Not a lawyer either but IMO it will matter by the weight of the argument the defense makes. If the defense can offer a good reason to lower bail (cant think of one) it will be lowered.

Based on what @Tortoise already posted it will have to be something significant and new.

Like evidence the kids are not abandoned for example.

You cant just relitigate the original hearing

Fremont County hands over to the Attorney General's office - could be down to resources and expertise but I wonder - could it be because they see themselves hampered by having handled the attempted murder (paintball) and death callouts, and treated one as a prank and two as non-suspicious? Is it because they would have to call their own officers as witnesses and attack their credibility, as they would be more aligned with the defense case?

My other suggestion is that it could be to do with ultimately getting a pool of untainted jurors?

Probably wrong with both guesses but I would love to hear a lawyer's perspective on this.

I am intrigued by the fact that on the first page of the letter there are 5 criteria which can be used to ask for assistance. On page 2 of the letter it shows three of the criteria with a check in the box of one of them (no.2 shown below). So why show the other two unchecked (criteria 1 & 3), and why exclude two others (criteria 4 and 5)?

The five criteria are -

providing prosecutorial assistance...
1. ...due to a conflict of interest.
2. ...due to other reasons without local prosecutor involvement.
3. ...with local prosecutor involvement.
4. providing only investigative assistance.
5. providing investigative assistance and, if determined by the investigation to be warranted, prosecutorial assistance without the involvement of the local prosecutor.

ETA - another possibility - could also be due to the high profile nature of the case as a whole.

My guess is because a whole lot of charges with multiple felons are being investigating so that the investigation is being consolidated at the highest level

ETA - that pretty much seems to be confirmed by the Idaho AG's own press release.

e.g. If they can link Lori and Alex to the Tammy murder, then they need to kick upstairs rather than run the prosecution in parallel locally. We also know there is an out of state possible murder.

This would tend to indicate murder/conspiracy charges are going to drop against our dear friends

I thought you might enjoy some other coverage of the case by Scott Reisch, criminal defense attorney based in Colorado. I've just had approval to link them but we aren't allowed to sleuth the attorney, obviously.

He has more related to the case on his channel.

The first one starts discussing LV at 6mins:52s, and the second one starts from the beginning and lasts for about 6 minutes.



I watched these - thanks for the vids.

I was also wondering why Means was requesting discovery of a whole bunch of stuff his client is not charged with. Of course this rather gives the game away that he knows his client may soon be charged with it.

I also agree the guy is way out of his depth. He should be litigating this case in the media but they seem to have no strategy at all. Which makes me wonder if the defence just intends to eat these charges and offer no active defence. Because the problem is, if they start trying to make an active defence about where the kids are that could really place them in a bad place when murder charges drop.

I just want to throw in an opinion. As and Idaho resident, I feel our AG is extremely competent and fair. I have a friend who works for him and I’ve met him. This is definitely a good thing.
Great, hope they pick CD up very soon and put him in a cell.

I have a question for the legal eagles: On page 2, lines 9-10 of Charles Vallow's 15 February 2019 divorce petition, it states: "Parties have one (1) minor child in common, namely: Joshua Jaxon Vallow ("JJ")" On lines 10-11 of page 3 it states "(the parties have emancipated children along with JJ)" This appears to assert something I wasn't aware of: Tylee was an emancipated minor.

So my question is: Under Idaho law, can you be charged with abandonment of an emancipated minor?
I'm no legal eagle but are they talking about Colby and the sons of CV here rather than Tylee?

It's got to be CV19 threat in jail as the new facts I think. The risk of catching it in prison must be higher than in your home.

I’ve always suspected that CD was a rising star in his organization, and by no means the head of it. I believe it’s helmed by wealthier people cloaked in secrecy, who are threatened by exposure because of the national attention Lori’s actions has brought. I think these other members probably include community leaders and/or members of LE.

I recall from the Anne Marie Fahey case, the AG got involved at first because the Wilmington PD needed their permission to do wiretaps. Local LE didn’t have that power. Also b/c the suspect and POI’s were all “connected” so to speak, and the case was garnering a lot of attention. Then the US district attorney got involved kinda on a whim, the exact reason escapes me. But the FBI was already involved because a couple of the POI’s had been federal informants in the past, so the FBI were consulted about them. It was really a clusterf*** of reasons why all these agencies got involved, lol. Of course the US attorneys office can get involved in whatever they feel like.
As the feds are already involved and there is at least one other attempted murder as well as CV's murder, both in AZ could that also be a reason for the AG to get involved? Federal charges on the way?

So, in that world of wealthy so-called prophets is Tax evasion, familial deaths, life insurance claims, etc higher than the national average?
As executive secretary, did CD handle any funds?

First of all she was over 16, almost 17, so in Idaho she can marry at 16 or 17, is it, so surely she must at least since 23 Sept now be an emancipated minor? So my view is LVD (and CD) may only be able to be charged regarding JJ. MOO of course.

Not exactly sure how to answer, since you're responding to a post that seemingly refers to issues outside of normal LDS church channels, but asking a question that seems to be very directly referring to things within normal LDS church channels.

So I'll answer the only way I think the question can be answered (in reference to normal LDS church channels): executive secretaries have no access to funds. Those are handled through the congregation's bishop and ward clerk (or stake president and stake clerk at a higher ecclesiastical scale).
