Hannah Payne, 24, (21 at the time of the killing) faces two counts of felony murder, three counts of possession of a weapon during a crime, and a count each of malice murder, aggravated assault, and false imprisonment.

Authorities have said that the alleged victim, Kenneth Herring, 62, had driven through a red light in his Dodge Dakota pickup truck, causing a minor crash with a semi on May 7, 2019. Testimony at a hearing stated that he stayed for 15 to 20 minutes.




A witness — a state corrections officer with medic training — saw the crash, and spoke to Herring, a detective told the court. Based on his training, this witness suggested that Herring was having a medical emergency — a diabetic shock or something of that nature. For example, Herring was disoriented, displayed red-orange eyes, and had walked around a truck several times.

Herring drove off after the witness advised him to sit back in his truck, according to testimony. This witness asked Payne, who had witnessed the crash, to get the fleeing vehicle’s tag. Payne called 911 and followed Herring in her car, caught up, and blocked him in with her Jeep even though the 911 operator told her to stay away because it was safer.

“He is drunk. I’m not,” Payne told dispatch before the fatal confrontation. “I’m sorry, but I’m here to tell you I’m not not going to follow him because he is going to cause an accident.”

That altercation, however, turned deadly. Payne told dispatch that the man pulled the trigger of her gun while it was in her hand.“Ma’am, he just pulled the trigger of my gun in my hand,” Payne said on audio.“Ma’am, you were not supposed to follow him,” said the dispatcher.

Authorities found no drugs or alcohol in Herring’s system. His wife has suggested he was suffering from a diabetic emergency and was driving to the hospital.Payne’s defense lawyer, Matthew Tucker, maintained she saw herself as a good Samaritan trying to help in apprehending a hit-and-run driver.

"Get out of the truck! Get the f*** out of the truck!" Payne could be heard shouting before a long silence on the line. She then gets back on the phone to say, "He shot himself with my gun."

Herring died at the hospital from a gunshot wound to the stomach.

Payne has been out on bond with conditions since her deadly encounter with Herring.

This defense attorney asks all kinds of completely irrelevant questions. I wish prosecution would object. This is the defense attorney who said he had a stroke last week?

Tortoise cat-eyes are evidently the new horn-rimmed, or else the prosecutor is trying to score points with the judge. I'm way behind the times. I just bought new glasses, and I'm kinda glad I wasn't in on this new trend.

The stories of what happened couldn't be farther apart. If the defense is right, she seems NG to me.

I’m having a little trouble understanding why she got out of her vehicle and approached the other driver - especially after being told by a 911 operator not to even continue following him. I get that she was concerned that he would have or cause another accident and while I disagree with her decision to block him in, I can still understand it. But getting out of her vehicle and approaching his goes a bit beyond my logic. If she had shot him because he got out of his vehicle and approached her in some threatening manner then I might be able to see self defense here even though I think she was wrong for blocking him in. I want to see the video the bystander took and I want to here her testify but for now it sure seems to me that she should have taken that deal they offered her.

She was on the phone with 911 when she approached his car. He grabbed her and assaulted her and she could not get away. She took out her gun and he grabbed it and it went off. Apparently there are audio recordings from 911, videos and photos which show part of this and she is bruised, scratched and the front of her shirt is torn open from top to bottom.

Could all be defense exaggerations. We shall see.

The defense says the deadly shooting was a result of a scuffle, where Payne’s shirt was ripped, her chest and face clawed. They claim the incident was a citizen’s arrest and Payne acted in self-defense.

Iirc, it will be interesting to hear the 911 call and also, curious if they checked Mr. Herring's nails since there are claims of face claws. moo

TBH, I'm not sure he's 100% after his stroke.

Even if that's exactly what happened, she is 100% guilty of murder, IMO. She should not have followed him, should not have gotten out of her car. If anything, the deceased could have claimed self defense for the assault had he not died. If he really was in diabetic shock, she has no earthly business preventing him from getting to the hospital. She is not trained to keep a person at the scene for medical care, particularly someone in an acute medical crisis. Life without parole, IMO, regardless of whether or not what the defense says is true. Vigilantism can't be excused, IMO.
