Judge Whitaker has taken the bench in what could be the last week in the longest trial in Georgia’s history.

Jury selection began back in Jan. 2023 with 14 defendants, which was reduced to 6 by the time opening statements took place Nov. 27, 2023.

Now, only 2 remain.

Investigator Viverito is back on the stand to finish her testimony.

The state is expected to continue direct examination for about 2 hours before defense attorneys begin cross examination.

Most of the day has been spent playing phone calls between alleged YSL members with Hylton asking Viverito questions after each clip is played and Viverito testifying about her knowledge of YSL based on her investigation.

Viverito testified that she also worked in the YFN indictment.

Direct examination of Viverito continued for about 2 1/2 hours this morning (I deducted break and sidebars) before going to lunch. She'll still be under direct after lunch at 1pm. The state estimated last week they had about 2 hours left of direct but as the case with most attorneys.....on either side of the courtroom....estimations are rarely accurate. Assuming @MaxGoddard13 will still start his cross-exam at some point today.

The state is done with their direct examination.

Attorney Doug Weinstein is up first for cross-examination.

He starts off by showing pictures of Lil Wayne tattoos after Viverito testified regarding similar tattoos Kendrick and Stillwell have.

Weinstein asked Viverito about Lil Wayne’s “ESPN” tattoo but Viverito said she couldn’t tell Weinstein what the tattoo meant because Lil Wayne is not a member of YSL.

Weinstein is arguing that his client has the “ESPN” tattoo too but seems that the tattoo is only relevant on his client or YSL members but not other people. Weinstein said Kendrick was a football star that had a scholarship to UGA.

Weinstein just showed a video still of Viverito with the watch from YoungThug’s home he has been asking investigators about for the past couple of weeks.

Viverito said the still is from them taking inventory of YoungThug’s jewelry, she claims that it’s put back.

Viverito just said that she hasn’t been watching the trial but has been following it on Twitter/social media(?)

Weinstein seems to be hesitant for a second but Whitaker just said she shouldn’t have been watching the trial at all.

Viverito said she doesn’t know the value of the watch and she said that the watch was left there and the home was turned over to YoungThug’s father.

Viverito said they were speeding through it because there was a “hostile” crowd gathering at the bottom of the driveway.

Viverito testified that she did not personally see Kendrick inside of YoungThug's home during the raid or with any drugs or weapons.

Weinstein doesn't want to play video of the day of the raid at YoungThug's home that shows Viverito because he doesn't want to risk showing her face.

Viverito said there was a lot of expensive jewelry there and it's not her first case with it.

Weinstein is done with his cross-examination, before Schardt started, Whitaker asked them to approach to ask a scheduling question.

Viverito testified that she started working on the YSL with the DA's office around Fall 2021.

Viverito said she worked under Don Geary, who left the DA's office while the case was still in pre-trial motions hearings back in 2022.

Schardt seems to be taking an aggressive approach with Viverito, which Whitaker will allow during cross-examination.

Schardt is asking Viverito about reports, after she keeps saying that she didn't write reports about taking screenshots of social media or reviewing a phone.

Viverito keeps saying that she wrote everything in affidavits instead of making reports but she seems to be avoiding answering Schardt's question directly.

The jury was asked to exit the courtroom but Viverito to remain.

Whitaker wanted to make sure they clarify her answer to Schardt's question about Stillwell rapping about "beating a homicide."

Adam Abate is now asking the judge if they can ask in redirect about when Stillwell wrote the song.

Whitaker also said that with the state's case almost done, she will need to find out whether the defense will present a case and whether the defendants wish to testify or not.

Jury is dismissed until 10 a.m. tomorrow. Whitaker said they are getting to the point of needing to have a charging conference to determine what instructions to give to the jury, primarily about RICO.

Williams also acknowledged the conundrum of authenticity and the ways his lyrics — which have earned him so much commercial and critical appeal — were turned against him in the court of law. "I understand rap lyrics," he said. "I understand how it can be twisted. I understand what it can do to the mind of people. I understand all that and I promise you I'm 100 percent changing that. I'm older; I'm grown now. I'm smarter. It's more things to rap about. I've experienced a lot of good things. I've experienced more bad things, but I've experienced a lot of good things, too."

The parties are going over jury instructions this morning. The jury is due in at 10am. Heaven help them when they get to deliberations and have this stack of jury instructions. Inv. Viverito will still be on the stand under cross-exam by Max Schardt.

YSL trial/Day 163 ...

@JozsefPapp_

Attorneys and Judge Whitaker have been in the courtroom since 8:45 a.m. continuing working on jury charges until 10 a.m., when the jury is expected to come in and attorney Max Schardt to continue his cross-examination of Inv. Viverito.

Viverito is back on the stand after the jury arrived a little late. Schardt continues to question Viverito about social media posts she collected.

Viverito seems to be trying to keep talking about more than what Schardt is asking and Schardt's keeps telling her that they will get to the surveillance footage later."Answer the question that's asked," Whitaker tells Viverito.

Schardt is going in on Viverito about her investigation and the flaws of her sworn affidavits. Viverito is trying to explain herself a lot on the stand.

Viverito is struggling to answer some of Schardt's question, who has honed in on the flaws in her investigation of YSL, Stillwell and YoungThug.

It’s weird being back here without seeing Brian Steel, Keith Adams, YoungThug and the other defendants and attorneys.

Hylton is up for redirect. She is asking questions relating to Weinstein's cross examination involving the raid at Young 🤬🤬🤬🤬's house.

Viverito, as expected, is clearly more comfortable and forthcoming when answering questions for Hylton than she was for Weinstein and Schartd.

Late posts, posting for those that may watch at Law&Crime.

@cathyrusson

Lunch until 1:40pm. We know we had tech difficulties just prior to court adjourning for lunch. We're working on it during the lunch break.
