Missed a little (and I can only be around for a little longer) . . ..

tremors and shaking . . . . Mr. Nurmi who first told you . . . . yes - made an effort to look @ it . . . . JA didn't bring it up initially but she answered questions . . .

3-8 cases per 100k people . . . . small number of people . . . to show amnesia is not mysterious doesn't happen frequently . . . . but people with transient global amnesia . .. .

dissociative amnesia occurs from something much more traumatic. . . . hypnosis is not typically done . . . infrequently asked to do hypnosis by LEO in NJ to help LEO better recollect circumstances around sooting . . . . Samuels is proficient in hypnosis . . . he has used it ins a 10 year old girl who was accused of shoting her mother. . . . . value is limited and in LEO hard to know if memory of event is confabulating (lying) . . . .

hypnosis is a valuable tool but in forensic techiniques it has limitations

other Doctors have differing opinion of JA

When other Dr's are looking @ making a diagnosis . . . are theyusing same criteria as you would use? yes . . . in the DSM? yes

criteria exists in DSM - likelihood Dr. with the same experience level would they come up with the same diagnosis
if they had same information, crime scene photos, intervews etc . . . . yes very confident they would make . . . .

therapy for over 35 years look @ to make these assesments . . .
consistency of reporting, ancillary information - spouse or family mebers , , , text messages or emails , conversations with significant peole in their lives form a pattern . . . . attribute a higher level of likelihood what they are telling yu is true . .. .
how do you know nothing overly negative was not written in her journals because nothing negative ever happened. . . . .
other things than speaking with JA to come up with diagnosis . . .I did

see how TA would treat JA . .. .

text message coming from JA . . . . .

do not text me anything . . . . .anything else matters all the crazy things you have done . . . no batter ho the truth is . . . . feel my wrath . . .

this threatening behavior?
can be
considered threatening by someone receiving it?
yes

incoming . . .it doesn't sound to me that is being dramatic

TA to JA - do not call back - sick of you playing . . . .

ruining another dayof his . . . . bitter feelings - sick of days ruind by her . . . genuine dislike for her - revenge . .. .

these things considered negative or mean . . . hurtful - sure

( I gotta go now folks!!!!! yes . . . . .Gonzaga just won!!!!!)

carry on!

I am told that Maricopa County Superior Court is getting more than 1,100 calls per month about Arias case, like asking to talk to the judge.

Clancy Talbot, friend of TA, on Nancy Grace talking about JA confronting her in the bathroom of a PPL event.

http://www.hlntv.com/video/2013/03/20/friend-travis-alexander-clancy-talbot-prosecution-witness-list

Also, from the bottom of the article:

Talbot went on to tell Grace of another incident where Arias’ possessiveness was on display. According to Talbot, Arias showed up to Alexander’s home uninvited and declared to a group of thirty people, including her, that she was Alexander’s girlfriend. Talbot revealed that Travis told the group, “no, she is not my girlfriend; we went on a couple of dates.” She went on to explain how Travis told Arias there was no room for her to stay at his home and “she ended up sleeping under his Christmas tree.”

We are back in the courtroom . Judge is not looking very hppy while she overseesthe courtroom and makes notes with a sharpie, judge speaks sternly to Dr. Samuels - tells him to please take the stand . . . he wheels in his case . . . . standing for the jury . . . JA wearing white v neck sweater top over black tank top. .. . Her har is parted to the side.

Judge asking any jurors see media, speak to them about the case . . . no hands . . .

JM continues

PDS scoring . . . exhibit #535 - raw data scores 15 and 33 . . this was created @ the time . . .there were 2 times actual calculating, once when he did original eval and second was when he re-calculated to recreate in preparation for court.

JM hands over exhibit #534 says 1/15/2010 . . or the second time . . . may have been up to six months later - he is not sure . . . recalculated one t review notes

#550 came first . . . have the scores
rescored it and came up with #535 . . . .

when he re-scored it he had raw data in front of him in order to re-score . . . . something was missing . . . what was missing? . . . original worksheet . .. . #534? it is identfied

the raw data . . . .
part 1 question #1 - answer yes circled for yes

what you are holding in your hand . . . .I didn't have it in my hand . . . exhibit #550 in your hand? . . . let me see - there are 2 forms connected to this

#534 and #550 in your hands - I had part of those exhibits in my hands. . . . Idon't know that I had either one of those in my hands . . . I had the score sheet I used to transfer over . . .

the dots that is not what is used?
yes that is part of the exhibit you gave me - I had that but not the 2nd part
#550

if you have #534 how hard is it to take the sheet with the little round circles . . . isn't that all you need for #535? yes
what is missing

the original worksheet - that is not it that is the answer sheet . . .

you have 2 exhibits there stapled together - there fore I cannot talk about one without the other .. . 1st pg, 2nd pg, 3rd pg with the dots . . . then there is an ABC portion of it. . .

