I hate say this but the burden of proof is on the prosecution not the defense. So far no hard evidence has been shown that either child has been harmed.
She has been charged with not supporting them, I believe, rather than harming them and also contempt of court by failing to produce them to the family court.

In late November, right before the welfare check, Kay guessed Charles' email password correctly. From there, Kay located Lori's whereabouts through discovering that a shipment from an Amazon purchase was sent to an Idaho address. Finding Lori's Amazon purchases is what led to the welfare check -- Kay now had an address to give to the police.

That it was her wedding ring is just wild.

I think this ring was the Amazon purchase that alerted KVW to Lori's new address and thus enabled the welfare check request. MOO.
If that purchase ends up being what got her caught, it will have a certain ring of poetic justice to it

I hate say this but the burden of proof is on the prosecution not the defense. So far no hard evidence has been shown that either child has been harmed.

That may technically be the case in a legal sense, but in real trials jurors pay attention when defense attorneys fail to address a charge specifically, fail to discredit a witness or deflect by accusing someone else without presenting any evidence supporting their accusations. Lori's lawyer can give opening and closing arguments saying Lori has been wrongly accused and someone else has the kids. But if he never shows where the kids are or proves the claims he makes in the opening statements then their defense is going to fail IMHO. The only thing I'm leery of is if corona virus may lead to a sequestered jury (to keep the jury from getting sick, maybe) and if that happens then we could have another Casey Anthony verdict due to extreme life pressure on the jury-- it's bad enough being sequestered but to be sequestered and not know if your family members who are quarantined at home are still alive and well might be a bridge too far. Hopefully the pandemic will be over by the time this comes to trial.

As for your second sentence about there being no evidence of the kids being harmed, I disagree. The prosecution can show that Lori has not had any contact with her children since at least November 1st when she was under surveillance by LE. She hasn't made any arrangements for her children to receive food, medical care nor other basic necessities, nor has she paid anyone else to take care of her children's needs. Evidence will likely show that she has continued to receive and withdraw payments from SS that were supposed to go to her children's needs but she spent the money on herself and her new husband instead. And no evidence of the money ever going to her children's care. Then we will have testimony that she lied about Tylee being dead years ago. And her new husband lied to his family members and Tammy's family members saying Lori doesn't have any minor children and is an "empty nester". The lies told about the children by Lori, Chad and even Alex and then the attempts to get their friend MG to lie to police and say she had JJ with her when she hadn't seen him in months, plus Lori and Chad fleeing to Hawaii after the welfare check will be used as evidence that the children have likely been harmed as well. They were given several opportunities to present the children or even to arrange a facetime with the children to police and they didn't do that. Instead they fled and they hid in Hawaii. Lori's actions at every turn of the investigation show her children are in grave danger, if not already harmed.

All that said, while it's my opinion the children have been harmed, the prosecution will not be trying to prove she harmed the children yet since there are no murder charges and no abuse charges. The prosecution only has to prove felony desertion and non-support plus evidence of the other misdemeanor charges (solicitation, obstruction & contempt). MOO.

Lori current charges:

Desertion and Nonsupport of Dependent Child Under 18 YOA, I18-401(1), Felony on 9/23/2019

Desertion and Nonsupport of Dependent Child Under 18 YOA, I18-401(1), Felony on 9/08/2019

Arrests & Seizures-Resisting or Obstructing Officers, I18-705, Misdemeanor, 11/26/2019

Criminal Solicitation to Commit a Crime, I18-2001 {M}, Misdemeanor, 11/26/2019

I dont see her not getting convicted on those charges. I cant think of any defense she can offer that would offset the fact that she refuses to account for their whereabouts. Her best explanation would be to claim that Tylee took JJ and they ran off together. Lori could claim she refused to reveal that to protect Tylee but I cant see any rational juror accepting that.
What i was saying is that the prosecution needs to tred carefully with what they charge. I think so far they have charged appropiately.

So they searched Alex's Rexburg apartment a second time on 19th Dec. Did they believe the kids may have been there between 27th Nov, when they previously searched it and 19th Dec? I wonder if they also searched the house where he died on the 12th Dec in Az? They surely would not just search the Rexburg appt and not the Az home would they? I do wonder about Alex's wife and what she must know. Do many posters believe Lori can produce them unharmed?

Speaking of AxCP residences - do we know if the and AZ police or sheriff ever searched the place he was evicted from?

okay, I needed to laugh, thank you! That is perfect!

I imagine explanation will go something like that. Chad being a visionary, knew Tammy was going to depart into the better world very soon.
Wasn't it his claim that Tammy's departed spirit is the one who helped him reconnect with Lori, overcome his grief, and move on to the next phase of his life? Kinda hard to believe that when Tammy was still alive at this point and Chad and Lori are apparently already making plans to be together.

