Thanks, that's interesting. Could Idaho charge him, then? Or does that make it a Federal crime?
IIRC, LH also stated that federal or Idaho charges were unlikely.

Anyone think we'll be able to see anything?

  • #946
When is the deadline?

  • #947
Scott Reisch doesn't believe Lori is malingering, because professional would be able to pick up on it much sooner than in six months. We'll know that her competency has been restored if she returns to jail in the next few days.

IMO I am leaning towards mental ill health. I have very limited knowledge of metal illnesses though. I did note she stated she no longer needed to eat and I have heard it reported she demanded a room to dance in. IMO sounds like mania. IMO the state is not going to throw the jail doors open for her if it is found she has mental health issues. Purely speculation on my behalf. If she is found guilty of the crimes a forensic mental health unit comes to mind... Personally I wouldn't want to be locked away in a forensic unit with no release date. It appears she is a danger to society going on what LE have release to the public. Either way it doesn't look good for her. I am inclined to believe justice will come for the incent lives that have been stolen. Just wish the system would hurry up for the loved ones left behind but I fear it will not come swiftly.:(

They really do have to wait. If she IS incompetent, and they push through anyway, the results of the trial can be thrown out and they'd have to start over. In some cases, they wouldn't even be allowed to refile the charges.

My personal view (I am not a trained professional) is that she's been dangerously insane for several years. And it's much harder to fool the real trained professionals than people think it is.

The online docket is back up finally. FWIW, at the top it still lists her case as inactive, but the judge may not have ruled on anything yet either. MOO

I don't think they're going to push. Trained professionals are either going to deem her competent or not. For the most part, that bar has been historically low but I'm assuming they're working within specific guidelines. It will be interesting to see. I'd assume we'll know more in the next couple of days.

SBM. Strangely, she didn't appear insane while frolicking with Chad in Hawaii and didn't sound insane in her police interview after Charles' murder or upon the welfare check. Dangerous, yes; delusional, probably. She was hiding both from police. Not being able to understand the consequences of her actions? I doubt it. IF she is insane, she got worse than she was around the time of the murders. (IMO)

Chad Daybell’s attorney has been busy. Besides motion/order to seal, John Prior motions to dismiss indictment, strike the death penalty & DQ prosecution including out of state prosecutor Rachel Smith. He also wants to see homicide/DP cases she has served as counsel or worked on.

Did LV have an actual hearing on Monday? That was just an approximate date I picked from the Judge saying "180 days". :)

Two years ago….we were standing at the tiny Rexburg airport with a wonderful crew from Dateline NBC when Lori Vallow Daybell landed in this plane. She was escorted by several law enforcement officers from Hawaii to Idaho - and then taken to the Madison County Jail where a hoard of media was waiting.

A competency update is expected next week in her case. If doctors deem her competent, she will head back to jail and await her trial. If not, she remains in the state hospital until she is psychologically competent. Hard to believe it’s been two years.
