@ZaZara - the article above mentions a Oct. 24th date - did he have a court date today? or just that testimony from the cell mate?

TIA! :)

It was a day in court, and both his lawyer and the lawyer of Maëlys' parents were there, but I have not seen any mention that Nordahl Lelandais was taken from his cell to the court. IMHO it was lawyers-only day.

Maïtre Alain Jakubowicz requested that evidence was removed from the case.
Maître Rajon wants the charges to be reclassified to assassination and rape.

Les parents de Maëlys demandent que Nordahl Lelandais soit jugé pour viol et assassinat

The parents of Maëlys, the little girl who went missing on 27 August 2017, want Nordahl Lelandais, her alleged murderer, to be tried for assassination and rape.

They want the aggravating circumstances to be used against Nordahl Lelandais. The parents of Maëlys, whe went missing on August 27 2017, have requested the courts to try her alleged murderer for assassination and rape. Currently, the former soldier is under indictment for kidnapping followed by murder.

The lawyer for Jenifer and Joachim de Araujo's parents filed a request for reclassification with the investigating judges to request that the proceedings against Nordahl Lelandais be amended. "Today, Nordahl Lelandais is not being charged with acts of a sexual nature on Maëlys, in the same way that he is not being charged with acts of murder on Maëlys, and my clients have had the opportunity to say that this criminal qualification is not acceptable to them," Me Rajon said.

"Well if it isn't acceptable to them, that's one thing. On the other hand, the fact that we may have objective elements that lead us to fear that Maëlys de Araujo was the victim of these abuses is another matter and we do have these elements," the lawyer for the girl's parents added. He was referring to the testimony of a former co-detainee of Lelandais.

Last August, a man who spent six months in a cell next to Nordahl Lelandais' cell at the Saint-Quentin-Fallavier prison said that the latter told him that he had raped Maëlys before beating him to death. This testimony contradicted the statements of the suspect who, since the beginning of the case, has always claimed to have "accidentally" killed the girl.

On Thursday, Nordahl Lelandais' lawyer, Alain Jakubowicz, requested the investigating division of the Grenoble Court of Appeal to cancel this testimony implicating the former soldier. The decision was deferred until next week.

"The manifestation of the truth in the Maëlys case is a very difficult undertaking and one in which we must not rely on Nordahl Lelandais to move it forward," Mr Rajon reacted. "By contrast, making such a request, I consider that it hinders the manifestation of the truth, which is the reason why if the testimony has been gathered in a regular manner, it should not be dismissed."

Nordahl Lelandais is already facing life imprisonment with a security penalty at the end of which he would be eligible for release. But if the charges of murder and rape of a minor were to be prosecuted, Nordahl Lelandais would then face criminal imprisonment for life, i.e. without the possibility of being released. An exceptional penalty imposed by a "special decision" of the court.

Nordahl Lelandais : une nouvelle information judiciaire ouverte pour agression sexuelle

Nordahl Lelandais: New judicial investigation opened for sexual assault

After the hearing of Nordahl Lelandais' first cousin, the judges decided to open a new judicial inquiry into sexual assault against the former dog-handler.

A new young cousin accuses Nordahl Lelandais of sexual assault. The young woman who was 14 years old at the time of the incident was heard by the judges on Tuesday, October 29. At the end of the hearing, a judicial investigation was opened, according to L'Express. In addition to the magistrates, a psychologist interviewed her to assess the credibility of the teenage girl.

In addition, during the preliminary investigation, messages were found on her phone, proving the nature of the exchanges between Lelandais and his young cousin. "At the end of March, he started sending me messages and I answered him because I was scared. He said to me, "When is it we will we get married? you're my little bomb," and stuff like that.

The events allegedly took place in March 2017 when the former dog-handler took advantage of a state of weakness of his alleged victim to engage in touching. During her first testimony, she explained that during the funeral of her father, Nordahl Lelandais had first comforted her by holding her in his arms before taking the opportunity to touch her "chest" and "buttocks with insistence". He then threatened her with death: "If you tell, I'll kill you".

