Defense attorney Brad Rozzi resumed questioning of Indiana State Police Sgt. Jason Page.

Page said it was not his job to determine the girls’ times of deaths when asked an opinion about when that may have happened.

“Do you know if a rape test kit was given?” Rozzi said.

“I would assume. I wasn’t there,” Page said.

Rozzi next asked about the sticks placed over the bodies. Page said he’s seen other death investigations where bodies had sticks placed over them. Page said, in Delphi, a human appeared to have placed the sticks over the girls’ bodies.

Rozzi also asked about the depth of Deer Creek, the size of the footprints found, the blood around the area where the bodies were found, and about information on the hair found in Abby’s hand. Page responded, “You’re asking questions out of my knowledge.”

Page also revealed that he was not aware of any DNA from Allen found at the scene.

Page later explained his job — he was the 14th law enforcement officer to arrive at the crime scene — was to preserve the area through photography.

3. Jurors saw 147 photos taken by State Police CSI investigators. Pics show the girls’ bodies lying in the woods w their throats slit. Libby’s body was naked, her face & hands covered in blood. Abby was wearing a sweatshirt & jeans, blood visible on her neck w deep wound. #wthr

4. All 3 ISP investigators who took pics/collected evidence at the crime scene testified. They showed photos of the ground near the bodies “saturated in blood.” Another pic showed blood on a nearby tree. The photos were shown on that large video screen in the courtroom. #wthr

6. The families of Abby & Libby were also shaken. Both moms cried. At times, they turned away or put their heads down to avoid seeing the most graphic images. Pics of the girls’ faces, Libby’s hands & feet, the aerial & low angle shots…it was a LOT to take in for everyone. #wthr

7. The point of today’s testimony wasn’t just to show jurors the crime scene pics but to allow investigators to explain how & where they collected evidence at “ground zero.” That’s the immediately area around the bodies where nearly all evidence was collected. #wthr

8. The investigators discussed where they found blood, sticks on the girls’ bodies, notable disturbances on the ground, etc, and jurors saw a CSI diagram of the crime scene. This is a rendering that I drew in my notes today based on the diagram shown to jurors. #wthr

10. Defense attorney Brad Rozzi questioned the ISP investigators on why sticks on the bodies were not taken as evidence right away rather than returning later to gather them & place them into evidence. One CSI agent said it’s hard to get DNA off a stick so they saw little value.
8:49 PM · Oct 21, 2024

11. Rozzi also grilled investigators about an unspent bullet cartridge they discovered between the bodies. He asked why they took no pics/video showing the item being removed from the scene, questioning the chain of custody and integrity of the evidence collection. #wthr
8:52 PM · Oct 21, 2024

12. The ISP investigator who found the cartridge testified he brushed away leaves near the evidence very gently. Another said there’s no reason to video the evidence being removed from the ground. The bullet, which the state later tested & linked to Allen, is central to the case.

DAILY TRIAL HIGHLIGHTS

DAY 3 – 10/21/24

  • Carroll County Deputy Darron Giancola, who was one of the first law enforcement officers on the scene, testified about the scene where the girls’ bodies were found.
    • Giancola said he did not see their bodies as he walked south from the cemetery to the creek, but did see a multi-colored shirt and and one Nike shoe in the creek when being called to the scene.
    • Giancola said Libby’s body was unclothed, while Abby was clothed. Giancola recalled seeing a significant amount of blood on their bodies and the ground.
  • Abby’s clothes and shoes appeared to be damp, presumably from crossing the creek. It was determined that Abby’s body was wearing Libby’s jeans and sweatshirt, while Abby’s clothing and Libby’s t-shirt were found in the creek inside out.
  • Sgt. Jason Page, a crime scene investigator with the Indiana State Police, took the jury through 44 images.
    • WATCH: Witnesses Detail Delphi Murders Crime Scene in Richard Allen’s Trial
    • Tree branches were found on the girls’ bodies. A large branch appeared over Libby’s upper body.
    • During a heated cross-exam between defense attorney Brad Rozzi and Jason Page, Rozzi asked several questions regarding the unspent bullet.
    • Rozzi asked why there weren’t more photos taken of the bullet on the ground and why there are no pictures of the bullet while it was being removed from the ground, and after it was removed from the scene.
    • Attorneys raised several questions about the sticks and branches found on and around the girls’ bodies during Monday’s sessions.
    • Photos of Libby’s body, the sticks, and blood found in the area were shown in court. The defense questioned investigators on whether they think the sticks may have been placed there by someone. Page said, “It was reasonable to believe it was placed there by a human act.”
  • ISP CSI Duane Datzman testified to being the CSI who discovered the bullet found between the girl’s bodies.
    • Defense attorney Andrew Baldwin tried to emphasize the defense’s interest in the bullet at the crime scene. Arguing that they believe more photos should’ve been taken of the bullet found at the scene.
    • The sticks and branches laid on top of the girls were not collected at the time, even though some had blood on them. They were deemed to not be of evidentiary value so they were left.
    • On March 10, 2017, Datzmanwas asked to go get them. He relied on memory and photos to make sure he grabbed the correct limb, branches and twigs.
  • ISP CSI Brian Olehy, the lead CSI at the crime scene, testified about the documentation and collection of evidence
