Small problem with this theory:

If the suspect was the only one who knew the crime scene apartment was vacant he would have simply locked the door and everyone, including the police and apartment complex manager, would have never been the wiser. They would have assumed it was rented and skipped it in their search, and the perp could have come back at a later date and cleaned, or "discovered" the crime scene, or whatever.

I think the most likely answer is that the police officer conducting the search didn't do a whole lot of actual searching. He probably stuck his head in the door, saw a nice tidy living room, maybe called for Jorely, and moved on to "search" the next unit.

I do, however, hold out the possibility that this search was led by their helpful volunteer maintenance guy who happened to conveniently skip over this unit. However, that hardly constitutes an excuse. If they knew enough to check vacant apartments, they knew enough (obviously) to potentially suspect an employee.

And in any case, considering that they left the dumpster unsearched and unsecured over the weekend, and that they damn near LOST the body as a result, it is not unreasonable to assume that they applied this level of professionalism to all areas of this investigation. To review:

"The Canton police chief also declined to call in the state’s Child Abduction Response Team, which pulls from nine state law enforcement agencies with different specialties. Once the team was called — by the Cherokee County sheriff rather than the Canton police — it took just four hours to locate the crime scene and another two hours to find Jorelys’ body in a nearby trash compactor...

"For instance, local police did not search the trash container that held the body, and the waste disposal company was on the verge of hauling it off Monday when members of the state task force intervened.

Again, we know they didn't secure the dumpster, and we now have witness reports that the suspect might well have been using it late at night on the evening of the murder. They didn't secure the dumpster. Think about that.

That dumpster, with the body smashed up inside, was about to be hauled to the dump before the Sherriff's office finally said enough and called in the experts. Had the SO not done so this case might well have gone unsolved.

In my opinion, and with all respect, we don't need to speculate or invent scenarios that excuse or explain what happened. We know what happened.

The GOOD news is that it probably wont matter. I believe that this guy is in custody now because the police KNOW he did it. I believe that they have solid physical evidence and/or witness testimony linking him to the crime, and any screw ups that might have occured the first day won't stop this guy from going to prison.

Wondering if the Manager was just not available at that particular time meaning not on site or close enough for LE to get information ASAP? Have we heard anything in the Press or from LE that they dealt directly with Management on their initial arrival?

  • #125
Maybe that vacant apartment wasn't listed as vacant because it was possibly being held/refurbished for RB to move in to after he had finished a 30 day probation period working for the complex. Maybe RB did have the keys to that apartment. Maybe that is part of the reason LE is sure they have the right guy....because possibly RB was listed as the occupant. Just a thought.

Great observation except the part where he would be listed as an occupant. He would only be listed as a future resident if no money had been put down, or if he was waiting out a 30 day probation period. THAT is the best point made so far IMO - he would likely have to wait a certain period of time....our's is usually 90 days except in special cases, like someone moving from another town or city. So maybe he was just staying with the son temporarily and this was, like you said, the one slated for him. Busted big time if true.

Respectfully, it would seem that you know what happened. I, for one, do not. Yet.

Do we know what room the actual crime took place in?

Why should we accept this neighbors statement and not the statement of the other neighbor who said they searched the dumpster 3 or 4 times?

I also would like to know why there has been no reporting re: the manager or her son? That is very odd to me. jmo

I thought of this to,RB picked a Friday at 5 pm to carry this out.
he probably waited until everyone was gone for the weekend
and knew his plan could be carried out with no problem, meaning using the vacate apt-JMO

I have not heard that. I just always thought she went to her own apartment for the drinks. WOW. The bad apt. was 10 according to a post up thread. WOW again if true.

Here is the original news report which said that she went to apt. #10 to get the drinks.

- (showed apartment complex map) Jorelys lived in building #9 across from play ground, vacant apartment building #10 (saying that's where Jorelys went to get drinks?), vacant apartment in building #2 where LE believes she was killed, dumpster where she was found is next to building #2

"In a news conference Tuesday morning, Georgia Bureau of Investigations Director Vernon Keenan said an autopsy revealed 7-year-old Jorelys Rivera died from blunt force trauma and stab wounds. "
http://www.cbsnews.com/8301-504083_...-rivera-died-shortly-after-her-disappearance/

Reported today: "Police said Rivera was abducted by Ryan Brunn, a maintenance worker at the River Ridge Apartments on Dec.2. Brunn took Rivera to a vacant apartment where he bound, gagged, raped and stabbed her before dumping the body in a Dumpster and running the compactor, according to authorities."

Did the blunt force trauma come from RB or the trash compactor?

I personally don't know how they could tell. I said earlier when I asked the similar question, that was one hell of an ME to be able to tell all those things on a body that had been compacted and in a dumpster for maybe 3 days. jmo

ME = Medical Examiner

Okay, so if the news reporter was told that Jorelys went to apt #10 to get the drinks, then they must have something which proves that to be true. They allegedly found 4 coke cans out behind the Apt. I wonder if the other 2 from a six-pack were found inside the apt?

The ME will have the ability to discern what injuries were suffered pre mortem and what ones were inflicted post mortem.

When a living body receives a wound, it will have one appearance. It will have an altogether different appearance from trauma that was dealt after death, compacted or not.

Now if the body had made it to the landfill, and had been subject to the elements, carrion birds, and predation, for some time, THAT may have made COD more difficult to determine.

I think we are very very lucky that body was discovered within days of death rather than weeks, months or years. There would have been much less that the ME would have been able to report with any certainty.

I know all about post mortem, etc., but compacted to me means it was crushed. Now obviously it wasn't or they would not have been able to have an open casket last night. If there is an open can in the compactor there would be no way to tell how it was opened or the condition prior to being compacted. I am really amazed especially at the swiftness of COD. And especially the noting of the stab wounds, and apparent beating. It would seem to me those would be wounds of anyone who had been in a compactor.

I am not arguing/doubting just my opinion based on some logic. I am really glad the results of damage on the body was not as bad as what the word brings to mind at least to me. And they were able to determine COD. jmo

My question would be..why leave the coke cans there..he had to know evidence would be found on them..right-why did he not throw them away-if he is the one who gave them to her!!

  • #136
I think the reason RB's roommate and the roommate's mom have NOT been seen or heard from is because they might have given LE substanial information or evidence. You better believe I would be in hiding if I were in their shoes.

I agree, when I first heard compacted . . . Well you can imagine.

I know what you mean. It seems so sloppy on his part. I suppose he might try and use that in his " I WAS FRAMED" defense.

I am very confused by this reference to her going to a vacant apartment to get drinks, since it doesn't fit with other info that was reported. I can't find the link to the actual news story where that is said. Can someone help me out?

Well, I don't think it's like a car crusher and there was nothing but hard objects on all sides of her. There was likely garbage beneath her and to the sides, and if he was in a rush, possibly on top of her before the compactor was run. Kind of cushions things, I'd think.

And Friday night, Saturday night and Sunday night, I thought it got down to the upper twenties to low thirties. That compactor was likely like a refrigerator at night. :twocents:
