Unless someone knew someone. Before what I just wrote is poo pooed, consider who their lawyer is?

Nothing has changed on casenet since they got a lawyer. Everything is the same as it was the very first week when I, and many others here, looked it up in the first couple of days. This has absolutely nothing to do with who anybody's lawyer is. She doesn't have a lawyer on record listed then or now for that case.

There were two tickets issued by Missouri Highway Patrol during one traffic stop.

Technically in Missouri, when MHP cites you during a traffic stop you are "arrested."

But it's a far cry from a DUI or DWI. Like I said....full moon

Thanks DeAnn. I should also add that she was charged with 301.020 which is failure to register a motor vehicle. That would be the other ticket.

They do not arrest you for driving without insurance. DB was ARRESTED.

But she was arrested for failure to appear for this case.

I have a feeling that no matter what we say we aren't going to convince each other (is it a full moon tonight?) but if you look you can see she clearly didn't get a year's probation because she was cited Jan. 7, 2009, and it was imposed Feb. 19, 2009, to start and it lists Aug. 3, 2009, as completed before probation revoked. That's not a year. I know what the record says....but this was a state case, not a municipal case so it's handled differently in Missouri.

She was arraigned on 1/15/2009. Her probation was not completed on 08/03/2009. It was suspended. If her probation was completed how could have they issued a warrant for violation? How could have they arrested her for that violation, which they did.

I am not sure why you are fixated on the word arrested.

But in Missouri if a state agency cites you for a misdemeanor you are arrested. Ticketed, arrested, it's THE SAME THING. So yes, you are arrested for driving without insurance if you are busted by the Missouri Highway Patrol or Jackson County Sheriff's Office as opposed to the Independence Police Department or Lee's Summit Police Department.

I tell you what....call the Missouri Highway Patrol in Lee's Summit right now and ask them.

yes. Look at the docket. It clearly shows that she didn't do something for her terms of probation and they made a court date for her side to be heard for the reason why she had a violation. She failed to show and an arrest warrant was then made. This is when it shows an arrest - for the failure to appear.

Because Missouri Highway Patrol, a state agency which means it falls under Missouri state law not a local city charter and thus city ordinance, pulled her over and asked for her license, registration and insurance card.

She had a license (or at least she wasn't cited for not having one so guess she has been licensed at some point in some state) but didn't have registration and proof of insurance.

She may not have been put in handcuffs. She may not have spent the night in the Lee's Summit Police Department. But when she was handed two traffic tickets for violating state law she was "arrested."

I specifically asked about probation and driving without tabs and insurance and was told, "No, someone would not get a one year probation for that. Well, if it was habitual maybe. Like if they had several of those the judge might do that, but not on the first offense."

This could also apply if she could not show proof that she ever had insurance, as in not just a lapse in coverage, but a blatant disregard for not having insurance. She might have very well ran her mouth with her known lack of filter and said something stupid like she never had insurance. This could have set a judge off. (Much like it could have been exactly the kind of thing that set LE off in the first place when they were called for the baby being missing - her lack of filter.)

BBM Especially if it was a dui/dwi with a failure to appear and probation violations attached! Independence MO is not known for lax sentencing, either. Especially Judge Bushur from what I have been told!

Correct. And the charges were 303.025 which is the financial responsibility charge. A misdemeanor charge.

That in no way implies that that is what she was arrested for. What was her arraignment for on 1/15/2009? They don't lock people up for driving without tabs and insurance in MO. She was locked up. . .and then arraigned, hearings were scheduled and probation was ordered. She violated the terms of her probation, a warrant was issued and she was arrested and bailed out.

The last entry says her bond was refunded on March 2. I don't think that would have occurred if she hadn't paid the $250 fine. I imagine she had to pay the $250 fine on March 1 before she could leave the courtroom.

I've been in Judge Bushur's courtroom (thankfully not as a defendant but as an observer) and he's pretty no nonsense. I also know someone who had a run in with him and he didn't spare any prisoners either.
