I personally believe him, but this photo issue reminds me of the supposed video in the Holly Bobo case. Another situation where someone peripheral to the case claimed they saw deeply incriminating images on a phone but the evidence was never recovered.

A perfect analogy of a trial is described as a "Tennis Match".

Sometimes its 30-Love and looks like things are going well for one side, and then all of a sudden its 30-15 and other side starts doing well.

Sgt. Michael Kathman with HCPD said he was asked to see how many times Heather Elvis was reported missing. The answer: 1. Asked to see if there are any harassment claims against Tammy or Sidney Moorer. He said he didn't find any.

I caught that and it admittedly broke my heart. I do believe he's just trying to do the right thing at this point. I believe him.

Defense's point on cross examination is someone who is missing, but not reported to police, is still missing. Also police don't always write up a report (for harassment) -- sometimes things can get resolved just by having a discussion.

Casey Brown for defense just brought up the fact that a reporter was arrested for trespassing on the Moorer property. He gets witness to agree that trespassing can be a form of harassment. Mr. Brown gets witness to agree that record should have been found in the system. Witness says he didn't see it.

ETA: Defense suggesting similarly a second missing persons report for Heather Elvis could have been missed in the system. Defense briefly mentioned the phone record from July (the note).

I think Demarino was also taking somewhat of a risk by incurring the wrath of TM against him and his family. She won't forget or forgive this, ever. She may not do him bodily harm but she can definitely make his life more difficult if she ends up free and looking for payback after having all her dirty business put on display.

But he previously said there was no report of harassment in 2013. The reporter was arrested after 2013 probably, right?

Agree. Donald said his mom "was" close with that side of the family. His testimony probably ruined all of that because of his "betrayal" so he was probably trying to backtrack .

I believe he saw the photo.

I've lied to my grandma to protect her from things I witnessed to preserve her memory of my dad or be ause I was just plain uncomfortable about it at the time. Obviously nothing to this extent but yah. I still think the state has enough without his testimony. But also if the jury's stomach felt anything like mine when they heard what he saw they won't be forgetting about it anytime soon.