Shocked with fear, the teenager wraps herself in silence. It was the former soldier's double indictment that finally led her to reveal everything to her mother: "I heard about my second cousin, I thought it was time to talk about it, that I shouldn't keep it to myself any more. That I had to talk about it because I couldn't keep it to myself anymore, it was too hard," she told BFMTV last July.

The alleged victim encourages all persons who have been victims of Nordahl Lelandais to come forward and file a complaint.

In addition to the three sexual assault cases, the former dog-handler is being charged with the murders of little Maëlys and Corporal Arthur Noyer. He is also suspected of killing Thomas Rauschkolb.

IMHO it would be more accurate to call Nordahl Lelandais a person of interest in the unexplained death of Thomas Rauschkolb.

We don't have a word for person of interest in french, not that I know of at least

It was kinda late when I posted this , and I think I was referring more to the Websleuths lingo (suspect = named as such by police). It is mainly the family of Thomas Rauschkolb who have suspicions about the involvement of Nordahl Lelandais. He is not a formal suspect, as far as we are aware. IMHO the newspaper was overdoing it by claiming: He is also suspected of killing Thomas Rauschkolb.
It isn't even clear if Thomas Rauschkolb was killed.

To be fair, most newspapers have been milking the Nordahl Lelandais story. Most people know it's a stretch to call him that, I agree POI would be a better term in this situation but as I said, we don't have such an expression in France. Also, with his ex girlfriend's claim that he killed Arthur a couple of days after assaulting her and Thomas Rauschkolb dying just after their first break up, I feel like his involvement should be looked into.
Also, for context, Chambéry is as small town, there are very few clubs in the area so the both of them being in that club at some point is not surprising. IMO I don't think Nordahl Lelandais is involved in all those disappearances, there is a clear escalation to his acts in a short lapse of time so I really don't think he's responsible for the disappearances of people back in 2010 but TR's death would fit the time frame. Again, JMO.
I feel like I should add : weird things, violent things go down in the area. For example, the brother of one of NL's potential victims, the second one to disappear from the music festival, was found dead in a park a couple years ago, stabbed 28 times.
Meurtre d'un marginal à Chambéry : l'effrayant profil de l'étudiant tueur
My point is : I really don't think all those missing people went missing because of NL, sorry for rambling

So @ZaZara - the article you posted in #84 - is NL's being "charged" cause I already have in my descriptions:
*Preliminary investigation has been opened (7/1/19). A young cousin of Nordahl Lelandais told BFMTV that she was sexually assaulted in March 2017 by the alleged murderer of Maëlys.

Or just "further investigations" ?? TIA! :)

The first one was a preliminary investigation, then comes the court hearing and the judges decide to open an investigation into sexual assault.

Original report in L'Express describes the preliminary investigation as follows:
Accusé par une petite-cousine, Nordahl Lelandais visé par une nouvelle enquête

Investigations conducted during the preliminary investigation phase made it possible to take her testimony seriously: the teenager answered questions from a psychiatrist. And messages were found on her phone, proving the nature of the exchanges between Lelandais and his younger cousin.

Affaire Maëlys : une expertise psychologique accable Nordahl Lelandais, son avocat tente de la faire annuler

Maëlys case: a psychological expertise is damaging Nordahl Lelandais, his lawyer is trying to get it withdrawn.

This expertise in the investigation file describes him as "a narcissistic manipulator without a sense of guilt".

While the Grenoble Court of Appeal is due to render its decision on Thursday, October 31, on the cancellation of a prosecution testimony against Nordahl Lelandais, BFMTV unveils a psychological analysis of the former soldier conducted between January and June 2018, "both before and after he confessed to the murders of Arthur Noyer and Maëlys de Araujo," the channel said.

The 30-year-old met five times for more than two hours with a psychologist, who produced a 73-page report. Nordahl Lelandais is described as a narcissistic manipulator without a sense of guilt. His lawyer, Alain Jakubowicz, is calling for the withdrawal of this expertise.

During these interviews, the former dog-handler stated that he had indeed taken Maëlys de Araujo into his car the night of his abduction, from 26 to 27 August 2017, during a wedding in Pont-de-Beauvoisin, Isère. But he says, "I wasn't the driver! I was a zombie! As if it was an entity that was taking me over. Like in a video game."

