As this trial begins, if you go back and read threads from when the charges were filed, it's enlightening to compare what the prosecution and defense hoped to do, with what has happened.

Lori's defense was focused on keeping her from the death penalty. Their whole case and witness list was built with that mostly in mind. Still was until very recently, in fact.

Chad's defense was focused on getting the cases severed. They stated the unfair difficulty in distancing Chad from Lori and what she did, not him.

Now? I think the focus of Lori's defense will be mostly an attempt to lessen the sentence, perhaps by shifting blame on others, and less about trying to prove innocence. Or maybe to get her incarcerated in a prison for those with diminished capacity. It's still mostly about the punishment phase.

As for Chad, I expect his defense now will be to point at Alex and Lori, and claim he had no clue they would plot such things as they chased money. He will say imo the first murder(s) were way outside Chad's world (or geography), with Charles and maybe more -- and that when those didn't land the big money Lori/Alex expected, they just found new targets whose deaths would refashion their lives, working from a casual disregard for human life.
There won't be a penalty trial now but her mental illness will be a focus at sentencing, although Lori thinks she can convince a jury of innocence.

Vallow Daybell does not think her mental illness will factor into the trial at all however, because she is certain a jury will find her not guilty.

"Defendant believes that she will be acquitted of all charges and that the penalty phase will not be necessary," say her lawyers in their filing.

The defense team does say that they will present evidence of mental illness at that penalty phase should Vallow Daybell be found guilty by a jury.

Vallow Daybell's lawyers say that "would then be an appropriate time to present the mental illness evidence to the jury in consideration of the potential penalty."

Personally, I'm following Nate Eaton. He's posting a lot of stuff (which I appreciate). He and Justin Lum have done a great job reporting on this case for 3 years and I think they'll do a great job covering the trial

I'm also following Lori Hellis who is present in the court's overflow room and sometimes includes expert commentary in her tweets, like predictions about jurors being excluded.

So glad I am not in that mess being screened for jury duty. I imagine it is quite a daunting task.

Hmmm... I've never quite been a sketch artist fan. But, I guess it helps those who appreciate it.
In the UK we are still nearly entirely sketches. It's refreshing following USA trials and not having sketches for once usually

If there is an upside to not having cameras in the courtroom, it's that I don't have to actually see LVD's face. I honestly don't care if I see her smirk and saunter again. Just my opinion, of course.

Yes March. Didn't notice until you mentioned it. It's this headache I keep getting, haven't slept well over the weekend due to thinking thoughts. I'm not happy with the situation with Kay and Larry. He's not in very good health these days, poor man.

Apparently four potential jurors from the first batch didn't know anything about this case before. There are still people who don't follow the news.

A little explainer on the sketch artist:

12:58 p.m. When Judge Boyce banned cameras and refused to allow a live audio feed, EastIdahoNews.com and other media outlets hired a sketch artist to draw images inside the courtroom. She is not permitted in the courtroom during jury selection, so today she is drawing sketches being transmitted from a grainy webcam onto a screen in an overflow room. Here is an image she just completed showing Jim Archibald questioning jurors with prosecutors Rod Wood, Lindsey Blake and Rachel Smith observing.

1:45 p.m. Kay and Larry Woodcock are not here today but I’m told they will arrive later this week. None of Lori Daybell’s family members are here. Chad Daybell has no family here and Tammy Daybell’s family members are not here.

We are told another panel of jurors will be brought in for questioning. The court wants to reach 42 jurors before narrowing it down to the final 18

John Prior, Daybell's attorney seems to be getting in a tizzy with a prosecutor communication liaison... "I think it's inappropriate that you're here making comments to the media," she says.. "I've informed the judge." Prior: "Well you do that."

That makes me think the defense is going to claim Alex and Chad conspired to kill the children but they told Lori they were hidden away in a safe place.