I don't think others understood it was humor; but I've been around the system enough to have heard that more times than I can count. Glad you could laugh. We all need that this last few weeks; and going forward too!!!

Pardon my ignorance, but can Lori be charged for using other people's credit/bank cards? Credit card fraud, identity theft, or something? Since it seems she's used CV's credit card and/or Tylee's bank cards.

Interesting. I'm expecting the opposite-- no crazy religious beliefs will be brought up in court by the defense IMO. Instead she will try to claim someone else took her children and she has no idea where they are now. Maybe she will claim (through her lawyer) that JJ's grandparents are hiding him and they are persecuting her through the police and courts out of spite because her brother Alex shot Charles. And she might keep saying (through her lawyer) that Tylee is in college somewhere but is an emancipated teen and stopped communicating with her, so she doesn't know where she is either. Neither explanation will make any sense but I expect she will double down on whatever explanations she has given to her lawyers and followers already. I'm basing that on Lori's past history of interactions with the police and others outside the cult.

Some examples:

1. When she talked to the police after Charles was murdered she knew not to mention any religious beliefs at all and she blamed the victim. She made up a bunch of lies about Charles being abusive and mean. She had been telling her friend in Hawaii the same lies and had been lying to her family saying Charles was cheating on her before he died. None of her lies had a religious component.

2. In early 2019, after she had stolen money from Charles' business bank account, changed the locks on the house, removed all his clothing, his business computer and anything of value from the house, taken his truck so he couldn't get back from the airport, canceled his flight, hidden Bailey's collar and JJ's meds, JJ's clothing and i-pad, etc, Charles took her purse and car keys to try to prevent her from leaving the parking lot of JJ's school so that she could be served with the order for a psych eval. Lori went straight to the police (with a friend) and told a story that made herself the sympathetic victim and made Charles look like a controlling/abusive spouse who stole her purse. She didn't mention any religious beliefs to the police then.

3. Lori has passed at least 2 psych evaluations in the past, which indicates to me she knows not to bring her crazy religious beliefs up. The first one we know about was in 2011 during a joint child custody case involving Lori, Charles, Charles ex-wife Cheryl and Lori's ex-husband Joe Ryan. Lori tried to make an excuse to get out of that one, but in the end she ended up showing up early for her appointment and as far as we know nothing was uncovered. The 2nd psych eval she passed was in early 2019 right after the purse incident- she was in and out within a matter of hours. If she had mentioned anything about Charles being possessed by a zombie named Nick Schneider I believe they would have held her for observation.

4. During that same time period as the 1st psych eval mentioned above a judge ordered cameras in Lori and Charles' home because of accusations of some kind against her (we don't know what the accusations were). Nothing untoward was ever captured on camera. IMHO Lori knew she was being filmed and was able to control herself as long as the cameras were there.

5. We have records of Lori talking to JJ's school and other people such as the dog trainer and nanny. She knows not to use her religious beliefs as an excuse for her behavior with them. She makes up other lies instead. Sometimes pointless lies-- such as telling JJ's school Charles committed suicide and telling the dog trainer that Tylee was already in college in Idaho when Tylee was at home and would move with them. She lied to make herself seem like a victim who was forced to move out of state and uproot her children's lives because of "circumstances beyond her control" when the reality is she is making choices on where to move and what she wants to do.

Lori is very cunning at this lying game and has seemingly been doing it all her life, never accepting any personal responsibility for failed marriage after failed marriage or anything else that happens to her. When her 2nd marriage ended she told a friend that Colby's father didn't want a relationship with her and Colby. We don't know the truth of the situation, but she was the one who filed for divorce in that marriage. I think the wild religious beliefs are only shared with people they perceive share their beliefs and will accept that as an excuse. Believing your children and/or spouses are zombies has never been grounds for murder and it never will be. Lori and company are well aware of that IMO. I expect instead of revealing their wild beliefs we will see more wild accusations against other people such as the ones made against Brandon in the letter from Melani's lawyer.

MOO.
Great points, Gardener1850. I like the way you think.
I don't disagree that she's a clever woman and a talented storyteller. Her lies and her charm have been her secret weapon, but she's out of ammo. She's not in the same position she was in last year, before she was in any real trouble. Now she's "cult mom." The prosecution isn't going to gloss over her unorthodox beliefs, and it would be naive of the defense to develop a strategy that didn't embrace Lori's fringe mindset. I predict that they are going to flip the narrative. I do agree that there's going to be some creative blame games.

She's preggers too?

Nahhh... She probably developed some goddess-gout when traveling to other planets which puts her at higher risk ;)
