Yeah, but Markley was in cahoots with Truslow during the hearing when Livesay screwed up. He was basically laughing at Livesay because she couldn't see that what just happened today would happen. I'm royally pissed.

Truslow objects, saying the phone calls aside from the pay phone calls are irrelevant based on the indictment. Judge rules they're not.

But Judge Dennis does warn solicitor that he will not allow this line of questioning to go much further

About 50 minutes after the pay phone called her she tried to text it, Sgt. Martin says

Sgt. Martin is now explaining the records for Sidney Moorer's phone.

Sgt. Martin explains that missing persons investigations are common, but different leads can be very time consuming to track down

Sgt. Martin is now being questioned by defense attorney Kirk Truslow. Truslow asks what changed about follow up based on Moorer's statements.

Truslow is questioning Sgt. Martin about how Moorer lying about using the phone phone changed the investigation

Martin says a call at 3:41 from Elvis was the last time her phone was ever used

Martin confirms the person making the phone call from the pay phone was Sidney Moorer.

Now looking at text message information from Heather Elvis' phone

The evidence shows outgoing text messages showing Heather attempting to text the pay phone starting at 2:21 am.

After her last text message at 2:42, she starts calling the pay phone. All phone calls after that are to the pay phone and Moorer.

Martin says they also got phone records for Moorer. Those are now being presented to the court.

So... what have we learned today? That was frustrating trying to follow online.

I was listening, but couldn't watch, and it was hard to follow. I learned that these obstruction charges are a HUGE deal, knowing there will someday be another trial for the kidnapping. I guess I originally just wanted him charged with "something". The defense sounded desperate IMO.

Not that it matters for this particular Obstruction case, but I'm rethinking the timeline and putting way more focus on the possibility that HE was never at Peachtree and that the later calls from HE's phone were not made by HE. She called that payphone 9 times in a row and even attempted to text it before calling it, so Sid did not tell her he was calling from a payphone. Having a little trouble thinking that she made the later calls.

Oh, and the Moorers continue in the running for Worst Parents Ever!

Sgt. Danny Furr with the Horry County PD was the first officer called to the stand. He was involved in the initial investigation for the Heather Elvis missing person case.
Furr testified that Moorer originally told him he had not talked to Heather Elvis in weeks, but later changed his answer and said he had called her the night before. He said that, had he known that Moorer called her from a pay phone the night she was last heard from, the investigation would have gone differently.

Sgt. Jonathan Martin also testified that Moorer's lie about calling Elvis from a pay phone hurt the investigation. He said that had they known it earlier they would have been able to question different witnesses and they could have pulled other records earlier.

But, Moorer's attorney Kirk Truslow argued that the investigation was not hindered at all by Moorer's lie about using the pay phone, noting that Moorer quickly admitted to using the pay phone and the police quickly got his phone records as well.

Moorer's other attorney James Galmore also pointed out that Moorer answered all of the officer's questions voluntarily.

Testimony wrapped up for the day at around 5:30 p.m. and the eleven men and three women chosen to sit on the jury were asked to return by 9:30 a.m. Tuesday morning.

OPENING STATEMENTS Recap from WBTW:

In the opening statements, prosecutors said Sidney held up the investigation at a crucial time.

“His dishonesty, his deceit, led investigators down one path, then they had to follow up on the story he told. You’ll hear it. Doesn’t make sense. Why wouldn’t he just be honest when he was last person to talk to her twice? Once with a payphone. Why? So that law enforcement wouldn’t find Heather Elvis,” said assistant solicitor Josh Holford.

Sidney’s attorney did say Sidney lied, but said he told the truth within a few seconds. Sidney’s attorneys repeatedly asked how a ten second lie really affected the overall investigation. “He’s accused of false statement that impeded investigation. You knew the lie was a lie for 10 seconds. How did that impede you?” asked defense attorney Kirk Truslow.

Prosecutors maintain they had to question everything about Sidney after they learned he lied.

“The first couple of days, 24, 48, 72 hours of an investigation, is the most crucial time. What could law enforcement have done if they had the correct information early on? What direction would law enforcement have gone if the defendant had been honest early on,” asked solicitor Josh Holford.
