Revisiting the #BryanKohberger alibi situation due to several questions asked. As per the attached law and the ruling set forth by Judge Judge in this case, BK had until yesterday to tender notice to the prosecution concerning an alibi. You can bet the court would have also been made aware of such information. Recall there was a motion filed by the defense asking for more time. While yes, the alibi would be submitted to the prosecution, the court would have been noticed as well. Throughout the attached reference, the court is mentioned several times in regard to overseeing/making rulings related to the submission of such an alibi. The defense, nor the prosecution, would keep the judge in the dark if BK submitted an alibi.

"Evidence corroborating Mr. Kohberger being at a location other than the King Road address will be disclosed pursuant to discovery and evidentiary rules as well as statutory requirements. It is anticipated this evidence may be offered by way of cross-examination of witnesses produced by the State as well as calling expert witnesses."

Attorneys for Bryan Kohberger, the man accused of killing four Idaho college students last year, are trying to get his indictment dismissed.

In a new court filing from July 25, but released on Thursday, Kohberger's attorneys are asking the judge to dismiss the indictment on the "grounds that the Grand Jury was misled as to the standard of proof required for an indictment."

Kohberger's legal team claimed earlier this week Kohberger was not at the location where the students were stabbed, but did not give any more details. His lawyers said he was preserving his right to remain silent on specifics.
