I know this is the Obstruction trial but is there anyone who thinks TM and her sister are the ones that killed Heather? And her dad helped hide the body? The dogs hit on a scent at a construction site.

The rest of the Tweets for the day from https://twitter.com/taylor_herlong, we left off with the phone calls:

State calls Sgt. Jonathan Martin to the stand. He helped look through phone records of Moorer & Elvis.

Martin looking back at the phone calls to and from Heather's phone from 1:00 am to 3:40 am.

Says there was an incoming phone call to Elvis from a payphone and then multiple calls back to that pay phone from Elvis.

Now looking at several calls Elvis made to Moorer around 3am. Several short phone calls.

Truslow has an objection and Judge has asked jurors to leave the room. Truslow says the additional phone calls aside from the pay phone calls are irrelevant. Judge argues they're not. Bringing jurors back in now

Martin says a call at 3:41 from Elvis was the last time her phone was ever used.

Martin confirms the person making the phone call from the pay phone was Sidney Moorer.

Now looking at text message information from Heather Elvis' phone

The evidence shows outgoing text messages showing Heather attempting to text the pay phone starting at 2:21 am.

After her last text message at 2:42, she starts calling the pay phone. All phone calls after that are to the pay phone and Moorer.

Martin says they also got phone records for Moorer. Those are now being presented to the court.

The judge says we will recess for today.

I don't think her sister had anything to do with it, except for knowledge after the fact. But, I do think her dad helped hide the body. I think the guilt of that killed him.

Continued tweets regarding Sgt. Jonathan Martin and another witness from https://twitter.com/kaitlinstansell:

Martin said he also obtained phone records for Sidney Moorer in regards to this case.

The witness said he interviewed Moorer after 3 p.m. on Dec. 20, 2013. The defendant came in on his own and there was not an arrest warrant at the time.

According to the witness, Moorer denied seeing Elvis prior to November of 2013.

There are no further questions from the prosecution. The defense is now cross examining Martin.

When he was asked when the last time he’d talked to Elvis, Moorer said it was a couple of days ago. “We had no clue about the pay phone until we began investigating it,” Martin said.

According to the witness, when Moorer was initially asked if he called Elvis on a pay phone, he replied, “Nope. They still have pay phones?”

“A single lie can make the entire statement be questioned,” Martin said in reference to Moorer's alleged lie about the pay phone.

There are no further questions and the witness is excused.

The next witness is Amanda Nigro, landline service provider with Frontier Communications.

Nigro testified that she has records for the pay phone.

According to the witness, the pay phone was located at 1929 Mr. Joe White Ave. in Myrtle Beach. A pay phone call was made on Dec. 18, 2013 at 1:33 a.m. It lasted almost five minutes.

There are no further questions and the witness is excused.

more details:

Sgt. Jonathan Martin told Moorer’s attorney that Moorer briefly told police he didn’t use a 10th Avenue gas station payphone, but then quickly changed his answer.

Moorer had already spoken with police in regards to Elvis’ Dec. 18, 2013 disappearance, but when he spoke with Martin and other detectives on Dec. 20, 2013, he was briefly dishonest with them about contacting her.

By that point in the investigation, detectives had obtained Elvis’ cellphone records showing she spoke with someone at a payphone before vanishing that night, and detectives had gotten surveillance video of the payphone, but Martin testified they didn’t know for certain Moorer was the one who used it until he corrected himself in the lie.

“And at that point, he goes OK, maybe I made a payphone call,” Martin said Moorer told police. Martin said Moorer said this after police told him they had records and video surveillance of a call.

Kirk Truslow, Moorer’s attorney, questioned Martin on the time between the statement and correction.

“How much time had lapsed in between that?” Truslow asked him.

“10, 15 seconds,” Martin said.

“Ten or 15 seconds … How were you impeded in 10 seconds by that, or obstructed?”

Martin said that information would have been useful to police if he had told officers that initially.

“The lie was only a lie for about 10 seconds,” Truslow said. “How did that impede your investigation?”

“It’s still a lie,” Martin said.

“I know, and it’s bad to lie, but he’s charged with a crime called obstruction of justice,” Truslow said and went on to question whether making a statement and quickly correcting it was obstructing justice.

Martin said the payphone wasn’t the only thing Moorer was dishonest about during the beginning stages of the investigation, and said if he had told the first officers who contacted him about Elvis’ disappearance that he spoke with her from a payphone, the police would have taken different steps in the investigation, like trying to interview witnesses at the gas station.

Truslow also asked Martin about Moorer identifying himself for police and argued police were helped by Moorer telling them it was him on the video footage.

I agree with this & think her sister knew and/or helped during or after I'm undecided on that but IMO she was killed at LB by TM after planning to meet SM there. I'm still even today undecided on his involvement bc I partially believe that he intended to meet her that night but TM intercepted. That in no way excuses his actions since that night but I think he's too chicken s*** to kill. I think TM is and has always been the aggressor in the relationship with backboneless SM letting her control everything. JMO which is always changing with these people. I also think daddy C knew and helped in some way or form.

Sorry for typos and runons, I'm on my phone.

Marking my place. Thanks all

I

Not that it matters for this particular Obstruction case, but I'm rethinking the timeline and putting way more focus on the possibility that HE was never at Peachtree and that the later calls from HE's phone were not made by HE. She called that payphone 9 times in a row and even attempted to text it before calling it, so Sid did not tell her he was calling from a payphone. Having a little trouble thinking that she made the later calls.

I agree.

Question - Did we already know about Heather trying to text the pay phone, and I just forgot?

It breaks my heart thinking about her texting that payphone, trying to get a hold of him.

I've always thought that too. Do you think mama polly knows the truth?

So then who made all the calls to Sid? TM seeing if he would respond to Heather's calls? How would she have known they were meeting at LB and intercepted Heather?

  • #198
Absolutely.

I have to say, I love my kids with all my heart and soul. But I could never lie if I knew they killed someone. I remember the bs PC spewed to reporters early on, it was pretty clear she was being untruthful. Nooo, my kids never left the house that night ...

My son as a teen put me in a pretty tough spot, he told a CHP a lie. When I was asked about that lie, I couldn't do it, I told the truth.

I'm still wondering about Sid's family. Such a contrast to the C's, never heard so much as a peep from them. Matter of fact, have they ever been in court?

I actually wrote up a long scenario of how it could have happened, but it involved the group of teenage boys who posted an ominous FB message that night. I'll see if I can find it tomorrow but my scenario involves more than just TM and SM to pull it off.

This was the first I heard about texting the payphone. Poor Heather :(
