Agreed, however it depends on how the law is written. The judge may have an opinion either way but must follow the written law. Laws are written to protect the defendants rights. Sometimes too much. Some laws have room for interpretation, others are clear and cut. Keeping in mind that it has been suggested his story has changed a few times, we still don't know verbatim what he said to the detective that is trying to be suppressed... for example, even if SC said to the detective that Nala did not go on the trip at all, or Nala came back in his car, it would, as Det Loo said, be curious but would simply not be enough to read SC his rights and arrest him. Having said that, I have no idea how the law is written in this situation and am praying this motion is not granted.
What really would have prompted miranda rights? Other then him saying I did it, the det. had nothing to arrest him for.

It seemed to me that everyone in the courtroom knew the game the Defense attorney was playing and were allowing him to do so within the constraints of the law but not beyond the prosecutors many objections. It was quite obvious and made Apo look like a real character, but yet...his job of tangling the truth and trying to discredit Loo or say he was biased by slipping in a contradiction was relentless.

I am hoping the judge is just letting it all play out so that there won't be grounds for appeal that defense wasn't allowed to fully argue its motion. I've sat through quite a few motion hearings, and so far in my experience the judge has always been very clear and has not let an attorney's stunts sway him. But I have not seen this judge. I hope he is sharp, no reason to think otherwise, as he already denied the Motion to Dismiss.

It was interesting that all of the prosecution's objections were sustained by the judge. I feel like this is going to be a long trial. Ironically, Lavoie was the guy SC was mistaken for when SC's neck got wrapped around an inmate's cane.

Judge Cardoza seems to have a lot of experience in judging murder trials on Maui. By accident (sidebar click) I read an article the other day from 2010 and Cardoza was the judge in that case as well. Same courtroom in fact.

There was recently a guy that stabbed his gf's aunt (or his own aunt, news articles report both) this past January. He tried to set the house on fire to cover up the crime but no such luck. He was arrested, questioned AND RELEASED despite having cuts on his hands. In March, he stabs his own mother to death. He's currently awaiting trial on a 2nd degree murder charge. The manner in which he killed her was also described as "atrocious, cruel and especially heinous." His name is Keoni Vinuya Tomas, he's 25 y/o.

I bring up the Tomas case because Apo was insinuating that Dectective Loo jumped at the chance to interview SC because they thought they'd found a serial killer on Maui. I disagree. Females murdered on Maui by and large seem to be commited by a relative or close friend. These detectives knew it was imperative to follow MPD policy despite the whole ordeal being run-of-the-mill and it appears that Steven wasn't given any special attention or treated unfairly.

I agree. It wasnt until her car was found that most folks suspected foul play. Who could have projected what was to come. It really was his interview with the newspaper that everybody went "Uh Oh!"

I think back to the actual evidence in this case and am reminded that both the burned car and the items at Paraquat's were what has propelled this case into one that has a chance at being solved and Justice done. These were discoveries made because Charlie was so loved and connected and her family and so many friends and strangers were tenacious (not to denigrate LE in any way, but sometimes in many ways, love, personal knowledge, hunches and dogged will win the day). Think where this case would be without them. No-one to discover Charlie's burnt car because no-one would have had the hunch to go down there to look...no-one to find the things that led to the homicide ruling and later, to the certainty by LE that SC was the perp...all because her peeps, determined to find their beloved Charli and Joshua, wouldn't give up on searching the place where her phone pinged, would not give up. It gives me confidence that we will see justice done.

The idea behind this might be that SC would have never come up with the "She followed me back to Haiku" story had he known this.

The law baffles me sometimes. Is LE required to tell people everything they know??
At that point I would think Loo was doing his job. Simply an interview trying to see if SC knew anything that could explain why she was MIA. He was the last person to see her! Did she tell SC that she was hiding out, did she tell him that she was going to run her car off the road to kill herself, did she tell him she bought a one way ticket to Timbuktu, did she tell him she couldn't afford the dog and was going to abandon it?
By law, was was Loo required to tell him anything??

I only know that if a poster is verified by the WS admin. or mods there is no need to link the information being given. Could be other benefits I'm not aware of.

Being verified worrys me. I dont know that I want it. I will curb my posts to not include information that cant be linked. I was in that Courtroom. Thursday. Got a pic on my phone. I rarely have Thursdays off but I did last week. It wont happen again. To show support of my community for the Scott's and to the Judge. I have no idea what happened to Charli and Joshua Scott. I wish I did. Its all surmised speculation on my part to be clear. I hope this qualify's as a link.

What does verified mean and how does it benefit the poster?

It means that the Owner/ Admin. have verified your identity. It allows the poster to share information not available from media sources without having to post links or hedge around with "IMHO"s. And it prevents that person from having their posts removed from the board by the moderators. If an unverified inside source, such as a family member or close friend were to post information known only to them without becoming verified, the moderators would remove the post according to their terms of service. It also helps everyone on the board separate facts from opinions.
