Lil Rod’s lawyers had a mistrial motion this morning after the State confirmed that they will not be calling 2 of their witnesses (who they had brought from jail) because they refused to say anything on the stand.Lil Rod’s lawyers did not object to all the social media and ig dm evidence from these 2 witnesses because they were under the understanding that the State would call them.Now that the State isn’t calling them, it’s a “confrontation clause” issue since they can’t be crossed on those posts.Judge denied the mistrial, after the State says they let the defense know they wouldn’t call them early in the day and the lawyers still did not object, so they consider the issue waived.

And to remind everyone - Rodalius Ryan aka Lil Rod is serving a life sentence for the murder of Jamari Holmes in Feb 2019. The state says Holmes was a member of a rival gang and the murder happened as part of #YSL - the RICO count. Which is why the states needs to present the evidence of the murder.

In fairness, the exhibit Lee had in ,of him had #FreeQua on it. What was being shown on the monitor to the jury had that redacted. Leee said he was looking at the exhibit not the monitor.
Multiple defense teams moved for a mistrial as the jury is not to know that the defendants are locked up. Nichols attorney: "It is painfully obvious that the state is not prepping their witnesses."
Judge Whitaker denied the motion for mistrial. (No idea how many motions for mistrial have been made in this trial but it has to be close to double figures at this point)
Judge Whitaker called out the state "Fix your sloppiness!"
Judge Whitaker asked the defense teams if they want a mistrial WITHOUT prejudice, meaning the case ends today but the state can retry it. All the teams are huddling! This is the closest we've been to a mistrial. Stay tuned!
It sounds like Judge Whitaker is ready to declare a mistrial if the defense teams want it. She won't do it with prejudice, meaning the case is permemently done. She'll only do it without prejudice giving the state the opp to try again. The problem for the defense teams is their clients could still be behind bars for years with a new trial.
The vibe in the courtroom: Prosecutor Love is visibly agitated. All the defense teams are huddled in one area.
The defense needs to make a decision on if they think they are winning this case. If they do, they should stick it out. It's been a long 20 plus months. Two judges.
And remember, #YoungThug has been denied bail over and over. I don't think that would change with a mistrial. He could still be behind bars waiting for a new trial. However, Fani Willis opponent vows to dismiss the case if she gets elected.
After the prosecution team huddled, they all just left the courtroom.

On the monitor the state had redacted a #FreeQua hashtag in the post, BUT on the exhibit that was in front of Wunnie, it was left in. He was reading off the exhibit and not the monitor so he said FREE QUA in front of the jury.......who is not supposed to know the two Qua's in the courtroom are locked up.
