Johnson brings up Toledo's letter about sending three boxes, one large and two small to Texas. It's just odd, Johnson said

Johnson said that it's flat wrong to think there has to be direct evidence that Toledo killed the kids

Prosecutor: Toledo killed wife, then children to eliminate them as witnesses

ST. AUGUSTINE — Luis Toledo has admitted to killing his wife and — despite his denials — he killed her children to eliminate them as witnesses, a prosecutor told jurors as closings began Friday morning in the Deltona triple-murder case.

“They would know who killed their mother and they would be in a position to tell someone,” Johnson said.

Johnson said Toledo killed Suarez because she cheated on him then he killed the kids so they would not tell anyone. Johnson said it was wrong for Toledo to kill his wife, but there was absolutely no justification for killing the innocent children.

So Toledo had to come up with a plan.

“His plan was to admit what he could not deny and deny what he could not admit,” Johnson said.

Toledo sat still next to his attorneys, watching without expression as Johnson made his closing arguments.

Well, we are on verdict watch. Do you think it will be today? Does this jury want to spend a night or two in a hotel? Are they prepared to go into the second phase if they vote guilty on first degree?

I'm really worried about this. The defense put a lot of doubts in their minds--or rather, tried to. I hope the confession in the tapes helps but also worry that he'll only be found guilty of manslaughter. I'm on pins and needles--this case is dear to me since I lived nearby at the time and still pass by the house every time I go grocery shopping. And I think of Yessenia and the kids every single time. :(

The second degree count for the murder of Yessinia should be quickly decided; he admitted he killed her. As for the children, I think first degree should be easier to prove for Thalia since they found her blood in the bathroom and on his shoes. And even though there was no blood evidence recovered from Michael, it it logical to believe his fate was the same as his sister's.

I don't think there's any doubt that both children were murdered, I think the doubt may be in who actually did it since it can't be proven who or how. Common sense says it was LT, Tyshawn has no history of violence and no motive. We know, however, that sometimes jurors lack common sense....so we wait.
