I reached out with her text to an attorney initially connected with case, asking for status update or opinion on possible ruling. I’ll let you know when there’s reply.

Thanks! Hopefully some update will turn up! :)

In RE: State v. Ryan Duke (22CR113 - Ben Hill County)
Judge Chasteen ruled on the July 13, 2023, hearing in March (I think) of 2024, denying Ryan Duke's plea in bar on the statute of limitations. On June 5, 2024, Ryan's attorneys filed notice with the Georgia Court of Appeals asking the Court to reverse the trial court's denial of the plea. Oral arguments were held on January 16, 2025. I will post the link to the video below along with a link to his Court of Appeals case information. Since Ryan's appeal was docketed for the August 2024 term, the Court's opinion will have to be handed down by March 14, 2025. Until then, we wait...

In RE: State v. Ryan Duke (2017CR027 - Irwin County)
While checking out the court calendar for the Tift Judicial Circuit, I noticed that there have been two hearings this year regarding a Motion filed by his attorneys for a new trial in Irwin County. I have not seen the Motion or any other pleadings filed in regards to this matter. They were both Zoom hearings and neither of them were televised. I will attach the hearing notices.

In RE: State v. Bo Dukes (17CR139)
Bo's attorney has also filed notice with the GA. Court of Appeals on June 5, 2024. Oral arguments were scheduled to be held in October 2024, but his case is not listed for October or the following months. Not sure what's going on since I can't see the briefs filed. The link to his Court of Appeals docket record is posted below.

Unfortunately, that is all I have for now......

@cathyrusson

Very interesting. No one has ever been convicted of Tara Grinstread's murder. "Judges throw out charges in Tara Grinstead case, finding DA brought charges too late.

Here's why" https://msn.com/en-us/crime/general/judges-throw-out-charges-in-tara-grinstead-case-finding-da-brought-charges-too-late-here-s-why/ar-AA1zXktm

I thought murder had no stature of limitations?

True. Except this appeared to be a procedural error. Whenever there's an action (partial Indictment) that triggers the judicial clock, it's more important to follow through on the arrest and dismiss your case without prejudice, where you legally clear the clock, and can start over anytime.

While Georgia law allows murder charges to move ahead at any time, there are a few exceptions. Prosecutors generally have four years to file charges once they have "probable cause" against a suspect, which Georgia law says is "more than a mere suspicion, but less than absolute certainty." They found there was enough evidence to establish "probable cause" that Ryan and Bo were involved in November 2005. That means the clock to bring charges ended November 2009, the judges ruled.

The men were re-indicted in 2017, causing the men to argue that prosecutors failed to bring charges in a timely manner. That, the men argued, violated their due process rights. IMO, this appears to me where the State failed.
