11:00 a.m. Flurry of orders from Judge Gull​

  • Order returning equipment: Judge Gull returned cameras and equipment to members of the media, after the court confiscated them for violating decorum rules.
  • Order prohibiting defense use of sketches: Judge Gull granted the prosecution motion to prohibit the defense from using the composite sketches of ‘bridge guy’ in the trial.
  • Evidence stipulations: The prosecution and defense have agreed that certain evidence may be admitted to the trial without having to have an expert or witness verifying its origins or confirming a chain of custody. These items include videos of Allen while in custody, medical records and items collected at the crime scene.
  • Jury instructions: Judge Gull released the instructions the jury will receive when the trial is nearly concluded. Those instructions can be read below.
  • Motion to quash subpoena: Robert Ives, the former prosecuting attorney for Carroll County is asking the court to deny the subpoena calling him to testify about his previous work on the case.
  • Kegan Kline transport order: The court has arranged for transportation for inmate Kegan Kline to come to the Carroll County court to testify.

TESTIMONY FROM DAN DULIN​

At 9:59 a.m. the state called Dan Dulin to the stand. Dulin is a Captain with the Department of Natural Resources and has been a conservation officer for 26 years.

Dulin had worked across the state of Indiana, but had worked in the Carroll County area for 10 years. He told the jury he became involved with the investigation on February 16, 2017.

TESTIMONY FROM KATHY SHANK​

Court was back in session today with the jury entering the courtroom at 9:06 a.m. The judge shared that the jury was able to access their phones, call their families and view work emails briefly last night. They have not seen any media coverage.

9:08 a.m. The state called Kathy Shank. Shank acted as a “secretary” for the investigation. She would take tipster’s names and information. Shank said she was surrounded by 50 or more law enforcement officers while working the investigation.

Of the more than 50,000 tips received in #DelphiMurders only ONE mentioned Richard Allen, and that came from him on 2/16/17. The video the state says shows his car arriving on 2/13/17 - wasn't obtained until 9/2022, per testimony of Kathy Shank and Steve Mullin.


It was still in the possession of the Hooser Harvestore, per today's testimony. Mullin testified previously he took screen shots of it, but apparently they didn't take the entire video back in 2017.


Seems they should have collected that when they discovered it existed in 2017.

13 Thing To Know From The Delphi Murders Trial Today - Oct 24 Sorry for getting this out late. Long day at the office.

1. Today the State focused all testimony squarely on Richard Allen, telling jurors how they zeroed in on the defendant & why they arrested him.


2. Jurors learned Allen “fell thru the cracks” of the state’s Delphi Murders investigation, resulting in a 5-yr delay in his arrest. Investigators literally forgot Allen called their tipline 3 days after the murders to report being on the Monon High Bridge the day of the murders.

3. It was a volunteer file clerk who discovered a summary of Allen’s 2/18/17 interview with a DNR investigator that triggered his 2022 arrest. The file clerk testified today, as well as the investigator who conducted the 2017 interview discovered in an old file box.

4. The investigator met Allen in this grocery store parking lot. He said nothing from the interview seemed unusual & Allen’s file was marked “CLEARED.” Again, Allen called police ON HIS OWN to say he was near the crime scene the day he allegedly killed 2 girls. Think about that.

5. Former Delphi Police chief Steve Mullin & sheriff Tony Liggett both told jurors that after finding the 2017 RA interview in 2022, they quickly re-interviewed Allen & searched his home where they seized lots of knives & a gun later linked to a bullet casing at the crime scene.

6. ISP Lt. Jerry Holeman testified that during the search, when Allen was told he could file a complaint if investigators damaged his house,Allen replied “It doesn’t matter, it’s over.” Defense attorneys said the testimony from Holeman lacked importance context.

7. Sheriff Liggett told jurors the recovered gun allegedly linked to the crime scene bullet casing “put us over the edge” to arrest Allen. But he said even without that evidence, he had enough to arrest RA based on witness statements placing Allen near the crime scene. And then…


8. The defense went on the attack. During cross examination, atty Brad Rozzi asked Liggett about the statement of witness Betsy Blair, who described seeing Bridge Guy (the man seen on Libby’s phone & who the State says is Allen). It led to a remarkable admission by the sheriff.

9. Rozzi: “Betsy Blair saw a man who was boyish and beautiful with brown poofy hair in his 20s or 30s…Her description does not match the description of Richard Allen.”Liggett: “But neither do the 3 girls’ [descriptions] of Richard Allen.”Rozzi: “Exactly. Right.”


10. Yes, the sheriff pointed out for the jury that all four State witnesses who saw Bridge Guy on the day of the murders described seeing someone who does NOT look like the defendant. Not a great moment for the prosecutor who otherwise made some progress today.

