Judge Whitaker is handling the directed verdict motions from both defendants first before continuing with jury charges.
Doug Weinstein, attorney for Deamonte Kendrick, said they are moving for a directed verdict in all counts against Kendrick.
Weinstein argues that the overt acts before May 10, 2017 should not come in.
He is asking for a directed verdict on all the over acts in the indictment before May 10, 2017.
"I do not believe that they have presented to this jury any form of an overarching conspiracy that would tie those acts together," Weinstein said.
Max Schardt, attorney for Shannon Stillwell, is now up arguing for directed verdict for all counts against his client.
Schardt makes the same argument that any of the overt act before May 10, 2017 can't be used.
Whitaker said she is not convinced that the over acts before May 10, 2017 shouldn't be presented to the jury.
Schardt said he does not belief there is sufficient evidence that would authorize a rational juror to come back with a guilty verdict against Stillwell relating to the Shymel Drinks murder charge.
