Agreed, however it depends on how the law is written. The judge may have an opinion either way but must follow the written law. Laws are written to protect the defendants rights. Sometimes too much. Some laws have room for interpretation, others are clear and cut. Keeping in mind that it has been suggested his story has changed a few times, we still don't know verbatim what he said to the detective that is trying to be suppressed... for example, even if SC said to the detective that Nala did not go on the trip at all, or Nala came back in his car, it would, as Det Loo said, be curious but would simply not be enough to read SC his rights and arrest him. Having said that, I have no idea how the law is written in this situation and am praying this motion is not granted.
What really would have prompted miranda rights? Other then him saying I did it, the det. had nothing to arrest him for.
It seemed to me that everyone in the courtroom knew the game the Defense attorney was playing and were allowing him to do so within the constraints of the law but not beyond the prosecutors many objections. It was quite obvious and made Apo look like a real character, but yet...his job of tangling the truth and trying to discredit Loo or say he was biased by slipping in a contradiction was relentless.
Judge Cardoza seems to have a lot of experience in judging murder trials on Maui. By accident (sidebar click) I read an article the other day from 2010 and Cardoza was the judge in that case as well. Same courtroom in fact.
There was recently a guy that stabbed his gf's aunt (or his own aunt, news articles report both) this past January. He tried to set the house on fire to cover up the crime but no such luck. He was arrested, questioned AND RELEASED despite having cuts on his hands. In March, he stabs his own mother to death. He's currently awaiting trial on a 2nd degree murder charge. The manner in which he killed her was also described as "atrocious, cruel and especially heinous." His name is Keoni Vinuya Tomas, he's 25 y/o.
I bring up the Tomas case because Apo was insinuating that Dectective Loo jumped at the chance to interview SC because they thought they'd found a serial killer on Maui. I disagree. Females murdered on Maui by and large seem to be commited by a relative or close friend. These detectives knew it was imperative to follow MPD policy despite the whole ordeal being run-of-the-mill and it appears that Steven wasn't given any special attention or treated unfairly.
Is Charli's pregnancy the main or only motive being considered for her murder? Is there any chance/suspicion there might be anything else?