11. The defense also pushed back hard on witnesses who seemed to spin testimony by leaving out important context or details. Atty Andy Baldwin scolded witness Steve Mullin:“You are so desperate to place Richard Allen’s car traveling west on 300N that…you lied to this jury.”

]Delphi Murders Trial Day 6 Recap:

I'll start where I left off on my morning recap and that was with Steven Mullin back on the stand. He's the investigator for the prosecutor's office.

-Once tip from Richard Allen resurfaced in Sept. 2022, Mullin got a call from Tony Liggett
-They began looking in to Allen
-They found out what cars he drives which included a 2016 Black Ford Focus
-He went to Hoosier Harvest store to see if cameras there captured the vehicle as it had several other cars
-Vehicle matching that description seen at 1:27 PM
-Car was traveling east to west
-Camera doesn't capture license plate or the driver
-Mullin said shape and appearance are consistent
-The time is significant because Allen said he arrived at the trails around 1:30
-After that, Mullin and Tony Liggett went to speak with Allen
-Mullin said they went to Allen's home and asked to speak with him
-Mullin said they told him he was not obligated to go with them but Allen agreed to do so
-Mullin said he advised Allen of his rights
-During the interrogation, said he visited his mom that day
-Afterwards he went home, got a jacket and then went to the trails
-He said he walked past three girls on the trail
-Allen said during that interview that he arrived at noon and then left at 1:30
-He told Mullin he walked to high bridge to look at the fish
-Allen said he normally goes to the trails through the city but may have gone through the country
-If he took the country route, he would pass by the camera on the Hoosier Harvest store
-Allen told investigators he was wearing black or blue Carhart jacket, jeans and boots
-Mullin said during the interview he initially was going to let them look through his phone but changed his mind
-Mullin said he became "agitated" when they showed him photo of bridge guy
-Mullin said Allen responded by saying "if the picture was taken with the girls camera..."
-"...there's now way it could be me"
-Allen then walked out and ended the interview
-During cross examination, Baldwin accused Mullin of lying to the jury
-Baldwin asked Mullin to point out in the transcript of the interview where Allen said he may have gone west on the road
NOTE: If he's going west on the road, he'd pass in front of the camera

-Mullin looked through the transcript for roughly 5 minutes but couldn't find it
-Baldwin said Allen actually said he had gone by the high bridge entrance
-Mullin said it was his "interpretation" that Allen was talking about the Mears entrance which would mean Allen was traveling west
-Baldwin smirked and said "your interpretation"
-Baldwin says Allen told them he took "the loop" that day
-Mullin acknowledged it was a route Allen said he possibly took
-Baldwin asked if Allen told them he went through town to get to the trail which would mean he was going east on the road by the trails
-Mullin said yes
-Baldwin says "He told you if he was going to Monon High Bridge then he'd go through town"
-Mullin responded "Not how I interpret what he was saying"
-Mullin agreed with Baldwin that the theory from prosecution is that Allen was parked at the old CPS building from 1:30 to 4
-Baldwin asked if there was anything to contradict that in the investigation?
-Mullin said he wasn't aware of anything
-Baldwin then brings up Betsy Blair and her description of the car parked there that day
-McLeland asks to approach and Baldwin ended his cross
-Jury asked a few questions including if Mullin investigated how many other black Ford Focus cars there are in this area.
-Mullin said no
-Next up was Sheriff Tony Liggett
-A enhanced version of the video from Libby's cell phone was played
-Liggett was asked what he believes he heard and said:

Abby: "Is he right there"
Abby: "Don't leave me up here"
Libby: "See this is the path"
Libby: "That be a gun"
Libby: "There's no path here"
Male: "Guys"
Girls: "Hi"
Male: "Down the hill"
-Defense attorney Brad Rozzi asked to strike the line about the gun and Judge Gull agreed
-Liggett said after tip resurface he researched Richard Allen and found out he worked at CVS, had a lifetime handgun permit and drove a 2016 Ford Focus
-Said he and Mullin interviewed Allen
-Told the jury Allen was "wishy washy" about where he parked
-Liggett then talked about search warrant on Allen's home on October 13, 2022
-Inside home they found Sig Sauer .40 gun
-Found a .40 cartridge in a "keepsake" box as well as a blue Carhart jacket
-Defense attorney Rozzi then crossed and insinuated Liggett wanted to make arrest because he was running for Sheriff
-Rozzi asked if he was aware of any leaks of info early on in the case. Liggett said yes
-Rozzi then asks if bridge guy should be seen on video since he was seen walking along the road. Liggett says yes.
-Rozzi asks if they saw anyone the video. Liggett says no.
-Liggett said searches for evidence were never done in the fields along that roadway
-Rozzi then asks if there's any DNA evidence connecting Allen to the scene? Liggett says no.
-Rozzi asks if any digital evidence connects Allen to the scene? Liggett says no.
-Rozzi then asked if there were pieces of the girls clothes missing from the scene? Liggett said yes
-Those pieces of clothing have still never been recovered
-Rozzi talks about Betsy Blair and asks if it's okay to just believe what she saw because her description does of bridge guy doesn't match Richard Allen
-Liggett says "neither do the 3 girls" who were on the trail
-Rozzi said "that's exactly right"

Sheriff Liggett stepped down and I had to leave the courtroom to brief other members of the media pool. I'm still compiling those notes. More to come.
And by those notes, I mean the notes about witnesses that took the stand after I left.

