Here's the motion the judge ruled on. It's possible that this was partly (or entirely) a penalty for late disclosure actions by the prosecution. That was one of the defense's points in the motion. It will be interesting to see the details when they emerge,

He stressed the “death is different” argument for trials that may hang (sorry) by issues of disclosure or other technicalities that could reverse a decision on appeal. This suggests he was letting the people — Represented by the jury — off the morality hook should they be concerned that the defendant were put to death, then were found innocent, as sometimes happens. Not that I believe Lori to be innocent, nor that any disclosure provided now by the prosecution would change my mind. I believe this gets us closer to conviction. It’s almost beside the point that I believe corporal punishment to be unconstitutional under the “cruel and unusual punishment“ test. I’m relieved by this decision.
