I've been reading up on Mr. Goughs trial record. I found a statement from him regarding his 2008 campaign for Solicitor.

Prior to his campaign, he had worked as a prosecutor and then went into private practice.

Out of the cases that went to trial, he claims to have lost 1 case in 15 years as a defense attorney. This conviction was later overturned and dismissed. This does not include plea agreements.

If this is true, that is an impressive record. moo

I'll try to find the statement and link it.

He did not win the election btw.

It is my understanding Mr Gough is head of the Republican Party in Glynn County. He also has an open Facebook page you might want to review.

Haven't we been told OVER AND OVER that Sherry West is a VICTIM and should be treated as such here at WS?

Hi Minette,
What could he get? Are you familiar with the sentencing guidelines for this type of crime?

Do you have habitual offender laws? I'm in Texas and a crime can be enhanced if someone is a repeat offender.

alwaysonmymind, are you originally from Georgia? Your handle kind of makes me think so. :)

No, I do not know what kind of sentencing would be typical for crimes of this sort, because I've never heard of anyone shooting a baby in the face. :(

Georgia juries & judges tend to be pretty harsh on offenders against children, but who knows what will happen due to the age of these defendants. I do not mean to set myself up as any sort of expert on the legal system in Georgia because I have NO personal experience with it, not even a traffic ticket! I did get called to serve on a jury that involved the death of three children in a home due to an explosion in a meth-lab, but fortunately (and yes, that's my selfish take, because I don't know how I could have looked at photos of the children who died) the defendants pled guilty at the last minute. The 'mother' who allowed the meth lab that ultimately killed her children to be in her house received a 30 year sentence as did another co-defendant, for what that's worth. The man accused of running the lab escaped to (it is presumed) Mexico and is still at large.

The daughter recorded her mother's phone call, so I heard SM ask about the insurance.

Sorry, the end of the above quote makes no sense to me, who is making excuses for the person that shot this baby? <modsnip> IMO

I have heard many bizarre statements in funeral homes from people overwrought with grief. Not one of them saw their baby's face blasted away however. Can we have some compassion for a woman who is in the most horrific shock? Why even go there? The child wasn't killed for insurance. She did not sprint over to that lake and dump the gun.

Secondly, I am puzzled by the type of person who tapes a phone call under these circumstances. Was she all set up and ready to go? Who does that? Next time a relative loses a loved one...say, a child whose face has been blown off in front of them...be ready to tape when they call! Sure, every person of compassion...TAPES.

I stated earlier in this thread that, at the very least, DE will get a fair triel with Kevin Gough as his public defender. He is highly competent and well respected in this area, an excellent criminal defense attorney. Anyone who gets Kevin Gough assigned to him for a public defender is lucky and will get a defense usually only afforded to those who have the money to pay well. Thank God LE have hard evidence against DE and this will likely be pled out. I shudder to think what would have happened if LE didn't have the goods on these two.

I don't fault him for any of his statements made previously. He was only doing what defense attorneys do. He wasn't addressing the general public. He was addressing the jury that would sit on this case. Hard to swallow but it is what it is.

Just had a chance to read the indictment as I had to run just as they were posted.
Is that new information that Sherry was struck in the head by the gun?
I do recall that she said a bullet grazed her ear.

Again, how can he make a statement he made until he knows what evidence shows? I find that bizarre that he would claim that his client was 1000 % not guilty so early in the case-obviously not even having access to evidence collected by prosecution. At that time police hasn't even found a gun yet.

I believe that the struck in the head and grazed refer to the same injury. Semantics. Bullet had to strike her even if only to graze her.

Yes, Minette, I'm originally from Macon. :)

Those poor children. How tragic they paid the price for the Mothers poor choices. I'm glad you didn't have to sit on the jury and hear all the details of this.

I'll google and see what I can find regarding sentencing 17 year old murderers of toddlers in Georgia.

I thought that might be the case, but wondered as they used the word shot for the area of her leg and then we have 'striking the victim in the head with a firearm' so I thought I might have missed something along the way.

jjenny, I understand your outrage. But breath deeply and think about what you just asked. Defense attorneys must give 1000% to defending their clients ;)

think about some of the defense attorneys we have watched over the years say ridiculous, baseless things in order to defend their clients' actions.

He is no different. I was upset about another statement he made in regards to the family members and their being arrested. But now that I have simmered down and reflected I am much calmer.

It is SOP. Nothing more, nothing less.

I did want to make mention of that statement I took exception to though. He referred to teh family "shifting things" in order to place their loved one in a more favorable light.

At the time I thought he was referring to their faux alibis for DE. I now believe he was aware even then that certain family members had dumped the gun. It explains his rather unusual wording of his statement about that. They "shifted" (moved) the "thing" (gun).

Crazy...I guess people will find anything to argue about!!!

Here are the facts that we ALL can agree on:

Beautiful baby boy shot dead
Mother shot in leg and a bullet grazed her head-mother witnessed baby's brutal murder
2 young men charged with murder among many other crimes-related and unrelated
Several relatives of young men charged with various offenses related to and unrelated to the murder

This is a tragedy of epic proportions. An innocent baby killed in front of his mother in the most brutal way by 2 minor boys in broad daylight for NO REASON!!!

I agree with everything you posted up to the last sentence. While I have very strong feelings about what the women in Elkins family did, I won't be trashing anyone, it is clear to any with eyes exactly who and what these women are and I do not need to point it out to anyone or be leading the blind who will not see.

Wasn't being contrary but I want to thank your post while also being clear that I will not be participating in trashing anyone.

They are what they are and I don't need to label them as anything. People will draw their own conclusions.

Feel free to call out the trash where you see it, I can only speak for me

Please note that I put the word "trash" in parenthesis. I was quoting the word from the post I answered. I do not consider any of thecriticism I made or anyone else made of these "ladies" to be anything other than a curate summations of their character and morality.

whats your point?

Goonie, I didn't have "a point." Posters were discussing Mr. Gough and I was advising them where they could get more info and what little info I had been told.

I was contributing to the conversation...which I think is allowed on WS.
