I totally get the concern about a later discovered hair.

The reason they start with the in-state lab would appear to be cost. Each outside testing has to be an approved expense as it is paid out of taxpayer money. The blood sample was too degraded for standard DNA testing, but they had to try that first. It turns out that it was too degraded for the advanced testing as well.

I don't think we have enough information yet to know why they didn't find the hair. Procedures in Hawaii across the board are often less thorough than on the mainland, so no amount of slop really surprises me at this point.

I do think that the defense will or would file a motion to suppress the DNA of the hair if they see any way to cast suspicion on its being found after it returned to them from the lab. If they do not try to suppress it, then the defense must accept its validity as far as how it was collected.

so far, they are objecting to it on the basis of late receipt of the lab testing only. Now is their chance to argue that the hair may have been planted, so let's see if they go that way when the hearing occurs.

I understand everything you're saying, I do. I'm more so playing devil's advocate. In this day and age people expect that forensic testing is thorough. As in the opposite of the OJ trial were it meant nothing to them as it wasn't mainstream yet. I'm afraid jurors will look at this side eyed, like us on here, unless there is a great explanation.

If appropriate, please let the family know we're still here supporting.

Defendant's family (party of three) just arrived, in good spirits, commenting on how he lost 4 lbs with the haircut.

So he has family there?

Hon. Judge Cardoza just read off the list of witnesses, very lengthy. Trial is expected to last 2-3 months ending late July, early August 2016.

So you're back in the courtroom or can you hear what's going on inside?

That's an unusually long trial.

Charges just read off, SC looked down at the table the whole time.

Back in the courtroom. Attorneys are about to present mini opening statements.

Please God let this be a slam dunk.

loio, thank you for remembering us.

The defense made some argumentative statements that were sustained by Cardoza. Defense is attempting to discount the MPD by claiming SC was naive and too trusting with Det Loo. Prosecution made a brief and grim statement regarding Charli being 5 months pregnant and excited with her prospects. Her jawbone was found split in half, 6 ft apart along with clumps of her red hair, the fingertips of her right hand and her tattered clothing.

SC is turned around in his chair, looking at jurors.

oh oh geez. Details we waited for, for so long and now I am just heartbroken. I can't fathom someone doing that so to hear this is gut wrenching.
I guess I was naive on what we would hear...

The court is at recess at this time. Doubtful they will be back in session this afternoon given that the judge will be hearing drug offense cases at 1pm, after lunch.

The jurors were seated numerically and one by one taken back to determine their final eligibility. What's remarkable is when the judge asked the jurors if they had heard of the case, they all raised their hands, save for one young guy. The majority of the jurors groaned at the mention of 10+ weeks of trial.

The schedule is as follows, Monday, Tuesday, Wednesday, Friday court will be in session 9am to 4:15pm. This case will not be tried on Thursdays. The week of June 6th, 2016, court will be in recess.

Was today the first day of jury selection, Loio? If so it seems there was no problem finding jurors which I find hard to fathom. It only took about 4 hours?
Whoa! FingerTips or fingernails?
Many thanks for being our eyes and ears.

Cardoza said jury selection marks the beginning of the trial. And the prosecution's Rivera said it was Charli's fingertips that they found. I'm going to compile a list of witnesses later on. Kimberlyn S and her daughters Brooke, Fiona and Phaedra are all on the witness list.

There were no friends or family present for Charli except me. I was very transparent with everyone to let them know I was there to watch as a spectator. The jury was admonished not to use the internet or any of the legal websites (ahem Websleuths) to research the case.

Loio, any hint as the the order witnesses would appearing? Just wondering Kim, etc. will be able to sit in on the proceedings at all.
Fingertips!

Again, thanks for sharing the observations with us.

This is going to be a tough trial to sit through for everyone in the courtroom. The defense's plan of attack is to besmirch MPD and their investigation but as of their "mini opening statement" today, doesn't plan on establishing an alibi for SC on the evening of February 9, 2014. The State has an even harder job of establishing SC's motives, statements and demeanor as that of a murderer. This is why the pants are crucial to the case. The State needs to put SC in Honomanu with Charli's partial remains despite his own admission that he was out there fixing his truck.

Seems like SC established his own alibi during the interview with the reporter. Can you elaborate on the defense's not intending to establish an alibi?

I forgot to add something important, the defense opened up insinuating that Mo and Charli's disappearances were related.

  • #1,099
Loio, will you be able to be at all or most of the court proceedings? Your input is so valuable.

Fingertips? Wow that answers my questions about how they found her fingernails. I think several of us have mentioned how something scared him off or made him rush. If the jawbone was in 2 pieces 6ft apart it sounds like he was dropping things. Headed to the water? I can't wait to hear what Nala's role was. Remember how he posted that pic of a 23 week fetus being cut from the womb on his Facebook? It was in April '14.
