GUILTY IA - Nohema Graber, 66, HS teacher, beaten to death by students, Fairfield, Nov 2021 *arrests

It's true that Miller's mother was with him at his school on the day of the murder where mother and son met with the victim a couple of hours before she was murdered, but I'm not aware Miller's mother lied to police and/or investigators. I do recall she testified at the pretrial hearing when the defense opposed Miller being tried as an adult and alleged police misrepresenting a juvenile waiver she signed after she could not locate her reading glasses when police served a search warrant at her residence. JMO

I was referring to the article you posted that I quoted. Here is the relevant part [bbm]. Maybe she didn't end up covering for him but she agreed to in the interrogation room IMO (makes me wonder if it was a long term pattern with them):

Video begins with Miller inside the police interview room with his back to camera, leaning back in his chair. Miller is talking to a woman who I believe is his mother but her head cut off in the video and the volume is very low. She's holding a purse in front of her and wearing a lavender jacket. Mom has her hand on the closed door as if holding it closed as Miller leans forward and says "I was with you the entire day." Mom replies "Yeah" and leaves the room, closing the door behind her. End of video.

IMO, there's something off about Goodale. While I truly believe this murder was initiated, planned, and motivated by Miller's deprived sense of entitlement, I'm troubled by how easy it appeared to me for Goodale to agree to help Miller carry out this horrific act.
Though not a psychologist, Father Malachi Martin once related that partnerships between evil people will include one individual being the dominate partner. That dominance can be slight or noticeable.

The two perpetrators in this case may reflect that trend. Both could be willfully evil (willingly agrees to carry out the attack), but one could also be slightly dominate over the other (conceived of the attack).

Thanks for your reply @Cryptic and I tend to agree. I'm looking forward to hearing from the expert witness at sentencing that may add some insight into the unknown about Goodale. The only thing I recall from the court proceedings is Goodale lived with and was raised by a single father and that he was not a student in the victim's class.

IMO, other than the prosecution acknowledging Goodale's cooperation by recommending a few years less punishment than Miller, I doubt they will offer much more at his sentencing because Miller is no doubt working on his appeal as I type this post. (I believe a defendant only has 30 days to file the appeal notice after sentencing).

During Miller's sentencing, his defense also did its best to insinuate the prosecution showed bias between the two defendants. The defense also wanted it known that besides Goodale being more popular in school, he was allegedly taller and heavier than Miller at the time of the murder. No doubt the Judge didn't mince his words about Miller trying to pin the murder solely on Goodale. MOO

Thanks, @LadyL. In any posts from the 7-hour sentencing, I was sharing my observation from the hearing and did not mean to imply the Mother lied to the police or attempted to cover for him. I apologize if my post was unclear.

Personally, I think she probably feared her son and was accustomed to agreeing with him to avoid both a scene or any confrontation. (We know what happened when his teacher said 'no' to him)! I think Miller is a psychopath and don't doubt some of the swings of his bat at Mrs. Graber were also swings at his own mother. MOO

He turns to his family and says "I'm planning to get back out there as soon as I can to make up for lost time." Like he is going to serve a short stint for a murder. It amazes me how detached he seems to be from his crime. MOO

There were a lot of 'sorrys' in his statement but he showed absolutely no emotion other than a slight, yet only slight, pause when he mentioned his own family. The rest of his statement came across as a PR statement. I'm sure his lawyer told him what to say.

But at least he came to his sentencing and apologized.

Yes, but it seems likely that he has no empathy whatsoever, which makes him a permanent risk to society, if true. He's scary.

Not this one. Miller would never stay behind in his cell and miss the opportunity to stand and flip around with his perfectly coiffed haircut, knowing all eyes and courtroom camera were on him. I also found his words hollow, and obviously meaningless to him. JMO

I didn't know they were your observations but you didn't imply anything - her response did. However, I do also think he's a psychopath. I wonder how many fires he's started, animals he's tortured, and little kids he's bullied or injured in his lifetime. Glad he's off the streets. Thank you for your astute observations of the interrogations.

I agree of course.

He seems to be a "perfect example" of a saying:

"Tread over dead bodies to achieve a goal"

Yes, Goodale has a hearing about this subject on July 17.

Goodale's sentencing is scheduled for August but a mental health expert expected to testify at sentencing is not available on the August date and the defense requested sentencing bumped to October. The prosecution opposed the defense's Motion to push out the date-- citing Mr. Graber's failing health and the possibility that he will not live to see October.
Prior to Mr. Graber's death, Goodale's defense was seeking to push his sentencing date to October to allow an expert to testify at his sentencing but now it's scheduled for two days in November, and the State is not opposing.

Parking this MSM from March 30, 2023 here as a reminder Goodale was going to testify for the State against Miller. After the expert witness testifies, this may/may not have bearing on his sentence.

For comparison, two WA teens, age 16, in a similar dynamic, murdered a defendant's mother's ex-boyfriend, and the second defendant came along as the helper in the crime/burglary.

Both entered plea agreements for 2nd degree murder and the standard range is 123-220 months in prison. Prosecutor recommends the low side for one defendant or 123 months. That's only 10 years and a few months for brutal homicide!

The two WA teens referenced above were both sentenced Friday to 12 years and 33 months probation for murdering the mother's former fiance. The motive remains a mystery and it was painful to hear the words of the victims mother who feels age was an advantage.