DAILY TRIAL HIGHLIGHTS​

DAY 7 – 10/25/24​

  • Melissa Oberg, a forensic firearms examiner, explained and demonstrated to jurors how a semi-automatic pistol cycles cartridges to the gun. After lunch, the jury will see two videos showing how Sig Sauers are manufactured.

DAY 6 – 10/24/24​

  • Kathy Shank, a retired CPS worker and volunteer clerk who organized and evaluated approximately 14,000 tips given to law enforcement after the murders, took the stand to talk about her work on the case.
    • Shank began working on the case in March 2017, and the tips filled five filing cabinets. In 2020, the paperwork was digitized in a process that took two years.
    • When investigators moved buildings in 2022, Shank said she found a box in a drawer with a lead sheet from Feb. 16, 2017, labeled “Richard Allen Whiteman.” The tip indicated that Allen had been on the trail on Feb. 13. Shank said the file had the word “CLEARED” written on it and said, “I don’t know how that tip ended up in that box.”
    • The name on the file was changed from “Richard Allen Whiteman” to “Richard Allen” on Sept. 21, 2022. Whiteman is the name of the street on which Allen lived.
      • The file revealed that Allen self-reported that he was on the trail the last day the girls were seen. Shank said that was the only tip provided.
  • Daniel Dulin, a former lieutenant with the Indiana State Police, testified to his work on the case following up on leads.
    • Dulin called Allen on Feb. 18, 2017, after picking up a lead sheet. He asked to meet at Allen’s house, but Allen preferred to meet at a grocery store parking lot.
    • Dulin testified that Allen told him he had been on the Monon High Bridge Trail on Feb. 13, 2017, from 1:30 p.m. to 3:30 p.m. — a change from his original statement to police which was that he was there from 1-3 p.m. Dulin described the interaction as brief, and the interview was not recorded.
    • Dulin said that in Sept. 2022, Fmr. Delphi Police Chief Steve Mullin told him that Allen’s height on his fishing license changed in April 2017 from 5’4 to 5’6 and the listed weight on his license dropped by 15 pounds.
    • While canvassing the crime scene, Dulin said he found sticks and branches with blood on them that were piled up in a 5-foot area. This was after the area had been released by authorities. He called the investigation center and asked them to return to the scene to collect the sticks.
  • Former Delphi Police Chief Steve Mullin testified to his Oct. 2022 interview with Allen.
    • Mullin said that Allen believed he was driving his Ford Focus when he went to the bridge in 2017. He still owned the car in 2022. Allen said he was wearing blue jeans, a blue or black Carhartt jacket, a skullcap, and military-style boots or sneakers. Allen reported seeing three women — one older and two younger — on the trail that day.
    • When Mullin asked Allen if he was the “Bridge Guy,” Allen responded, “If the picture was the one that was taken on the girl’s camera, there’s no way it could be me.”
  • Carroll County Sheriff Tony Liggett testified that he reviewed the tip about Allen that Shank found in Sept. 2022. He said, “It stuck out. I wasn’t aware anyone had seen three girls on the trail that day. We believed it was ‘Bridge Guy,'” Liggett said.
    • The jury saw the video again – this time enhanced to stabilize the man and to listen to what was being said: “Guys, down the hill.” The victims’ family could be heard crying in the courtroom while the video played.
    • Liggett took photos of Allen’s Ford Focus at the CVS drugstore where he worked and noted that it was parked backed into the spot.
    • Liggett testified to items found at Allen’s house in Sept. 2022 when officers served a search warrant, which included a .40 caliber handgun, ammunition, a single .40 caliber bullet in a keep-safe box, a blue Carhartt jacket, and a gun registered to Allen.
  • ISP detective David Vido assisted in the search of Allen’s home on Oct. 13, 2022 and showed pictures to the jury that included a Ford Focus parked outside.
    • During the search, nearly 30 knives and at least four box cutters found inside the home were confiscated, along with 12 phones, two pagers and two SD cards.
    • All the items were tested, but nothing came back to link the items to the crime scene.
  • ISP Lt. Jerry Holeman testified to his supervision of the search. He sat in the car with Allen, and when he asked Allen if he wanted to fill out any forms for items taken, Allen said to him, “It doesn’t matter. It’s over.” Holeman said that Allen repeated himself twice.