After acknowledging the murder, he explained that "it was a monster that killed her! It wasn't not a person. I panicked as if I was bewitched by a demon, a devil. I had the impression that Maëlys wanted to attack me, that she wanted to hurt me. But these arguments did not convince the psychologist, who detected in him "constant mythomania" and an ability to "manipulate" accentuated by his impression of being in a "position of omnipotence".

The expert likens this behaviour to that of an animal and considers that the former handler "identifies" with his pets, whom he particularly loves. Nordahl Lelandais is under investigation for the "murder" of the 9-year-old girl. He is also charged with "murder" in connection with the death of Corporal Arthur Noyer.

Found Deceased - France - Maëlys De Araujo, 9, Pont-de-Beauvoisin, 27 Aug 2017 - #2

7/16/19 Update: Lelandais in court re Noyer case today, 7/16. The hearing lasted five hours. Nordahl continues to claim that he merely slapped Noyer and that Noyer's death was an accident. Trial is expected sometime in 2020.
8/27/19 Update: New information sheds light on the personality of NL According to revelations from Le Parisien, confirmed on Tuesday 27 August by franceinfo, a detainee at Saint-Quentin-Fallavier prison (Isère), where he is incarcerated, said that the 36-year-old former soldier confided in him and revealed sordid details about the circumstances of the deaths of Maëlys and Corporal Arthur Noyer, whose body was found in September 2017. NL told him that he raped the girl, before beating her to death and disposing of the body. This testimony undermines the position of the former dog-handler, who maintains that he did not commit any sexual violence against Maëlys and admitted in February 2018 that he killed the child, but "unintentionally". NL also told him why he murdered Noyer. According to him, the latter had rejected his advances. The investigation into Maëlys' murder is due to be completed this autumn, with a view to a trial. In total, NL is indicted in four cases: the murder of Corporal Arthur Noyer, the murder of Maëlys and sexual assaults on his two little cousins aged 4 & 6.
10/1/19 Update: The investigating judges have closed their investigation into the death of Arthur Noyer. The prosecutor's Office in Chambéry. From now on, the prosecutor has a period of one month (11/1/19) to make his requisitions, the most likely being that the latter would request referral to the Assises Court. During this period, each party may also make requests or submit motions.
10/24/19 Update: Last August, a man who spent six months in a cell next to Lelandais' cell at the Saint-Quentin-Fallavier prison said that the latter told him that he had raped Maëlys before beating him to death. This testimony contradicted the statements of the suspect who, since the beginning of the case, has always claimed to have "accidentally" killed the girl. Maïtre Alain Jakubowicz (Lelandais' attorney) requested that evidence was removed from the case. Maître Rajon (Maëlys' parents' attorney) wants the charges to be reclassified & amended to assassination and rape. Currently, the former soldier is under indictment for kidnapping followed by murder. The decision was deferred until next week.
10/29/19 Update: Judicial Inquiry: After the hearing of NL's first cousin, the judges decided to open a new judicial inquiry into sexual assault against the former dog-handler. The young woman who was 14 years old at the time of the incident was heard by the judges on Tuesday, October 29. At the end of the hearing, a judicial investigation was opened. 10/31/19 Update: A psychological expertise is damaging Lelandais, his lawyer is trying to get it withdrawn. This expertise in the investigation file describes him as "a narcissistic manipulator without a sense of guilt". His lawyer, Alain Jakubowicz, is calling for the withdrawal of this expertise. The Grenoble Court of Appeal is due to render its decision on Thursday, October 31.

JUSTICE. Affaire Maëlys: le témoignage accablant Nordahl Lelandais restera au dossier

The Grenoble Chamber of Investigation handed down a long-awaited ruling on Friday [ Thursday! ] in the Maëlys case: it did not grant Nordahl Lelandais' lawyer's request to cancel a damning testimony for his client.

This testimony on file is that of the former prisoner of the Saint-Quentin-Fallavier prison who, in isolation, was near the cell of the alleged murderer of Maëlys. This man had assured him that Nordahl Lelandais had told him how he had raped and killed the little girl, with many details.

