No, but he will in all probability walk free from this hearing. I'm pretty sure he's toast anyway. Nobody respectable is going to touch him with a long pole from now on, but yes, there is a possibility he could get this brought down to a more manageable negligent homicide charge and a suspended sentence.

It all depends what comes out when the blindfolds come off and we play for real (emphasising that what has happened so far is basically a very public sideshow).
oh yes, i have no doubt he will be home latest tomorrow!

14:58 - Nair questioning whether Roux adequately dealt with the allegation of threats of violence made by the accused.

14:57 - Nair: Pistorius had an assault charge laid against him previously. Roux: A false charge.

14:56 - Karyn Maughan says Oscar Pistorius gives a deep sigh as Nair questions his alleged history of threatening behaviour.

Roux: of course when a person is killed, there are people who will be outraged...there will be a level of shock if he isn't released #oscar

Nair questions Roux on whether releasing #OscarPistorius on bail will evoke sense of outrage in the community. Roux: it depends

14:55 - Nair: There is evidence Pistorius threatened to break legs; discharged weapon; swore at someone: charge laid against [him] by his ex.

14:53 - Roux admits he didn't ask Pistorius about his alleged accidental discharge of gun in restaurant - and asking friend to take fall.

14:52 - Roux: It would be a "terrible injustice" to use vague, hearsay allegation about the restaurant incident against Pistorius.

14:51 - Nair: There is evidence in this bail application that Oscar Pistorius asked a friend to take the fall for accidental gunshot fired in restaurant.

14:51 - Nair: If established [that Oscar Pistorius would interfere with witnesses] should he be released on bail? Refers to Tasha’s [restaurant] incident.

14:49 - Magistrate says one of the grounds against bail is the possibility the accused could influence witnesses.

14:59 - Phillip de Wet points out that the law deals with whether somebody out on bail is likely to intimidate witnesses or commit a crime.

14:58 - Pistorius looks incredibly tired. His eyes seem closed, says Alex Crawford.

now i'm wondering if this could go either way? re: Nair's ?s

I don't think he's going to get off scot free either. He admitted to shooting and killing someone, it's just a question of whether he knew who he was shooting at. Unfortunately, due to the farce of this 'investigation', we'll probably never know the complete truth.

I will say on the issue of journalism. I feel sad that people are able to make quick judgements based on tabloid-level 'facts' when the reality is usually very different. I know I've learned my lesson a long time ago to take anything that doesn't come from either LE or the state with a grain a salt, because often times we see that journalists will run with the first hint of something that may or may not be true, simply because it sells newspapers and generates clicks online. It's better copy to say that he bashed her head in with a cricket bat or that he shot her in the bedroom. That doesn't mean it's the truth though.

Roux put up a brilliant argument, think Nair just asked the questions he was supposed to. Lets see what the state throws at him now. Doubt this will be concluded today..in fact, its after 3pm already, court starts winding down at this time!

This is a ridiculous lie though. there were certainly less incriminating ways.

And you totally leap frogged over the most important detail IMO. She was in a bathroom with the door locked and a PHONE and she didn't call anyone? Forget about fearing he'd kill her, if he was that violently out of control why not call a friend?

It's too big of a gap for me.

His side has some major issues as well, but one thing I DO understand is that he was relying on his hearing in the blackened room. I am hearing impaired and hearing sounds is something that can really be confusing if you think the sound is coming from one place.

If he placed her via sound as on the bed, then he'd totally convinced his mind that she was on the bed. He may have even heard breathing or noises coming from her that were totally imagined.

Here's another detail btw that I considered. If she had gotten up to use the bathroom and fell asleep on the toilet, maybe leaned over with her face on her knees, and he shot her, the compact nature of her position and the 'relaxed" state of the body prior to shooting her would make her moving around less likely.

If she was sitting on the toilet (granted we only have his word) when he found her, than IMO this is kinda weird. Because if she was tensed up and terrified and then was shot in the head, chest and arm, her body would have jerked and collapsed.

The two phones were found in the bathroom on a shower mat. RS was locked in the toilet room. It appears she did not have access to either phone.

I really don't think he should get bail, but he will. I do think witnesses could be intimidated, I wouldn't rule anything out here. He's threatened people before and money talks.

Nel: "The uncontradicted, unchallenged evidence of the position of his cellphone and gun are the coup de gras for his case." Kill his case

15:21 - Nel: "The uncontradicted, unchallenged evidence of the position of his cellphone and gun are the coup de gras for his case." Kill his case.

15:20 - Nel says Oscar Pistorius may not have planned to show Reeva Steenkamp - but he planned to shoot somebody. Not in self-defence either.

Nel: "No court will ever accept that the applicant acted in self-defence."

15:19 - Nel: "I'm Oscar Pistorius, I'm a world-renowned athlete" is not showing special circumstances in terms of bail.
