Roux: state can't transfer intent to kill from burglar to Reeva. Has to stick to one version and argue that. Lots of legal jargon.

Roux says if he were prosecuting he'd argue for culpable homicide not murder.

Discussion about how long between shooting and #OscarPistorius telling someone "I thought it was burglar" - enough to plan coverup? Unclear

Roux: state case that #OscarPistorius meant to kill Reeva, not burglar. Court must deal with that charge.
 
11:40 - Roux referring to Nel: Sometimes it is very difficult to guard against what you really believe. It will come out.

Agreed. I also think he looks very angry when he is not having "alligator tears." The one site updating the 1st day also said he stared straight on at Botha when he came up for questioning (when Botha was saying he knows OP on a more personal level than just going to his house for domestic police calls), that made me wonder about issues with witnesses.

Roux: on going to open front door. Has to because security man he called is on way and wants to let him in. Nothing improbable.

Roux: prosecution acknowledging culpable homicide is "far cry" from premeditated murder in reference to bail conditions.

Therfore Botha may not have been objective.
 
srsly, Roux...if you do a flit, do you think you go through security control?
 
The same applies in Australia and it then comes off their sentence. Why would you let a suspected murderer go free? He could easily escape the country by road up to Egypt and across to Italy.

Did you read my post about Reeva saying in an interview a week before that he lied? That is very telling! Narcissists/sociopaths are very dangerous as they are not what they seem to be - charming one minute and violent the next. Real Dr Jeckyl and Mr Hyde characters and are the best liars.

Can't say I read the article in the same light. She seemed to be saying OTHERS - including the media - would make stuff up and ruin things. I wouldn't use that article as any kind of smoking gun.
 
Shouldn't the fact that he, y'know, killed someone be the reason not to give bail? They only seem concerned with flight risk.

Arguments over. Magistrate thanks both for professional manner. Nair says ruling at 2.30 pm

Roux: done more than enough to prove not flight risk. Magistrate: talking about "duck and dive" situation again if Oscar skips bail.

Roux: on flight risk - he cannot go unnoticed through airport security with prosthetic legs. Legs and stumps need constant attention too.

11:55 - Nair thanks Nel and Roux for their summations. "I'm now in the unenviable position," of having to decide... at 14:30.

11:54 - Roux correcting himself: Oscar Pistorius prostheses don't require maintenance every month, but often.

11:53 - Nair: Wouldn't it have made sense to put in [his] affidavit his stumps need medical attention and it will be hard in a "duck and dive" situation?

11:51 - Roux: All the factors are present to show that he's not a flight risk.
