watson Judicial Center, defending Luis Toledo, who is accused in a triple murder.

The defense and prosecution are working on the challenging task of picking 12 people plus three alternates to serve on the jury. They have summoned 180 people since Oct. 2, chosen 11 jurors so far and hope to finish on Tuesday and then make their opening statements on Wednesday.

Toledo, 35, is charged with second-degree murder in the killing of his wife, 28-year-old Yessenia Suarez, and two counts of first-degree murder in the deaths of her children, Thalia, 9, and Michael, 8. If convicted of killing either of the children, Toledo could face the death penalty...."

Jury of 12 plus three alternates is seated in #luistoledo trial. The panel is made up of four men and 11 women.

Prosecutor Ryan Will starting openings telling jurors that it's been 4 years since Felicita Perez has seen her daughter and grandchildren.

Will says Toledo killed his wife "in a violent and brutal way" and then killed the children.

"These crimes were senseless and they were brutal," Will said Toledo is accused of killing Yessenia Suarez & her children Michael and Thalia

The two children did well in school and participated in activities, Will said

Will tells jurors that Toledo was occasionally out of work and cared for children while Yessenia Suarez kept them financially afloat

Yessenia Suarez was often unhappy with her husband and his failure to achieve. The couple was married for 2 years

Trial will focus on the time between Oct. 13, 2013 and Oct. 23, 2013, Will tells jurors.

Will says that while on a business trip to Alabama Yessenia Suarez had an affair with another man.

When she returned home on Oct. 16, 2013, Yessenia Suarez texted Toledo that she did not want him to be a part of her life or her childrens

Will said Toledo was completely obsessed whether his wife had an affair. He installed an sms tracker on her phone

The electronic tracker told Toledo where she was, what calls she received, what text and emails she was sending and getting.

On Oct. 20, 2013 when Yessenia Suarez was looking for a hotel to meet her lover, Toledo was watching on the sms tracker he put on her phone

On Oct. 22, 2013, Toledo has his suspicion confirmed at 8:51 a.m. when Yessenia Suarez starts chatting with her lover

Will said #luistoledo went to her workplace shortly after learning identity of her lover. Then he left and later called her lover

#luistoledo later returned to his wife's workplace and caused a scene, and police were called but Toledo left before they arrived

About 6:30 p.m. on Oct. 22, 2013 around the home of Felicita Perez, was the last tracking data on #luistoledo's phone, which was never found

Yessenia Perez & her kids left her mother's house about 7:49 and went home but Toledo was not home. Police don't know where #luistoledo was

At six minutes before midnight, Toledo sent a message to his wife's lover pretending to be Yessenia. Toledo had returned home by then

On the morning of Oct. 23, 2013, Felicity Perez went to work and called her daughter. She said she had an ominous feeling.

Felicita Perez called her daughter's phone that morning but never got an answer. She kept calling but no answer. #luistoledo

#luistoledo pulled into the driveway seven minutes after police arrived. He told police he was going to work but was running out of gas

Evidence will show that was #luistoledo's first life to police. He had a quarter tank of gas. Toledo was supposed to be at work

#luistoledo gave law enforcement a tour of the house and the smell of cleaning fluids was overwhelming, prosecutor Will says

#Luistoledo's neighbor Tyshawn Jackson were attending barber school together. Toledo asked him for help early morning on Oct. 23, 2013

Tyshawn Jackson saw #luistoledo wiping down his wife's Honda Accord. After following Toledo to a Publix in Seminole County

AS they drove back after Toledo wiped down his wife's car, Tyshawn Jackson said #luistoledo told him "I snapped."

#luistoledo had told police that he had been sleeping in his car and that his wife and her kids must have left in middle of night

#luistoledo changed his story when confronted with photos of evidence found based on information provided by Tyshawn Jackson, Will said

#luistoledo then said he killed his wife when she attacked him and he karate chopped her in the throat, Will said

Will said #luistoledo told police that Tyshawn Jackson panicked when Toledo killed his wife and then Jackson killed the kids

#luistoledo told police that Tyshawn Jackson ordered him to clean the house

"I'll never tell you where the bodies are," #luistoledo told investigators at a later interview, prosecutor Will said

Will tells jurors that the little girl's blood was found in the house, on Toledo's left shoe and in the trunk mat of wife's car

#luistoledo killed the two children to eliminate them as witnesses because they saw what happened or would ask about mother in morning

Will finishes opening statements and now court is in recess

ST. AUGUSTINE, Fla. - Opening statements began Wednesday morning in the murder trial of a 35-year-old Deltona man who is accused of killing his wife and her two children.

Twelve jurors and three alternates -- 11 of whom are women -- will be seated Wednesday for opening statements in the trial of Luis Toledo.

Felicita Pérez, the mother and grandmother to victims, continues her testimony

Felicita Perez said she closed her daughter's bank accountt two years after her daughter and children vanished.

"She was nervous, scared," Felicita Perez said about her daughter arriving at her house the night of Oct. 22, 2013 #luistoledo

The kids were not in school on Oct. 23. until then they had perfect attendance, except 1 tardy, Nathan said. #luistoledo

Owens said he saw Toledo and Yessenia walked out into the parking lot having a heated conversation. #luistoledo

Owens said Dredden said he would take care of it and he went over and talked with Yessenia and Toledo. Then Toledo started walking away

But Owens said he was in his office minutes later and heard yelling then saw Yessenia Suarez and Toledo down the hall.

Toledo walked to Owens and said he needed to see the messages on Yessenia's phone. Yessenia was trying to take phone from Luis #luistoledo

Another employee took phone and handed it back to Luis and then Yessenia grabbed it from Luis and got phone

Owens said it looked like there would be a physical fight but it didn't happen. She said Suarez was embarrassed and upset

Owens said that after Yessenia snatched phone back from Toledo he turned, looked her in the eye . Owens feared there would be physical fight

"Did Yessenia ever show up for work after that?" Prosecutor Mark Johnson asked. Owens said "she did not." #luistoledo

Jessica Vandergriff, another former American K9 employee now testifying. She said she saw Toledo and Suarez talking in Spanish.

She said it wasn't a good conversation but she did not know what they were saying because it was in Spanish

Vandergriff said Yessenia asked her to call the cops and she called the Lake Mary Police Department.

ST. AUGUSTINE, Fla. - Opening statements began Wednesday morning in the murder trial of a 35-year-old Deltona man who is accused of killing his wife and her two children.

Toledo was quiet as prosecutors tried to paint him as an angry, jealous husband. They said that his marriage was ending and that he was jealous of an affair Suarez was having.

Prosecutors said Toledo installed a tracking app on her phone to access her location in real time. They said he killed her in a rage and killed her children to eliminate the potential for witnesses before seeking help from a neighbor to dispose of evidence.

"His answer is, 'I'll never tell you where the body is,'" Will said during opening statements Wednesday. "Not that he doesn't know or blames Tyshawn Jackson. 'I'll never tell you where the bodies are.'"

Defense attorney Jeff Deen said because the bodies haven't been found, it's unknown how the victims died of if they're even dead.