Taken very seriously, this testimony was therefore placed on the record, further undermining the defence of Domessin's ex-military who keeps claiming to have accidentally killed the child.
This new decision is therefore a new setback for the defence provided by Alain Jakubowicz.

On the other hand, this decision certainly supports the request made by Maëlys' parents, through their lawyer Fabien Rajon, to request the investigating judges to reclassify the acts of assassination and rape.

"The investigating chamber considered that the psychological expertise remained on file but that certain passages should be cancelled, i.e. deleted. It also found that the hearing of the detainee implicating the defendant remained on file. The investigating chamber also annulled the prosecutor's supplementary indictment requesting the indictment of Nordahl Lelandais for the rape of Maëlys and rejected all the other requests of the defence. The public prosecutor is studying the consequences to be drawn from this judgment" according to the public prosecutor of Grenoble, Eric Vaillant.

Affaire Maëlys : le parquet se pourvoit en cassation

Maëlys case: the Public Prosecutor's office appeals in cassation.
The Prosecutor announced on Monday that he had appealed to the Supreme Court to contest the cancellation of the indictment for "rape" of Nordahl Lelandais, who admitted to having killed Maëlys "involuntarily" with several blows to the face.

A new twist in the judicial process regarding the death of little Maëlys de Araujo. The Grenoble investigating chamber rejected on Thursday 31 October the supplementary indictment requesting the indictment of Nordahl Lelandais for rape. Nordahl Lelandais is already being prosecuted for the murder of the girl. The General Prosecutor's Office of the Grenoble Court of Appeal announced on Monday 4 November that it has appealed in cassationt to contest this annulment.

The prosecutor's supplementary indictment mentioned acts of murder "preceded, accompanied or followed by rape". It followed the inclusion in the Maëlys case file, at the end of 2018, of the testimony of a cell mate of Nordahl Lelandais, at the Saint-Quentin-Fallavier prison (Isère). According to him, the ex-dog handler told him that he raped the girl before killing her.

Nordahl Lelandais, who has since been heard on these statements and confronted with his former cellmate, contests this version of the facts. He claims to have killed Maëlys "involuntarily" with several blows to the face and denies any sexual assault.

His lawyer, Alain Jakubowicz, had requested on 18 September that this statement be cancelled before the investigating magistrates, but this request was also rejected last week by the investigating chamber, as was the request to cancel the psychological expertise to which Maëlys' alleged murderer had been subjected since his arrest.

In recent weeks, confirmed by the uncovering of the ex-convict's testimony, but also by suspicions of sexual assaults by Lelandais on his little cousins, Maëlys' parents and their lawyer Fabien Rajon had reaffirmed in the press their wish to see the ex-military prosecuted for "rape".

They also demand that the 30-year-old be sent back to the criminal court for " assassination " and not for " murder ", which would expose him to a heavier sentence: life-prison without any penalty adjustment [ parole ].

Nordahl Lelandais is also under investigation for the murder of Corporal Arthur Noyer in April 2017 and for the sexual assaults on his cousins. An investigation for "endangering the lives of others" is also under way after a former girlfriend complained that she had been assaulted in mid-July 2017.

I do wonder why the Court rejected the request for the additional charge of rape while admitting at the same time the testimony of the cell mate who specifically mentions rape.

Strange IMHO.

"Non élucidé" va consacrer une émission à la disparition de Lucas

1521203646_lucasok.jpg

The "Non élucidé" programme ["Unclarified"] on RMC Story spent several days in Bagnols-sur-Cèze with the parents of Lucas Tronche, the 15 year-old teenager who disappeared in March 2015 in the Gard in the Rhône region of France. The filming of the programme by Arnaud Poivre d'Arvor and Commissioner Jean-Marc Bloch, former boss of the PJ at "36" and in Versailles, took place in June in Bagnols-sur-Cèze. The film will be shown during the winter. All hope that this broadcast will trigger new evidence. We will come back to this later.

BBM

Nordahl Lelandais is not a suspect in the disappearance of young Lucas Tronche, but we keep hoping he will be found soon.
