After reading Nate Eaton’s thorough tweets, sounds like Boyce has denied an extended date on this trial as much as Prior has tried for it, Chad has not looked at Lori, jury will not be sequestered, Archibald is really fighting the death penalty thing to the point of that Idaho hasn’t put anyone to death in so many years.

I think it’s somewhat foreboding that Judge denies continuance based on one side of Defense still not having documents from discovery process. It is even odder that one defense side has the materials but the other side does not, seems like prosecution loses any argument about needing time to prepare said materials if they’ve been disclosed to at least one party already.

Why is one side still waiting on documents? I know in other lands of the internet people think he’s just complaining to complain and is wasting time but IMHOO it’s a genuine concern if it’s legitimate and is still awaiting things - and continuing to say on record he’s not and will not be ready for trial without these things.
I know none of us here don’t have that answer and frankly that’s understandable.

State has to file any opposing motions 7 days before the hearing, which would have been January 12th, for the hearing on 19th. Sometimes they don't show up on the Portal for a few days. I'll be looking out for State's response to this, I can't see them agreeing to these sessions, even though it looks on the surface to be a step in the right direction.

The way I'm looking at it, which could be wrong - just because it's a joint trial and they're charged with conspiracy and a common plan, doesn't mean as individuals they defend the charges as a team. Yes they both want to know what the other is going to say but if they're planning on telling the truth they wouldn't need "strategy" sessions.

That's aside from the legal ramifications of their lawyers participating.

Another thing that's interesting is Scott Reisch and Lori Hellis haven't really batted an eyelid between them at this. SR said it will be interesting to see what the court says. LH (youtube live on Wednesday Jan 11th) seems to think "they" want to make an offer to the State. I just can't see what's stopping them doing that individually with their lawyers representing them. Their acts weren't done by one body and one head, their verdicts will be taken separately and mitigation and sentencing will be individual. This looks exactly like scheming.

I think Lori doesn't want to plead guilty to some aspect, to have Chad say at trial, 'she's pled guilty, it proves my defense of Lori and Alex did it'. I'm not sure Chad is ready to admit guilt or has made any overtures of the sort. I don't even think Lori is ready to admit full guilt, she wouldn't be giving an "alibi" if she was. I think she might say she's guilty of not reporting the children's deaths, Alex confessed to her on the day he died. Her personality has always been to demonize others, right back to her early marriages.

I say bring on the trial!

Do we know if it's the prosecution or the defense that's issued these subpoenas? I think subpoena duces tecum is a request for documents in the possession of the named individual to be produced, IIRC.

Coming from the point of view of an individual who does not think the death penalty and modern civilization go together-

(Yet who also believes the existing law is the existing law and if the worst punishment applies to anyone it should apply to serial killers of innocent victims)

Who would like to see the death penalty eradicated-

I don't see how JA's motion would apply unless he is able to connect one of the reasons it should be unconstitutional as discussed in his motion to Lori's specific case.

Edited to add: Just listened to some of the recording of the hearing. JA cited a study that concluded Idaho DP is unconstitutional because it is not narrowly defined enough as to whom it should apply.

My Holy Dog who does he think has been accused of worse crimes? In the case of his client there is virtually no mitigation. (Maybe narcissistic parents and a probable hx. of abuse. People survive that without murdering so many others, including children.)

Sure I hope death penalty is eradicated. But if his client did what it appears to me his client did (with co-conspirators), I sure don't want her name attached to that progress.
