I don't believe it is discriminatory to question it. I do believe it is discriminatory to deny CR the job based on his race. Obviously, they hired him.
I don't think it should ever be a violation to question something that doesn't look right. Obviously, the applicant might feel harassed and discriminated against if he is being verbally questioned at every interview about the sound of his name and outright denied jobs based on the sound of his name. Of course you would want to interview them the same as everyone else and give them the benefit of the doubt, but before officially hiring them it may be prudent to use a more reputable service to check their ID or even run it through a 2nd service for peace of mind. All the applicant needs to know is that he has to pass a background check same as everyone else. That you used a cheaper service for your nephew whose background you already know, the applicant need not know. No harm. No foul. Honest worker gets a job. Disaster averted with dishonest worker.

A person who has held H-2A nonimmigrant status for a total of 3 years must depart and remain outside the United States for an uninterrupted period of 3 months before seeking readmission as an H-2A nonimmigrant.

Additionally, previous time spent in other H or L classifications counts toward total H-2A time.

It's still temporary work. Farmers need permanent workers, and workers need permanent work. So it's not a solution. From that link:

Right, IMO, if she was found clothed the warrant would say the fully clothed body or the body was found intact

And it's against federal law for a potential employer to ask a person their ethnicity or their immigration status.
I won't argue about ethnicity. That shouldn't matter. Don't they have to show docs that prove their right to work? Those documents prove their status more or less, provided they aren't forged or stolen. I would do a 2nd interview asking about things that came back on their background check. I would want to make sure that what they say about their history matches the report I received.

Yeah, but the people who hire illegal immigrants don't use E-Verify. As this case proves, even when they say they do.

I read an article that said the feds are considering requiring Social Security to notify the valid owner every time the number is used for employment purposes. Maybe I'm wrong and it is Congress that is considering making such notification a law.
they should definitely do this. it can't hurt.

When LE first went to the farm to interview CR, I wonder what name he gave them. If he did not give them his real name, it didn't take them long to figure out who he really is.
I am confused on where LE approached CR. I thought he was contacted at the farm but then read something today that made it sound like he was apprehended in Tama county. Did LE approach him twice or did I misunderstand

It's not BS. If you think that 84,000 US citizens are going to move to Iowa to live in a derelict trailer in the middle of a farm field, to milk cows for minimum wage, I've got a bridge somewhere to sell you.
Don't machines do the milking? There are plenty of family-owned dairies who have no problem hiring American farm workers and paying them a decent wage and benefits.

I don't even know if he was doing the milking. The farmer has crops too. They do not pay decent wages. But even if they did, it's very difficult work that most people would not want to do, unless the wages were really, really great.

Question.

The boss said he couldn’t question it because of discrimination issues. But what rights does an illegal worker have in that sense? Can they truly sue in the USA a potential employer, when they are trying to commit a crime? Like being hired under a fake name?

I don’t see how that is even an issue.