#535 ABC - next page is DEF . . . there is nothing else left

you have 2 separate documents stapled together with one number . . . I can't talk about it without talking about the other

didn't have the 4th page . .. . didn't have the previous scoring . . .. able to find first 3 pages?
yes . . . because you couldn't find the original scoring . . . .

I didn't take the orginal scoring with me on a trip = left it on my desk - I had 2 blank score sheets so I rescored it . . .

on a whim you decided to rescore it? not a whim . . . I re-scored it and I am entitled to do that . . . . somehow when you picked up my pile of papers you also picked up a piece of papers that I had not disclosed.

it was picked up and entered into evidence

what is the necessity . . . when did you rescore .aand did you doubt yourself/
3 or 4 month later - palm springs . . . didn't doubt self . . .I can rescore it 10 times if I want to . . . I was on a weekend vacation I always take my files in case I have some down time to work on it. . . .

just as I was workingon this . . . I had no plan to have this be disclosed . . . doesn't change my diagnosis of PTsd. . .

rescore it later one - number of symptoms is 15 . . . . ..the first one is 17 . . . . both o them are not correct . . . . get another number

first time got a score of 17

the numbers are not important and they do not match . . .
you had everything you needed to score it. . . when first sat down . . . scored it - not in a rush . . . .got score 17, then later you were on vacation and rescored it and got a 15 . . .

didn't have all the data right?
no i had all the data . . . .I didn't have the original score s heet . . . I wanted to make sure the DSM criteria was met and it was

scored this now 3 times . . . . after scoring 3 times you are a little bit sloppy . . . i made an arithmetical error . . . each time I scored it JA met or exceeded the diagnostic criteria for the DSM . . . . I didn't include the scores . . . . it confirmed presence of PTsd . . . . the first level of scoring were identical in all 3 numbers . . . .

in 35 years of scoring and this is what we get . . . . first 17, then 15 and today we get 16 . . .

MCMI 3 - #541 - print out after computer actual scored it . . . sir did you actually re-score this one too?
no (objection - overruled)

let me show you something . . . . take a look @ exhibit # 553 - recognize it?
this is not my print out . . . this is someone else's print out . . . it has a date on top that mine doesn't have

I don't believe this is mine . . .

approach . . .

  • #1,078
samuels - the scoring company changed the protocol . . . . .

how come the date magically appears?
I honestly don't know . . .I cannot account for one having a date and another having a date..

Post Traumatic stress d/o - . . . . numbers do not change your diagnosis . . ..

sir follow along I am reading . . . . indicates example D must have 2 or more of the following . . .under C - three or more . . . . your print out of DSM-4 diagnostic criteria of PTsd
yes

that is what you based your diagnosis of PTsd - move for admission of #545? . . .
approach

Twin sisters appear to be chatting with each other . . . . . . JA looks like a pillar of salt . . . . not moving . . .

finding of PTsd . . . . requires 2 or more of the 5 factors set out there . . . yes there are 3 . . I am not asking you that . .. I know you want to jump the gun but I haven't ask yet

D-3 . . . these factors have to be present after the traumatic event that is why we call it PTsd . . . Post trauma. . . . cannot be counted if the were present before the trauma. . .

that is not true . . . well it is irrelevant as they were there when I evaluated her.

difficulty falling or staying asleep . . . . she did not manifest that . . . no . that is a NO

D2 - irritability or outbursts of anger - yes . . . . you indicated . . . that one she met because she was fighting with her mother right? yes - you reviewed the corroborating data . . . that had been present since her teen years? . . . not to the degree that it manifested . . . objection

fighting with her mother was present from her teen years. . . . yes it was lesser degree . . . .

look @ 3 exhibits and let's see what that degree i . . . .

may we approach?

Defense heads up to the bench . . . wondering what is up JM's sleeve (IMO)

  • #1,079
Look @ exhibit #554 read highlighted portion . . . ok . . . JA has said . . no read to yourself

exhibit #555 - read highlighted portion - familiar with that
exhibit #556 - look @ this first #476 on the right the number - something in the journals - read in the journals - yes

same exhibit #480 pg 480 on the right . . you read that and you are familiar with that (yes)
this is what you used when evaluating what this defendant used on the telephone with her Mother - right

You said you wanted to approach Judge
Allright lets approach

Judge looking thru documents . . . .

JM is answering questions to the Judge
