GA - Suspicion over heat death of Cooper, 22 mo., Cobb County, June 2014, #9

For me, I could not accept the googling of death in hot cars as a coincidence. To me, that is insanely incriminating on its own.

I needed a little more of a push. I got it today.

1. Pack bags and any extra money laying around the house.
2. Make sure passport is up to date.
3. Clean out the bank account.
4. Make sure to pack all non maxed out credit cards.
5. Search up non extradition countries.
6. Make reservation for the correct airline.
7. Tell Ross he can shove it and pay for this crime all on his own in a last minute phone call/note before heading to airport and/or boarding plane.

You mean that kind of "to do" list?

8. Hire prison hit man.

At one point I thought I saw him stifle a yawn, then he turned around and noticed the 3 deputies? Sheriff dept? Guys standing behind him...
He looked a little shocked...just a little.

I won't be popular for saying this but here goes.

I know someone just like her.

The woman I know has a really bad bad boy for a son and she acts like a crazy woman -- loses all sense of proportion and is in such deep denial that her precious little boy is a criminal. Truth is the woman I know has been an enabler for years. Oh yes fair to say beloved Momma's boy.

Oh yes the woman I know is a ''bright'' university degreed mom who has totally lost her marbles because her son is in prison.

I truly feel sorry for these women but they have had a reality issue for some time it seems. MOO

Oh you know one also? LOL....I know one as well. He is not old enough to be in prison yet......give him a couple years and there he will be.

HB 271 amends Title 16, relating to crimes and offenses, so as to create the offense of murder in the second degree, and provides for penalties. A person commits the offense of murder in the second degree when, in the commission of cruelty to children in the second degree, he or she causes the death of another human being irrespective of malice. A person convicted of the offense of murder in the second degree shall be punished by imprisonment for not less than ten nor more than 30 years.

Yes. Effective July 1 there is a second degree murder charge and it applies to child cruelty. I don't remember whether it applies to first degree and/or second, though. I think second, but I've had a cocktail

Is it retroactive? Where did you find this? I'd like to read the actual law if possible.

Not every forward-facing seat comes with a base. They must have put Cooper's old car seat back in the SUV so that he could be in a rear-facing seat. It would be so much harder to make it look like an accident in a forward-facing car seat.
And LH must have known all about it!

And THAT screen cap was not when the detective was on the stand talking about Cooper's death. THAT screen cap was when a defense witness was talking about Harris.

I didn't find it. Popsicle did. But I verified that it was in the Legislature and appears to have been passed. It's not "on the books yet," though. Or at least I couldn't find it on public lexis. Haven't tried Westlaw.

Georgia law on retroactivity appears to be somewhat complicated. I linked the most recent case in a post before the hearing. It was a sex with minors case involving an 18 year old named Genarlow Wilson. The law changed after he was convicted to make his crime a misdemeanor, iirc. In that case, though, the legislature specified that the change in law was NOT to be applied retroactively. Nonetheless, his punishment was ultimately found to be cruel and unusual.

Afaik, Georgia does not have a saving statute -- all laws apply prospectively only unless there's some really good reason why they don't. So, imo, the new law will not apply retroactively unless the legislature said it should, BUT a sentence of more than 30 years (and defo the DP) will be deemed unconstitutional. I have NOT been able to find the Leg. history of GA's new second degree murder statute.

Sorry if that doesn't make much common sense. I've had a week from hell and am SOOOOOO tired!

Yes! I know people are upset about what she said about the judge being a SOB for not granting bond, BUT my heart breaks for her. She was put through the ringer today. I can understand her misplaced anger. After all this is her child being accused of killing her grandchild. She had to hear for the first time her son wasn't the man he was pretending to be. That has to be so deeply devastating!

I completely agree. Years ago there was a horrific case that caused me to reflect - what's worse than having your child murdered? Having one of your children murder another one of your children. That's worse.

This is what happened today. She realized her son murdered her beautiful grandson.

I can't even imagine.

lol, he noticed the sheriffs....they were all for him. I swear one time I wondered if he was gazing around looking for the cameras.
